<chapeau style="-uslm-lc:I11" class="indent0">In this subchapter:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1b00e15b-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/1"><num value="1" class="bold">(1)</num><heading class="bold"> Agency</heading><content><p style="-uslm-lc:I12" class="indent1">The term “agency” has the meaning given the term in <ref href="/us/usc/t44/s3502">section 3502 of title 44</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1b00e15c-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/2"><num value="2" class="bold">(2)</num><heading class="bold"> Antitrust laws</heading><chapeau>The term “antitrust laws”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id1b00e15d-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/2/A"><num value="A">(A)</num><content> has the meaning given the term in <ref href="/us/usc/t15/s12">section 12 of title 15</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1b00e15e-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/2/B"><num value="B">(B)</num><content> includes <ref href="/us/usc/t15/s45">section 45 of title 15</ref> to the extent that <ref href="/us/usc/t15/s45">section 45 of title 15</ref> applies to unfair methods of competition; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1b00e15f-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/2/C"><num value="C">(C)</num><content> includes any State antitrust law, but only to the extent that such law is consistent with the law referred to in subparagraph (A) or the law referred to in subparagraph (B).</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1b00e160-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/3"><num value="3" class="bold">(3)</num><heading class="bold"> Appropriate Federal entities</heading><chapeau>The term “appropriate Federal entities” means the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id1b00e161-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/3/A"><num value="A">(A)</num><content> The Department of Commerce.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1b00e162-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/3/B"><num value="B">(B)</num><content> The Department of Defense.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1b00e163-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/3/C"><num value="C">(C)</num><content> The Department of Energy.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1b00e164-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/3/D"><num value="D">(D)</num><content> The Department of Homeland Security.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1b00e165-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/3/E"><num value="E">(E)</num><content> The Department of Justice.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1b00e168-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/4"><num value="4" class="bold">(4)</num><heading class="bold"> Cybersecurity purpose</heading><content><p style="-uslm-lc:I12" class="indent1">The term “cybersecurity purpose” means the purpose of protecting an information system or information that is stored on, processed by, or transiting an information system from a cybersecurity threat or security vulnerability.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1b00e169-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/5"><num value="5" class="bold">(5)</num><heading class="bold"> Cybersecurity threat</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id1b00e16a-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/5/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Except as provided in subparagraph (B), the term “cybersecurity threat” means an action, not protected by the First Amendment to the Constitution of the United States, on or through an information system that may result in an unauthorized effort to adversely impact the security, availability, confidentiality, or integrity of an information system or information that is stored on, processed by, or transiting an information system.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id1b00e16b-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/5/B"><num value="B" class="bold">(B)</num><heading class="bold"> Exclusion</heading><content><p style="-uslm-lc:I13" class="indent2">The term “cybersecurity threat” does not include any action that solely involves a violation of a consumer term of service or a consumer licensing agreement.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1b00e16c-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/6"><num value="6" class="bold">(6)</num><heading class="bold"> Cyber threat indicator</heading><chapeau>The term “cyber threat indicator” means information that is necessary to describe or identify—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id1b00e16d-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/6/A"><num value="A">(A)</num><content> malicious reconnaissance, including anomalous patterns of communications that appear to be transmitted for the purpose of gathering technical information related to a cybersecurity threat or security vulnerability;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1b00e16e-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/6/B"><num value="B">(B)</num><content> a method of defeating a security control or exploitation of a security vulnerability;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1b00e16f-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/6/C"><num value="C">(C)</num><content> a security vulnerability, including anomalous activity that appears to indicate the existence of a security vulnerability;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1b00e170-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/6/D"><num value="D">(D)</num><content> a method of causing a user with legitimate access to an information system or information that is stored on, processed by, or transiting an information system to unwittingly enable the defeat of a security control or exploitation of a security vulnerability;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1b00e171-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/6/E"><num value="E">(E)</num><content> malicious cyber command and control;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1b00e172-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/6/F"><num value="F">(F)</num><content> the actual or potential harm caused by an incident, including a description of the information exfiltrated as a result of a particular cybersecurity threat;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1b00e173-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/6/G"><num value="G">(G)</num><content> any other attribute of a cybersecurity threat, if disclosure of such attribute is not otherwise prohibited by law; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1b00e174-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/6/H"><num value="H">(H)</num><content> any combination thereof.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1b00e175-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/7"><num value="7" class="bold">(7)</num><heading class="bold"> Defensive measure</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id1b00e176-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/7/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Except as provided in subparagraph (B), the term “defensive measure” means an action, device, procedure, signature, technique, or other measure applied to an information system or information that is stored on, processed by, or transiting an information system that detects, prevents, or mitigates a known or suspected cybersecurity threat or security vulnerability.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id1b00e177-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/7/B"><num value="B" class="bold">(B)</num><heading class="bold"> Exclusion</heading><chapeau>The term “defensive measure” does not include a measure that destroys, renders unusable, provides unauthorized access to, or substantially harms an information system or information stored on, processed by, or transiting such information system not owned by—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id1b00e178-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/7/B/i"><num value="i">(i)</num><content> the private entity operating the measure; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id1b00e179-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/7/B/ii"><num value="ii">(ii)</num><content> another entity or Federal entity that is authorized to provide consent and has provided consent to that private entity for operation of such measure.</content>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1b00e17a-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/8"><num value="8" class="bold">(8)</num><heading class="bold"> Federal entity</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Federal entity” means a department or agency of the United States or any component of such department or agency.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1b00e17b-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/9"><num value="9" class="bold">(9)</num><heading class="bold"> Information system</heading><chapeau>The term “information system”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id1b00e17c-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/9/A"><num value="A">(A)</num><content> has the meaning given the term in <ref href="/us/usc/t44/s3502">section 3502 of title 44</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1b00e17d-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/9/B"><num value="B">(B)</num><content> includes industrial control systems, such as supervisory control and data acquisition systems, distributed control systems, and programmable logic controllers.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1b00e17e-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/10"><num value="10" class="bold">(10)</num><heading class="bold"> Local government</heading><content><p style="-uslm-lc:I12" class="indent1">The term “local government” means any borough, city, county, parish, town, township, village, or other political subdivision of a State.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1b00e17f-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/11"><num value="11" class="bold">(11)</num><heading class="bold"> Malicious cyber command and control</heading><content><p style="-uslm-lc:I12" class="indent1">The term “malicious cyber command and control” means a method for unauthorized remote identification of, access to, or use of, an information system or information that is stored on, processed by, or transiting an information system.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1b00e180-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/12"><num value="12" class="bold">(12)</num><heading class="bold"> Malicious reconnaissance</heading><content><p style="-uslm-lc:I12" class="indent1">The term “malicious reconnaissance” means a method for actively probing or passively monitoring an information system for the purpose of discerning security vulnerabilities of the information system, if such method is associated with a known or suspected cybersecurity threat.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1b00e181-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/13"><num value="13" class="bold">(13)</num><heading class="bold"> Monitor</heading><content><p style="-uslm-lc:I12" class="indent1">The term “monitor” means to acquire, identify, or scan, or to possess, information that is stored on, processed by, or transiting an information system.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1b00e182-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/14"><num value="14" class="bold">(14)</num><heading class="bold"> Non-Federal entity</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id1b00e183-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s1501/14/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Except as otherwise provided in this paragraph, the term “non-Federal entity” means any private entity, non-Federal government agency or department, or State, tribal, or local government (including a political subdivision, department, or component thereof).</p>
