and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id986a5c4f-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/a/4\"><num value=\"4\">(4)</num><content> the terms “cybersecurity risk” and “information system” have the meanings given those terms in <ref href=\"/us/usc/t6/s148\">section 148 of this title</ref>.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id986a5c50-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Requirement</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id986a5c51-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau>Not later than 1 year after <date date=\"2015-12-18\">December 18, 2015</date>, the Secretary shall deploy, operate, and maintain, to make available for use by any agency, with or without reimbursement—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id986a5c52-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/b/1/A\"><num value=\"A\">(A)</num><content> a capability to detect cybersecurity risks in network traffic transiting or traveling to or from an agency information system; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id986a5c53-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/b/1/B\"><num value=\"B\">(B)</num><content> a capability to prevent network traffic associated with such cybersecurity risks from transiting or traveling to or from an agency information system or modify such network traffic to remove the cybersecurity risk.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id986a5c54-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Regular improvement</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall regularly deploy new technologies and modify existing technologies to the intrusion detection and prevention capabilities described in paragraph (1) as appropriate to improve the intrusion detection and prevention capabilities.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id986a5c55-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Activities</heading><chapeau>In carrying out subsection (b), the Secretary—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id986a5c56-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/c/1\"><num value=\"1\">(1)</num><content> may access, and the head of an agency may disclose to the Secretary or a private entity providing assistance to the Secretary under paragraph (2), information transiting or traveling to or from an agency information system, regardless of the location from which the Secretary or a private entity providing assistance to the Secretary under paragraph (2) accesses such information, notwithstanding any other provision of law that would otherwise restrict or prevent the head of an agency from disclosing such information to the Secretary or a private entity providing assistance to the Secretary under paragraph (2);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id986a5c57-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/c/2\"><num value=\"2\">(2)</num><content> may enter into contracts or other agreements with, or otherwise request and obtain the assistance of, private entities to deploy, operate, and maintain technologies in accordance with subsection (b);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id986a5c58-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/c/3\"><num value=\"3\">(3)</num><content> may retain, use, and disclose information obtained through the conduct of activities authorized under this section only to protect information and information systems from cybersecurity risks;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id986a5c59-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/c/4\"><num value=\"4\">(4)</num><content> shall regularly assess through operational test and evaluation in real world or simulated environments available advanced protective technologies to improve detection and prevention capabilities, including commercial and noncommercial technologies and detection technologies beyond signature-based detection, and acquire, test, and deploy such technologies when appropriate;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id986a5c5a-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/c/5\"><num value=\"5\">(5)</num><content> shall establish a pilot through which the Secretary may acquire, test, and deploy, as rapidly as possible, technologies described in paragraph (4); and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id986a5c5b-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/c/6\"><num value=\"6\">(6)</num><content> shall periodically update the privacy impact assessment required under section 208(b) of the E-Government Act of 2002 (<ref href=\"/us/usc/t44/s3501\">44 U.S.C. 3501</ref> note).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id986a5c5c-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Principles</heading><chapeau>In carrying out subsection (b), the Secretary shall ensure that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id986a5c5d-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/d/1\"><num value=\"1\">(1)</num><content> activities carried out under this section are reasonably necessary for the purpose of protecting agency information and agency information systems from a cybersecurity risk;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id986a5c5e-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/d/2\"><num value=\"2\">(2)</num><content> information accessed by the Secretary will be retained no longer than reasonably necessary for the purpose of protecting agency information and agency information systems from a cybersecurity risk;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id986a5c5f-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/d/3\"><num value=\"3\">(3)</num><content> notice has been provided to users of an agency information system concerning access to communications of users of the agency information system for the purpose of protecting agency information and the agency information system; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id986a5c60-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/d/4\"><num value=\"4\">(4)</num><content> the activities are implemented pursuant to policies and procedures governing the operation of the intrusion detection and prevention capabilities.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id986a5c61-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Private entities</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id986a5c62-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/e/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Conditions</heading><chapeau>A private entity described in subsection (c)(2) may not—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id986a5c63-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/e/1/A\"><num value=\"A\">(A)</num><content> disclose any network traffic transiting or traveling to or from an agency information system to any entity other than the Department or the agency that disclosed the information under subsection (c)(1), including personal information of a specific individual or information that identifies a specific individual not directly related to a cybersecurity risk; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id986a5c64-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/e/1/B\"><num value=\"B\">(B)</num><content> use any network traffic transiting or traveling to or from an agency information system to which the private entity gains access in accordance with this section for any purpose other than to protect agency information and agency information systems against cybersecurity risks or to administer a contract or other agreement entered into pursuant to subsection (c)(2) or as part of another contract with the Secretary.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id986a5c65-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/e/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Limitation on liability</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">No cause of action shall lie in any court against a private entity for assistance provided to the Secretary in accordance with this section and any contract or agreement entered into pursuant to subsection (c)(2).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id986a5c66-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/e/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Rule of construction</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Nothing in paragraph (2) shall be construed to authorize an Internet service provider to break a user agreement with a customer without the consent of the customer.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id986a5c67-5368-11e6-9a99-e51e9799391e\" identifier=\"/us/usc/t6/s151/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Privacy Officer review</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Not later than 1 year after <date date=\"2015-12-18\">December 18, 2015</date>, the Privacy Officer appointed under <ref href=\"/us/usc/t6/s142\">section 142 of this title</ref>, in consultation with the Attorney General, shall review the policies and guidelines for the program carried out under this section to ensure that the policies and guidelines are consistent with applicable privacy laws, including those governing the acquisition, interception, retention, use, and disclosure of communications.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id986ccc68-5368-11e6-9a99-e51e9799391e\">(<ref href=\"/us/pl/107/296/tII\">Pub.
