<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id59add45f-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s124"><num value="124">§ 124.</num><heading> Homeland Security Advisory System</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id59add460-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s124/a"><num value="a" class="bold">(a)</num><heading class="bold"> Requirement</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall administer the Homeland Security Advisory System in accordance with this section to provide advisories or warnings regarding the threat or risk that acts of terrorism will be committed on the homeland to Federal, State, local, and tribal government authorities and to the people of the United States, as appropriate. The Secretary shall exercise primary responsibility for providing such advisories or warnings.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id59add461-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s124/b"><num value="b" class="bold">(b)</num><heading class="bold"> Required elements</heading><chapeau>In administering the Homeland Security Advisory System, the Secretary shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id59add462-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s124/b/1"><num value="1">(1)</num><content> establish criteria for the issuance and revocation of such advisories or warnings;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id59add463-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s124/b/2"><num value="2">(2)</num><content> develop a methodology, relying on the criteria established under paragraph (1), for the issuance and revocation of such advisories or warnings;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id59add464-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s124/b/3"><num value="3">(3)</num><content> provide, in each such advisory or warning, specific information and advice regarding appropriate protective measures and countermeasures that may be taken in response to the threat or risk, at the maximum level of detail practicable to enable individuals, government entities, emergency response providers, and the private sector to act appropriately;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id59add465-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s124/b/4"><num value="4">(4)</num><content> whenever possible, limit the scope of each such advisory or warning to a specific region, locality, or economic sector believed to be under threat or at risk; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id59add466-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s124/b/5"><num value="5">(5)</num><content> not, in issuing any advisory or warning, use color designations as the exclusive means of specifying homeland security threat conditions that are the subject of the advisory or warning.</content>
