<chapeau style="-uslm-lc:I11" class="indent0">When used in this chapter:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ide3a20941-5368-11e6-bc36-e7b7d9db9607" identifier="/us/usc/t50/s2001/1"><num value="1" class="bold">(1)</num><heading class="bold"> Agency</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Agency” means the Central Intelligence Agency.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ide3a20942-5368-11e6-bc36-e7b7d9db9607" identifier="/us/usc/t50/s2001/2"><num value="2" class="bold">(2)</num><heading class="bold"> Director</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Director” means the Director of the Central Intelligence Agency.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ide3a20943-5368-11e6-bc36-e7b7d9db9607" identifier="/us/usc/t50/s2001/3"><num value="3" class="bold">(3)</num><heading class="bold"> Qualifying service</heading><content><p style="-uslm-lc:I12" class="indent1">The term “qualifying service” means service determined by the Director to have been performed in carrying out duties described in <ref href="/us/usc/t50/s2013">section 2013 of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ide3a20944-5368-11e6-bc36-e7b7d9db9607" identifier="/us/usc/t50/s2001/4"><num value="4" class="bold">(4)</num><heading class="bold"> Fund balance</heading><chapeau>The term “fund balance” means the sum of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ide3a20945-5368-11e6-bc36-e7b7d9db9607" identifier="/us/usc/t50/s2001/4/A"><num value="A">(A)</num><content> the investments of the fund calculated at par value; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ide3a20946-5368-11e6-bc36-e7b7d9db9607" identifier="/us/usc/t50/s2001/4/B"><num value="B">(B)</num><content> the cash balance of the fund on the books of the Treasury.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ide3a20947-5368-11e6-bc36-e7b7d9db9607" identifier="/us/usc/t50/s2001/5"><num value="5" class="bold">(5)</num><heading class="bold"> Unfunded liability</heading><chapeau>The term “unfunded liability” means the estimated amount by which—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ide3a20948-5368-11e6-bc36-e7b7d9db9607" identifier="/us/usc/t50/s2001/5/A"><num value="A">(A)</num><content> the present value of all benefits payable from the fund exceeds</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ide3a20949-5368-11e6-bc36-e7b7d9db9607" identifier="/us/usc/t50/s2001/5/B"><num value="B">(B)</num><chapeau> the sum of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ide3a2094a-5368-11e6-bc36-e7b7d9db9607" identifier="/us/usc/t50/s2001/5/B/i"><num value="i">(i)</num><content> the present value of deductions to be withheld from the future basic pay of participants subject to subchapter II and of future Agency contributions to be made on the behalf of such participants;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ide3a2094b-5368-11e6-bc36-e7b7d9db9607" identifier="/us/usc/t50/s2001/5/B/ii"><num value="ii">(ii)</num><content> the present value of Government payments to the fund under sections 2091(c) and 2091(d) of this title; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ide3a2094c-5368-11e6-bc36-e7b7d9db9607" identifier="/us/usc/t50/s2001/5/B/iii"><num value="iii">(iii)</num><content> the fund balance as of the date on which the unfunded liability is determined.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ide3a2094d-5368-11e6-bc36-e7b7d9db9607" identifier="/us/usc/t50/s2001/6"><num value="6" class="bold">(6)</num><heading class="bold"> Normal cost</heading><content><p style="-uslm-lc:I12" class="indent1">The term “normal cost” means the level percentage of payroll required to be deposited in the fund to meet the cost of benefits payable under the system (computed in accordance with generally accepted actuarial practice on an entry-age basis) less the value of retirement benefits earned under another retirement system for government employees and less the cost of credit allowed for military service.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ide3a2094e-5368-11e6-bc36-e7b7d9db9607" identifier="/us/usc/t50/s2001/7"><num value="7" class="bold">(7)</num><heading class="bold"> Lump-sum credit</heading><content><p style="-uslm-lc:I12" class="indent1">The term “lump-sum credit” means the unrefunded amount consisting of retirement deductions made from a participant’s basic pay and amounts deposited by a participant covering earlier service, including any amounts deposited under <ref href="/us/usc/t50/s2082/h">section 2082(h) of this title</ref>.</p>

<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><content> Nothing in this section or any amendment made by this section shall be construed to require the forfeiture by any individual of benefits received before the date of the enactment of this Act [<date date="1987-12-02">Dec. 2, 1987</date>].</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><content> Nothing in this section or any amendment made by this section shall be construed to require a reduction in the level of benefits received by any individual who was receiving benefits under section 232 of the Central Intelligence Agency Retirement Act of 1964 for Certain Employees [<ref href="/us/pl/88/643">Pub. L. 88–643</ref>] before the date of enactment of this Act [<date date="1987-12-02">Dec. 2, 1987</date>]”.</content>

L. 88–643</ref>], the provisions of section 221(b) (as amended by this title) and the provisions of subsections (b) and (c) of section 222 of such Act, as added by this title, regarding the rights of former spouses to receive survivor annuities shall apply in the case of any individual who after the effective date of this title [<date date="1982-11-15">Nov. 15, 1982</date>] becomes a former spouse of a participant or former participant in the Central Intelligence Agency Retirement and Disability System.”</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><content> The amendment made by section 203 [enacting <ref href="/us/pl/88/643/s221/f/2">section 221(f)(2) of Pub. L. 88–643</ref>] shall apply to a participant who married prior to enactment [<date date="1976-10-17">Oct. 17, 1976</date>] but only if the election is made within one year after enactment [<date date="1976-10-17">Oct. 17, 1976</date>].</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><content> The amendment made by section 210 [amending <ref href="/us/pl/88/643/s251">section 251 of Pub. L. 88–643</ref>] is effective only with respect to annuity accruing for full months beginning after <date date="1971-01-08">January 8, 1971</date>; but any part of a period of separation referred to in such amendment in which the participant or former participant was receiving benefits under chapter 81 of title 5, United States Code or any earlier statute on which such chapter is based shall be counted whether the person returns to duty before, on, or after <date date="1971-01-08">January 8, 1971</date>. With respect to any person retired before such date of enactment, any such part of a period of separation shall be counted only upon application of the retired person.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><content> The amendment in section 211 [amending <ref href="/us/pl/88/643/s252/a/2">section 252(a)(2) of Pub. L. 88–643</ref>] to credit certain service in the Public Health Service is effective as of <date date="1960-04-08">April 8, 1960</date>, and the amendment to credit certain service in the National Oceanic and Atmospheric Administration is effective as of <date date="1961-09-14">September 14, 1961</date>.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="f">“(f)</num><content> The amendment in section 212 [enacting <ref href="/us/pl/88/643/s264">section 264 of Pub. L. 88–643</ref>] is effective as of <date date="1974-06-30">June 30, 1974</date>.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="g">“(g)</num><content> The amendment to recompute a reduced annuity during periods when not married in section 202 [amending <ref href="/us/pl/88/643/s221/b">section 221(b) of Pub. L. 88–643</ref>] shall apply to annuities which commence before, on, or after the date of enactment of this Act [<date date="1976-10-17">Oct. 17, 1976</date>], but no increase in annuity shall be paid for any period prior to <date date="1974-11-01">November 1, 1974</date>.</content>
