<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id50b1e03e-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8122"><num value="8122">§ 8122.</num><heading> Time for making claim</heading><subsection style="-uslm-lc:I11" class="indent0" id="id50b1e03f-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8122/a"><num value="a">(a)</num><chapeau> An original claim for compensation for disability or death must be filed within 3 years after the injury or death. Compensation for disability or death, including medical care in disability cases, may not be allowed if claim is not filed within that time unless—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id50b1e040-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8122/a/1"><num value="1">(1)</num><content> the immediate superior had actual knowledge of the injury or death within 30 days. The knowledge must be such to put the immediate superior reasonably on notice of an on-the-job injury or death; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id50b1e041-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8122/a/2"><num value="2">(2)</num><content> written notice of injury or death as specified in <ref href="/us/usc/t5/s8119">section 8119 of this title</ref> was given within 30 days.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id50b1e042-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8122/b"><num value="b">(b)</num><content> In a case of latent disability, the time for filing claim does not begin to run until the employee has a compensable disability and is aware, or by the exercise of reasonable diligence should have been aware, of the causal relationship of the compensable disability to his employment. In such a case, the time for giving notice of injury begins to run when the employee is aware, or by the exercise of reasonable diligence should have been aware, that his condition is causally related to his employment, whether or not there is a compensable disability.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id50b1e043-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8122/c"><num value="c">(c)</num><content> The timely filing of a disability claim because of injury will satisfy the time requirements for a death claim based on the same injury.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id50b1e044-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8122/d"><num value="d">(d)</num><chapeau> The time limitations in subsections (a) and (b) of this section do not—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id50b1e045-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8122/d/1"><num value="1">(1)</num><content> begin to run against a minor until he reaches 21 years of age or has had a legal representative appointed; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id50b1e046-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8122/d/2"><num value="2">(2)</num><content> run against an incompetent individual while he is incompetent and has no duly appointed legal representative; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id50b1e047-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8122/d/3"><num value="3">(3)</num><content> run against any individual whose failure to comply is excused by the Secretary on the ground that such notice could not be given because of exceptional circumstances.</content>
