<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id1224fa34-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s8141"><num value="8141">§ 8141.</num><heading> Civil Air Patrol volunteers</heading><subsection style="-uslm-lc:I11" class="indent0" id="id1224fa35-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s8141/a"><num value="a">(a)</num><content> Subject to the provisions of this section, this subchapter applies to a volunteer civilian member of the Civil Air Patrol, except a Civil Air Patrol Cadet under 18 years of age.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id1224fa36-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s8141/b"><num value="b">(b)</num><chapeau> In administering this subchapter for a member of the Civil Air Patrol covered by this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id1224fa37-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s8141/b/1"><num value="1">(1)</num><content> the monthly pay of a member is deemed the rate of basic pay payable for step 1 of grade GS–9 in the General Schedule under <ref href="/us/usc/t5/s5332">section 5332 of this title</ref> for the purpose of computing compensation for disability or death;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1224fa38-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s8141/b/2"><num value="2">(2)</num><chapeau> the percentages applicable to payments under <ref href="/us/usc/t5/s8133">section 8133 of this title</ref> are—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id1224fa39-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s8141/b/2/A"><num value="A">(A)</num><content> 45 percent for <ref href="/us/usc/t5/s8133/a/2">section 8133(a)(2) of this title</ref>, if the member dies fully or currently insured under subchapter II of chapter 7 of title 42, with no additional payments for a child or children while the widow or widower remains eligible for payments under <ref href="/us/usc/t5/s8133/a/2">section 8133(a)(2) of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1224fa3a-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s8141/b/2/B"><num value="B">(B)</num><content> 20 percent for <ref href="/us/usc/t5/s8133/a/3">section 8133(a)(3) of this title</ref> for one child and 10 percent additional for each additional child, but not to exceed a total of 75 percent, if the member died fully or currently insured under subchapter II of chapter 7 of title 42; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1224fa3b-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s8141/b/2/C"><num value="C">(C)</num><content> 25 percent for <ref href="/us/usc/t5/s8133/a/4">section 8133(a)(4) of this title</ref>, if one parent was wholly dependent on the deceased member at the time of his death and the other was not dependent to any extent; 16 percent to each, if both were wholly dependent; and if one was or both were partly dependent, a proportionate amount in the discretion of the Secretary of Labor;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1225214c-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s8141/b/3"><num value="3">(3)</num><content> a payment may not be made under <ref href="/us/usc/t5/s8133/a/5">section 8133(a)(5) of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1225214d-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s8141/b/4"><num value="4">(4)</num><content> “performance of duty” means only active service, and travel to and from that service, rendered in performance or support of operational missions of the Civil Air Patrol under direction of the Department of the Air Force and under written authorization by competent authority covering a specific assignment and prescribing a time limit for the assignment; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1225214e-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s8141/b/5"><num value="5">(5)</num><content> the Secretary of Labor or his designee shall inform the Commissioner of Social Security when a claim is filed and eligibility for compensation is established under section 8133(a)(2) or (3) of this title, and the Commissioner of Social Security shall certify to the Secretary of Labor as to whether or not the member concerned was fully or currently insured under subchapter II of chapter 7 of title 42 at the time of his death.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id1225214f-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s8141/c"><num value="c">(c)</num><content> The Secretary of Labor or his designee may inform the Secretary of the Air Force or his designee when a claim is filed. The Secretary of the Air Force, on request of the Secretary of Labor, shall advise him of the facts concerning the injury and whether or not the member was rendering service, or engaged in travel to or from service, in performance or support of an operational mission of the Civil Air Patrol at the time of injury. This subsection does not dispense with the report of the immediate superior of the member required by <ref href="/us/usc/t5/s8120">section 8120 of this title</ref>, or other reports agreed on under that section.</content>
