<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id59b50166-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Collective bargaining agreement</heading><content><p style="-uslm-lc:I12" class="indent1">The term “collective bargaining agreement” has the meaning given that term in <ref href="/us/usc/t5/s7103/a/8">section 7103(a)(8) of title 5</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id59b50169-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/a/5"><num value="5" class="bold">(5)</num><heading class="bold"> Qualified position</heading><content><p style="-uslm-lc:I12" class="indent1">The term “qualified position” means a position, designated by the Secretary for the purpose of this section, in which the incumbent performs, manages, or supervises functions that execute the responsibilities of the Department relating to cybersecurity.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id59b5016a-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/a/6"><num value="6" class="bold">(6)</num><heading class="bold"> Senior Executive Service</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Senior Executive Service” has the meaning given that term in <ref href="/us/usc/t5/s2101a">section 2101a of title 5</ref>.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id59b5016b-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/b"><num value="b" class="bold">(b)</num><heading class="bold"> General authority</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id59b5016c-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Establish positions, appoint personnel, and fix rates of pay</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id59b5016d-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/b/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> General authority</heading><chapeau>The Secretary may—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id59b5016e-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/b/1/A/i"><num value="i">(i)</num><chapeau> establish, as positions in the excepted service, such qualified positions in the Department as the Secretary determines necessary to carry out the responsibilities of the Department relating to cybersecurity, including positions formerly identified as—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id59b5016f-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/b/1/A/i/I"><num value="I">(I)</num><content> senior level positions designated under <ref href="/us/usc/t5/s5376">section 5376 of title 5</ref>; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id59b50170-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/b/1/A/i/II"><num value="II">(II)</num><content> positions in the Senior Executive Service;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id59b50171-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/b/1/A/ii"><num value="ii">(ii)</num><content> appoint an individual to a qualified position (after taking into consideration the availability of preference eligibles for appointment to the position); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id59b50172-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/b/1/A/iii"><num value="iii">(iii)</num><content> subject to the requirements of paragraphs (2) and (3), fix the compensation of an individual for service in a qualified position.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id59b50173-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/b/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Construction with other laws</heading><content><p style="-uslm-lc:I13" class="indent2">The authority of the Secretary under this subsection applies without regard to the provisions of any other law relating to the appointment, number, classification, or compensation of employees.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id59b50174-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Basic pay</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id59b50175-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/b/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Authority to fix rates of basic pay</heading><content><p style="-uslm-lc:I13" class="indent2">In accordance with this section, the Secretary shall fix the rates of basic pay for any qualified position established under paragraph (1) in relation to the rates of pay provided for employees in comparable positions in the Department of Defense and subject to the same limitations on maximum rates of pay established for such employees by law or regulation.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id59b50176-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/b/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Prevailing rate systems</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary may, consistent with <ref href="/us/usc/t5/s5341">section 5341 of title 5</ref>, adopt such provisions of that title as provide for prevailing rate systems of basic pay and may apply those provisions to qualified positions for employees in or under which the Department may employ individuals described by section 5342(a)(2)(A) of that title.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id59b50177-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Additional compensation, incentives, and allowances</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id59b50178-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/b/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Additional compensation based on title 5 authorities</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary may provide employees in qualified positions compensation (in addition to basic pay), including benefits, incentives, and allowances, consistent with, and not in excess of the level authorized for, comparable positions authorized by title 5.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id59b50179-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/b/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Allowances in nonforeign areas</heading><content><p style="-uslm-lc:I13" class="indent2">An employee in a qualified position whose rate of basic pay is fixed under paragraph (2)(A) shall be eligible for an allowance under <ref href="/us/usc/t5/s5941">section 5941 of title 5</ref>, on the same basis and to the same extent as if the employee was an employee covered by such section 5941, including eligibility conditions, allowance rates, and all other terms and conditions in law or regulation.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id59b5017a-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Plan for execution of authorities</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 120 days after <date date="2014-12-18">December 18, 2014</date>, the Secretary shall submit a report to the appropriate committees of Congress with a plan for the use of the authorities provided under this subsection.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id59b5017b-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/b/5"><num value="5" class="bold">(5)</num><heading class="bold"> Collective bargaining agreements</heading><content><p style="-uslm-lc:I12" class="indent1">Nothing in paragraph (1) may be construed to impair the continued effectiveness of a collective bargaining agreement with respect to an office, component, subcomponent, or equivalent of the Department that is a successor to an office, component, subcomponent, or equivalent of the Department covered by the agreement before the succession.