<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id1a9a7e49-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s124m"><num value="124m">§ 124m.</num><heading> Classified Information Advisory Officer</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id1a9a7e4a-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s124m/a"><num value="a" class="bold">(a)</num><heading class="bold"> Requirement to establish</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall identify and designate within the Department a Classified Information Advisory Officer, as described in this section.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id1a9a7e4b-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s124m/b"><num value="b" class="bold">(b)</num><heading class="bold"> Responsibilities</heading><chapeau>The responsibilities of the Classified Information Advisory Officer shall be as follows:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id1a9a7e4c-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s124m/b/1"><num value="1">(1)</num><chapeau> To develop and disseminate educational materials and to develop and administer training programs to assist State, local, and tribal governments (including State, local, and tribal law enforcement agencies) and private sector entities—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id1a9a7e4d-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s124m/b/1/A"><num value="A">(A)</num><content> in developing plans and policies to respond to requests related to classified information without communicating such information to individuals who lack appropriate security clearances;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1a9a7e4e-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s124m/b/1/B"><num value="B">(B)</num><content> regarding the appropriate procedures for challenging classification designations of information received by personnel of such entities; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1a9a7e4f-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s124m/b/1/C"><num value="C">(C)</num><content> on the means by which such personnel may apply for security clearances.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1a9a7e50-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s124m/b/2"><num value="2">(2)</num><content> To inform the Under Secretary for Intelligence and Analysis on policies and procedures that could facilitate the sharing of classified information with such personnel, as appropriate.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id1a9cef51-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s124m/c"><num value="c" class="bold">(c)</num><heading class="bold"> Initial designation</heading><chapeau>Not later than 90 days after <date date="2010-10-07">October 7, 2010</date>, the Secretary shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id1a9cef52-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s124m/c/1"><num value="1">(1)</num><content> designate the initial Classified Information Advisory Officer; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1a9cef53-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s124m/c/2"><num value="2">(2)</num><content> submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security of the House of Representatives a written notification of the designation.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> Over-classification of information causes considerable confusion regarding what information may be shared with whom, and negatively affects the dissemination of information within the Federal Government and with State, local, and tribal entities, and with the private sector.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> Over-classification of information is antithetical to the creation and operation of the information sharing environment established under section 1016 of the Intelligence Reform and Terrorism Prevention Act of 2004 (<ref href="/us/usc/t6/s485">6 U.S.C. 485</ref>).</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> Federal departments or agencies authorized to make original classification decisions or that perform derivative classification of information are responsible for developing, implementing, and administering policies, procedures, and programs that promote compliance with applicable laws, executive orders, and other authorities pertaining to the proper use of classification markings and the policies of the National Archives and Records Administration.”</content>
