<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id50f948d2-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8456"><num value="8456">§ 8456.</num><heading> Military reserve technicians</heading><subsection style="-uslm-lc:I11" class="indent0" id="id50f948d3-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8456/a"><num value="a">(a)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id50f948d4-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8456/a/1"><num value="1">(1)</num><chapeau> Except as provided in paragraph (2) or (3), an individual shall be retired under this subchapter if the individual—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id50f948d5-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8456/a/1/A"><num value="A">(A)</num><content> is separated from employment as a military reserve technician by reason of a disability that disqualifies the individual from membership in a reserve component of the Armed Forces specified in <ref href="/us/usc/t10/s10101">section 10101 of title 10</ref> or from holding the military grade required for such employment;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id50f948d6-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8456/a/1/B"><num value="B">(B)</num><content> is not considered to be disabled under section 8451(a)(1)(B);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id50f948d7-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8456/a/1/C"><num value="C">(C)</num><content> is not appointed to a position in the Government (whether under subsection (b) or otherwise); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id50f948d8-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8456/a/1/D"><num value="D">(D)</num><content> has not declined an offer of an appointment to a position in the Government under subsection (b).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id50f948d9-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8456/a/2"><num value="2">(2)</num><chapeau> Payment of any annuity for an individual pursuant to this section terminates—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id50f948da-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8456/a/2/A"><num value="A">(A)</num><content> on the date the individual is appointed to a position in the Government (whether pursuant to subsection (b) or otherwise);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id50f948db-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8456/a/2/B"><num value="B">(B)</num><content> on the date the individual declines an offer of appointment to a position in the Government under subsection (b); or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id50f948dc-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8456/a/2/C"><num value="C">(C)</num><content> as provided under section 8455(a).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id50f948dd-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8456/a/3"><num value="3">(3)</num><content> An individual eligible to retire under section 8414(c) shall not be eligible to retire under this section.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id50f948de-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8456/b"><num value="b">(b)</num><chapeau> Any individual applying for or receiving any annuity pursuant to this section shall, in accordance with regulations prescribed by the Office, be considered by any agency of the Government before any vacant position in the agency is filled if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id50f948df-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8456/b/1"><num value="1">(1)</num><content> the position is located within the commuting area of the individual’s former position;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id50f948e0-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8456/b/2"><num value="2">(2)</num><content> the individual is qualified to serve in such position, as determined by the head of the agency; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id50f948e1-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8456/b/3"><num value="3">(3)</num><content> the position is at the same grade or equivalent level as the position from which the individual was separated.</content>
