<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id50b6c1a9-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8171"><num value="8171">§ 8171.</num><heading> Compensation for work injuries; generally</heading><subsection style="-uslm-lc:I11" class="indent0" id="id50b6c1aa-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8171/a"><num value="a">(a)</num><chapeau> The Longshore and Harbor Workers’ Compensation Act (<ref href="/us/usc/t33/s901">33 U.S.C. 901</ref> et seq.) applies with respect to disability or death resulting from injury, as defined by section 2(2) of such Act (<ref href="/us/usc/t33/s902/2">33 U.S.C. 902(2)</ref>), occurring to an employee of a nonappropriated fund instrumentality described by <ref href="/us/usc/t5/s2105/c">section 2105(c) of this title</ref>, or to a volunteer providing such an instrumentality with services accepted under <ref href="/us/usc/t10/s1588">section 1588 of title 10</ref>, who is—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id50b6c1ab-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8171/a/1"><num value="1">(1)</num><content> a United States citizen or a permanent resident of the United States or a territory or possession of the United States employed outside the continental United States; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id50b6c1ac-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8171/a/2"><num value="2">(2)</num><content> employed inside the continental United States.</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">However, that part of section 3(a) of such Act (<ref href="/us/usc/t33/s903/a">33 U.S.C. 903(a)</ref>) which follows the second comma does not apply to such an employee.</continuation>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id50b6c1ad-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8171/b"><num value="b">(b)</num><content> For the purpose of this subchapter, the term “employer” in section 2(4) of the Longshore and Harbor Workers’ Compensation Act (<ref href="/us/usc/t33/s902/4">33 U.S.C. 902(4)</ref>) includes the nonappropriated fund instrumentalities described by <ref href="/us/usc/t5/s2105/c">section 2105(c) of this title</ref>.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id50b6c1ae-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8171/c"><num value="c">(c)</num><chapeau> The Secretary of Labor may—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id50b6c1af-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8171/c/1"><num value="1">(1)</num><content> extend compensation districts established under section 39(b) of the Longshore and Harbor Workers’ Compensation Act (<ref href="/us/usc/t33/s939/b">33 U.S.C. 939(b)</ref>), or establish new districts to include the areas outside the continental United States; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id50b6c1b0-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8171/c/2"><num value="2">(2)</num><content> assign to each district one or more deputy commissioners as the Secretary considers advisable.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id50b6c1b1-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8171/d"><num value="d">(d)</num><content> Judicial proceedings under sections 18 and 21 of the Longshore and Harbor Workers’ Compensation Act (<ref href="/us/usc/t33/s918">33 U.S.C. 918</ref> and 921) with respect to an injury or death occurring outside the continental United States shall be instituted in the district court within the territorial jurisdiction of which is located the office of the deputy commissioner having jurisdiction with respect to the injury or death.</content>