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id59b5017c-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/b/6"><num value="6" class="bold">(6)</num><heading class="bold"> Required regulations</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary, in coordination with the Director of the Office of Personnel Management, shall prescribe regulations for the administration of this section.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id59b5017d-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/c"><num value="c" class="bold">(c)</num><heading class="bold"> Annual report</heading><chapeau>Not later than 1 year after <date date="2014-12-18">December 18, 2014</date>, and every year thereafter for 4 years, the Secretary shall submit to the appropriate committees of Congress a detailed report that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id59b5017e-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/c/1"><num value="1">(1)</num><content> discusses the process used by the Secretary in accepting applications, assessing candidates, ensuring adherence to veterans’ preference, and selecting applicants for vacancies to be filled by an individual for a qualified position;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id59b5017f-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/c/2"><num value="2">(2)</num><chapeau> describes—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id59b50180-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/c/2/A"><num value="A">(A)</num><content> how the Secretary plans to fulfill the critical need of the Department to recruit and retain employees in qualified positions;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id59b50181-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/c/2/B"><num value="B">(B)</num><content> the measures that will be used to measure progress; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id59b50182-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/c/2/C"><num value="C">(C)</num><content> any actions taken during the reporting period to fulfill such critical need;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id59b50183-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/c/3"><num value="3">(3)</num><content> discusses how the planning and actions taken under paragraph (2) are integrated into the strategic workforce planning of the Department;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id59b50184-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/c/4"><num value="4">(4)</num><chapeau> provides metrics on actions occurring during the reporting period, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id59b50185-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/c/4/A"><num value="A">(A)</num><content> the number of employees in qualified positions hired by occupation and grade and level or pay band;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id59b50186-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/c/4/B"><num value="B">(B)</num><content> the placement of employees in qualified positions by directorate and office within the Department;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id59b50187-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/c/4/C"><num value="C">(C)</num><content> the total number of veterans hired;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id59b50188-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/c/4/D"><num value="D">(D)</num><content> the number of separations of employees in qualified positions by occupation and grade and level or pay band;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id59b50189-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/c/4/E"><num value="E">(E)</num><content> the number of retirements of employees in qualified positions by occupation and grade and level or pay band; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id59b5018a-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/c/4/F"><num value="F">(F)</num><content> the number and amounts of recruitment, relocation, and retention incentives paid to employees in qualified positions by occupation and grade and level or pay band; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id59b5018b-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/c/5"><num value="5">(5)</num><content> describes the training provided to supervisors of employees in qualified positions at the Department on the use of the new authorities.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id59b5018c-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/d"><num value="d" class="bold">(d)</num><heading class="bold"> Three-year probationary period</heading><content><p style="-uslm-lc:I11" class="indent0">The probationary period for all employees hired under the authority established in this section shall be 3 years.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id59b5018d-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/e"><num value="e" class="bold">(e)</num><heading class="bold"> Incumbents of existing competitive service positions</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id59b5018e-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">An individual serving in a position on <date date="2014-12-18">December 18, 2014</date>, that is selected to be converted to a position in the excepted service under this section shall have the right to refuse such conversion.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id59b5018f-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Subsequent conversion</heading><content><p style="-uslm-lc:I12" class="indent1">After the date on which an individual who refuses a conversion under paragraph (1) stops serving in the position selected to be converted, the position may be converted to a position in the excepted service.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id59b50190-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/f"><num value="f" class="bold">(f)</num><heading class="bold"> Study and report</heading><chapeau>Not later than 120 days after <date date="2014-12-18">December 18, 2014</date>, the National Protection and Programs Directorate shall submit a report regarding the availability of, and benefits (including cost savings and security) of using, cybersecurity personnel and facilities outside of the National Capital Region (as defined in <ref href="/us/usc/t10/s2674">section 2674 of title 10</ref>) to serve the Federal and national need to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id59b50191-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/f/1"><num value="1">(1)</num><content> the Subcommittee on Homeland Security of the Committee on Appropriations and the Committee on Homeland Security and Governmental Affairs of the Senate; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id59b50192-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s147/f/2"><num value="2">(2)</num><content> the Subcommittee on Homeland Security of the Committee on Appropriations and the Committee on Homeland Security of the House of Representatives.</content>
