<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id7c0ff976-8841-11e3-a17e-af2311883083" identifier="/us/usc/t5/s8128"><num value="8128">§ 8128.</num><heading> Review of award</heading><subsection style="-uslm-lc:I11" class="indent0" id="id7c0ff977-8841-11e3-a17e-af2311883083" identifier="/us/usc/t5/s8128/a"><num value="a">(a)</num><chapeau> The Secretary of Labor may review an award for or against payment of compensation at any time on his own motion or on application. The Secretary, in accordance with the facts found on review, may—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7c0ff978-8841-11e3-a17e-af2311883083" identifier="/us/usc/t5/s8128/a/1"><num value="1">(1)</num><content> end, decrease, or increase the compensation previously awarded; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7c0ff979-8841-11e3-a17e-af2311883083" identifier="/us/usc/t5/s8128/a/2"><num value="2">(2)</num><content> award compensation previously refused or discontinued.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7c0ff97a-8841-11e3-a17e-af2311883083" identifier="/us/usc/t5/s8128/b"><num value="b">(b)</num><chapeau> The action of the Secretary or his designee in allowing or denying a payment under this subchapter is—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7c0ff97b-8841-11e3-a17e-af2311883083" identifier="/us/usc/t5/s8128/b/1"><num value="1">(1)</num><content> final and conclusive for all purposes and with respect to all questions of law and fact; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7c0ff97c-8841-11e3-a17e-af2311883083" identifier="/us/usc/t5/s8128/b/2"><num value="2">(2)</num><content> not subject to review by another official of the United States or by a court by mandamus or otherwise.</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">Credit shall be allowed in the accounts of a certifying or disbursing official for payments in accordance with that action.</continuation>

<p style="-uslm-lc:I21" class="indent0">In subsection (a), the words “If the original claim for compensation has been made within the time specified in <ref href="/us/usc/t5/s770">section 770 of this title</ref>” are omitted as surplusage. The words “an award for or against payment of compensation” are coextensive with and, for clarity and consistency with section 8124, substituted for “the award”. The second sentence of former section 787 is omitted as included in the penultimate sentence of former section 793, which is carried into subsection (b). The last sentence of former section 787 is omitted as executed.</p>
<p style="-uslm-lc:I21" class="indent0">In subsection (b), the word “official” is substituted for “officer” because of the definition of “officer” in section 2104 which excludes a member of a uniformed service.</p>
