<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id50b450c4-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8134"><num value="8134">§ 8134.</num><heading> Funeral expenses; transportation of body</heading><subsection style="-uslm-lc:I11" class="indent0" id="id50b450c5-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8134/a"><num value="a">(a)</num><content> If death results from an injury sustained in the performance of duty, the United States shall pay, to the personal representative of the deceased or otherwise, funeral and burial expenses not to exceed $800, in the discretion of the Secretary of Labor.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id50b450c6-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8134/b"><num value="b">(b)</num><chapeau> The body of an employee whose home is in the United States, in the discretion of the Secretary, may be embalmed and transported in a hermetically sealed casket to his home or last place of residence at the expense of the Employees’ Compensation Fund if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id50b450c7-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8134/b/1"><num value="1">(1)</num><chapeau> the employee dies from—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id50b450c8-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8134/b/1/A"><num value="A">(A)</num><content> the injury while away from his home or official station or outside the United States; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id50b450c9-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8134/b/1/B"><num value="B">(B)</num><content> from other causes while away from his home or official station for the purpose of receiving medical or other services, appliances, supplies, or examination under this subchapter; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id50b450ca-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8134/b/2"><num value="2">(2)</num><content> the relatives of the employee request the return of his body.</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">If the relatives do not request the return of the body of the employee, the Secretary may provide for its disposition and incur and pay from the Employees’ Compensation Fund the necessary and reasonable transportation, funeral, and burial expenses.</continuation>

<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> Authorization to Provide.—</heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The head of an agency or department containing an element of the intelligence community may pay to the estate of a decedent described in paragraph (2) a burial allowance at the request of a representative of such estate, as determined in accordance with the laws of a State.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Description</inline>.—</heading><chapeau>A decedent described in this paragraph is an individual—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> who served as a civilian officer or employee of such an agency or department;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> who died as a result of an injury incurred during such service; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><chapeau> whose death—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> resulted from hostile or terrorist activities; or</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> occurred in connection with an intelligence activity having a substantial element of risk.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Use of Burial Allowance</inline>.—</heading><content>A burial allowance paid under subsection (a) may be used to reimburse such estate for burial expenses, including recovery, mortuary, funeral, or memorial service, cremation, burial costs, and costs of transportation by common carrier to the place selected for final disposition of the decedent.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Amount of Burial Allowance; Relationship to Other Provisions</inline>.—</heading><chapeau>A burial allowance paid under subsection (a) shall be—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><chapeau> in an amount not greater than—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> the maximum reimbursable amount allowed under Department of Defense Instruction 1344.08 or successor instruction; plus</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> the actual costs of transportation referred to in subsection (b); and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> in addition to any other benefit permitted under any other provision of law, including funds that may be expended as specified in the General Provisions section of the classified annex accompanying this Act.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Report</inline>.—</heading><content>Not later than 180 days after the date of the enactment of this Act [<date date="2012-01-03">Jan. 3, 2012</date>], the Director of the Office of Personnel Management, in consultation with the Director of National Intelligence, the Secretary of Labor, and the Secretary of Defense, shall submit to Congress a report on the feasibility of implementing legislation to provide for burial allowances at a level which adequately addresses the cost of burial expenses and provides for equitable treatment when an officer or employee of a Federal agency or department dies as the result of an injury sustained in the performance of duty.”</content>
