<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id5102e5c6-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8701"><num value="8701">§ 8701.</num><heading> Definitions</heading><subsection style="-uslm-lc:I11" class="indent0" id="id5102e5c7-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8701/a"><num value="a">(a)</num><chapeau> For the purpose of this chapter, “employee” means—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id5102e5c8-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8701/a/1"><num value="1">(1)</num><content> an employee as defined by <ref href="/us/usc/t5/s2105">section 2105 of this title</ref>;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id5102e5c9-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8701/a/2"><num value="2">(2)</num><content> a Member of Congress as defined by <ref href="/us/usc/t5/s2106">section 2106 of this title</ref>;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id5102e5cc-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8701/a/5"><num value="5">(5)</num><content> a justice or judge of the United States appointed to hold office during good behavior (i) who is in regular active judicial service, or (ii) who is retired from regular active service under section 371(b) or 372(a) of title 28, United States Code, or (iii) who has resigned the judicial office under <ref href="/us/usc/t28/s371/a">section 371(a) of title 28</ref> with the continued right during the remainder of his lifetime to receive the salary of the office at the time of his resignation;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5102e5cd-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8701/a/6"><num value="6">(6)</num><content> an individual first employed by the government of the District of Columbia before <date date="1987-10-01">October 1, 1987</date>;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id5102e5d1-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8701/a/10"><num value="10">(10)</num><content> an individual appointed to a position on the office staff of a former President, or a former Vice President under section 5 of the Presidential Transition Act of 1963, as amended (<ref href="/us/stat/78/153">78 Stat. 153</ref>), who immediately before the date of such appointment was an employee as defined under any other paragraph of this subsection;</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">but does not include—</continuation>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id5102e5d2-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8701/a/A"><num value="A">(A)</num><content> an employee of a corporation supervised by the Farm Credit Administration if private interests elect or appoint a member of the board of directors;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id5102e5d3-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8701/a/B"><num value="B">(B)</num><content> an individual who is not a citizen or national of the United States and whose permanent duty station is outside the United States, unless the individual was an employee for the purpose of this chapter on <date date="1979-09-30">September 30, 1979</date>, by reason of service in an Executive agency, the United States Postal Service, or the Smithsonian Institution in the area which was then known as the Canal Zone; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id5102e5d4-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8701/a/C"><num value="C">(C)</num><content> an employee excluded by regulation of the Office of Personnel Management under <ref href="/us/usc/t5/s8716/b">section 8716(b) of this title</ref>.</content>
</subparagraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id5102e5d5-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8701/b"><num value="b">(b)</num><content> Notwithstanding subsection (a) of this section, the employment of a teacher in the recess period between two school years in a position other than a teaching position in which he served immediately before the recess period does not qualify the individual as an employee for the purpose of this chapter. For the purpose of this subsection, “teacher” and “teaching position” have the meanings given them by <ref href="/us/usc/t20/s901">section 901 of title 20</ref>.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id5102e5d6-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8701/c"><num value="c">(c)</num><chapeau> For the purpose of this chapter, “basic insurance amount” means, in the case of any employee under this chapter, an amount equal to the greater of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id5102e5d7-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8701/c/1"><num value="1">(1)</num><content> the annual rate of basic pay payable to the employee, rounded to the next higher multiple of $1,000, plus $2,000, or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5102e5d8-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8701/c/2"><num value="2">(2)</num><content> $10,000.</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">In the case of any former employee entitled to coverage under this chapter, the term means the basic insurance amount applicable for the employee at the time the insurance to which the employee is entitled as an employee under this chapter stops pursuant to <ref href="/us/usc/t5/s8706/a">section 8706(a) of this title</ref>.</continuation>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id5102e5d9-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8701/d"><num value="d">(d)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id5102e5da-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8701/d/1"><num value="1">(1)</num><chapeau> For the purpose of this chapter, “family member”, when used with respect to any individual, means—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id5102e5db-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8701/d/1/A"><num value="A">(A)</num><content> the spouse of the individual; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id5102e5dc-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8701/d/1/B"><num value="B">(B)</num><chapeau> an unmarried dependent child of the individual (other than a stillborn child), including an adopted child, stepchild or foster child (but only if the stepchild or foster child lived with the individual in a regular parent-child relationship), or recognized natural child—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id5102e5dd-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8701/d/1/B/i"><num value="i">(i)</num><content> who is less than 22 years of age, or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id5102e5de-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8701/d/1/B/ii"><num value="ii">(ii)</num><content> who is 22 years of age or older and is incapable of self-support because of a mental or physical disability which existed before the child became 22 years of age.</content>

</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id5102e5df-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8701/d/2"><num value="2">(2)</num><content> For the purpose of this subsection, “dependent”, in the case of any child, means that the individual involved was, at the time of the child’s death, either living with or contributing to the support of the child, as determined in accordance with the regulations the Office shall prescribe.</content>

<p style="-uslm-lc:I21" class="indent0">The definition of “Congressional employee” in <ref href="/us/usc/t5/s2107">section 2107 of this title</ref> includes an Official Reporter of Debates of the Senate and an individual employed by an Official Reporter of Debates of the Senate so that the inclusion of “a Congressional employee” in subsection (a)(3) provides the coverage for those individuals which was given by former <ref href="/us/usc/t2/s126">section 126 of title 2</ref>.</p>
<p style="-uslm-lc:I21" class="indent0">The definition of “employee” in <ref href="/us/usc/t5/s2105">section 2105 of this title</ref> is broad enough to cover the officers and employees set out in former section 2091(a) with the exception of Members of Congress, the President, individuals employed either by the government of the District of Columbia or by Gallaudet College, and United States commissioners. Accordingly, these have been added specifically in paragraphs (2), (4), (5), (6), and (7).</p>

<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Direct Payment of Insurance Contributions</inline>.—</heading><content>Section 6 [amending sections 8707 and 8714a to 8714c of this title] shall take effect on the first day of the first applicable pay period beginning on or after the date of enactment of this Act.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> Additional Optional Life Insurance.—</heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Section 7 [amending <ref href="/us/usc/t5/s8714b">section 8714b of this title</ref> and enacting provisions set out as a note under <ref href="/us/usc/t5/s8714b">section 8714b of this title</ref>] shall take effect on the first day of the first pay period that begins on or after the 180th day following the date of enactment of this Act, or on any earlier date that the Office of Personnel Management may prescribe that is at least 60 days after the date of enactment of this Act.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Regulations</inline>.—</heading><chapeau>The Office shall prescribe regulations under which an employee may elect to continue additional optional insurance that remains in force on such effective date without subsequent reduction and with the full cost withheld from annuity or compensation on and after such effective date if that employee—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> separated from service before such effective date due to retirement or entitlement to compensation under subchapter I of chapter 81 of title 5, United States Code; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> continued additional optional insurance pursuant to section 8714b(c)(2) as in effect immediately before such effective date.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="f">“(f)</num><heading> <inline class="small-caps">Improved Optional Life Insurance on Family Members</inline>.—</heading><content>The amendments made by section 8 [amending <ref href="/us/usc/t5/s8714c">section 8714c of this title</ref>] shall take effect on the first day of the first pay period which begins on or after the 180th day following the date of enactment of this Act or on any earlier date that the Office of Personnel Management may prescribe.</content>
