<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id5a48322b-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501"><num value="8501">§ 8501.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">For the purpose of this subchapter—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id5a48322c-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/1"><num value="1">(1)</num><chapeau> “Federal service” means service performed after 1952 in the employ of the United States or an instrumentality of the United States which is wholly or partially owned by the United States, but does not include service (except service to which subchapter II of this chapter applies) performed—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id5a48322d-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/1/A"><num value="A">(A)</num><content> by an elective official in the executive or legislative branch;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5a48322e-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/1/B"><num value="B">(B)</num><content> as a member of the armed forces or the Commissioned Corps of the National Oceanic and Atmospheric Administration;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5a48322f-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/1/C"><num value="C">(C)</num><content> by members of the Foreign Service for whom payments are provided under section 609(b)(1) of the Foreign Service Act of 1980;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5a483230-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/1/D"><num value="D">(D)</num><content> outside the United States, the Commonwealth of Puerto Rico, and the Virgin Islands by an individual who is not a citizen of the United States;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5a483231-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/1/E"><num value="E">(E)</num><content> by an individual excluded by regulations of the Office of Personnel Management from the operation of subchapter III of chapter 83 of this title because he is paid on a contract or fee basis;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5a485842-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/1/F"><num value="F">(F)</num><content> by an individual receiving nominal pay and allowances of $12 or less a year;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5a485843-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/1/G"><num value="G">(G)</num><content> in a hospital, home, or other institution of the United States by a patient or inmate thereof;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5a485844-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/1/H"><num value="H">(H)</num><content> by a student-employee as defined by <ref href="/us/usc/t5/s5351">section 5351 of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5a485845-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/1/I"><num value="I">(I)</num><content> by an individual serving on a temporary basis in case of fire, storm, earthquake, flood, or other similar emergency;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5a485846-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/1/J"><num value="J">(J)</num><content> by an individual employed under a Federal relief program to relieve him from unemployment;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5a485847-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/1/K"><num value="K">(K)</num><content> as a member of a State, county, or community committee under the Agricultural Stabilization and Conservation Service or of any other board, council, committee, or other similar body, unless the board, council, committee, or other body is composed exclusively of individuals otherwise in the full-time employ of the United States; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5a485848-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/1/L"><num value="L">(L)</num><chapeau> by an officer or a member of the crew on or in connection with an American vessel—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id5a485849-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/1/L/i"><num value="i">(i)</num><content> owned by or bareboat chartered to the United States; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5a48584a-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/1/L/ii"><num value="ii">(ii)</num><content> whose business is conducted by a general agent of the Secretary of Commerce;</content>
</clause>

<continuation style="-uslm-lc:I32" class="indent2 firstIndent0">if contributions on account of the service are required to be made to an unemployment fund under a State unemployment compensation law under <ref href="/us/usc/t26/s3305/g">section 3305(g) of title 26</ref>;</continuation>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5a48584b-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/2"><num value="2">(2)</num><content> “Federal wages” means all pay and allowances, in cash and in kind, for Federal service;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5a48584c-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/3"><num value="3">(3)</num><content> “Federal employee” means an individual who has performed Federal service;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5a48584d-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/4"><num value="4">(4)</num><content> “compensation” means cash benefits payable to an individual with respect to his unemployment including any portion thereof payable with respect to dependents;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5a48584e-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/5"><num value="5">(5)</num><content> “benefit year” means the benefit year as defined by the applicable State unemployment compensation law, and if not so defined the term means the period prescribed in the agreement under this subchapter with a State or, in the absence of such an agreement, the period prescribed by the Secretary of Labor;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5a48584f-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/6"><num value="6">(6)</num><content> “State” means the several States, the District of Columbia, the Commonwealth of Puerto Rico, and the Virgin Islands;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5a485850-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/7"><num value="7">(7)</num><content> “United States”, when used in a geographical sense, means the States; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5a485851-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s8501/8"><num value="8">(8)</num><content> “base period” means the base period as defined by the applicable State unemployment compensation law for the benefit year.</content>
