<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id59c5a32e-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252"><num value="252">§ 252.</num><heading> Establishment of Bureau of Border Security</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id59c5a32f-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/a"><num value="a" class="bold">(a)</num><heading class="bold"> Establishment of Bureau</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id59c5a330-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">There shall be in the Department of Homeland Security a bureau to be known as the “Bureau of Border Security”.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id59c5a331-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Assistant Secretary</heading><chapeau>The head of the Bureau of Border Security shall be the Assistant Secretary of the Bureau of Border Security, who—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id59c5a332-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/a/2/A"><num value="A">(A)</num><content> shall report directly to the Under Secretary for Border and Transportation Security; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id59c5a333-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/a/2/B"><num value="B">(B)</num><content> shall have a minimum of 5 years professional experience in law enforcement, and a minimum of 5 years of management experience.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id59c5a334-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Functions</heading><chapeau>The Assistant Secretary of the Bureau of Border Security—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id59c5a335-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/a/3/A"><num value="A">(A)</num><chapeau> shall establish the policies for performing such functions as are—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id59c5a336-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/a/3/A/i"><num value="i">(i)</num><content> transferred to the Under Secretary for Border and Transportation Security by <ref href="/us/usc/t6/s251">section 251 of this title</ref> and delegated to the Assistant Secretary by the Under Secretary for Border and Transportation Security; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id59c5a337-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/a/3/A/ii"><num value="ii">(ii)</num><content> otherwise vested in the Assistant Secretary by law;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id59c5a338-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/a/3/B"><num value="B">(B)</num><content> shall oversee the administration of such policies; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id59c5a339-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/a/3/C"><num value="C">(C)</num><content> shall advise the Under Secretary for Border and Transportation Security with respect to any policy or operation of the Bureau of Border Security that may affect the Bureau of Citizenship and Immigration Services established under part E of this subchapter, including potentially conflicting policies or operations.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id59c5a33a-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> Program to collect information relating to foreign students</heading><content><p style="-uslm-lc:I12" class="indent1">The Assistant Secretary of the Bureau of Border Security shall be responsible for administering the program to collect information relating to nonimmigrant foreign students and other exchange program participants described in <ref href="/us/usc/t8/s1372">section 1372 of title 8</ref>, including the Student and Exchange Visitor Information System established under that section, and shall use such information to carry out the enforcement functions of the Bureau.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id59c5a33b-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/a/5"><num value="5" class="bold">(5)</num><heading class="bold"> Managerial rotation program</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id59c5a33c-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/a/5/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau>Not later than 1 year after the date on which the transfer of functions specified under <ref href="/us/usc/t6/s251">section 251 of this title</ref> takes effect, the Assistant Secretary of the Bureau of Border Security shall design and implement a managerial rotation program under which employees of such bureau holding positions involving supervisory or managerial responsibility and classified, in accordance with chapter 51 of title 5, as a GS–14 or above, shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id59c5a33d-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/a/5/A/i"><num value="i">(i)</num><content> gain some experience in all the major functions performed by such bureau; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id59c5a33e-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/a/5/A/ii"><num value="ii">(ii)</num><content> work in at least one local office of such bureau.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id59c5a33f-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/a/5/B"><num value="B" class="bold">(B)</num><heading class="bold"> Report</heading><content><p style="-uslm-lc:I13" class="indent2">Not later than 2 years after the date on which the transfer of functions specified under <ref href="/us/usc/t6/s251">section 251 of this title</ref> takes effect, the Secretary shall submit a report to the Congress on the implementation of such program.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id59c5a340-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/b"><num value="b" class="bold">(b)</num><heading class="bold"> Chief of Policy and Strategy</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id59c5a341-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">There shall be a position of Chief of Policy and Strategy for the Bureau of Border Security.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id59c5a342-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Functions</heading><chapeau>In consultation with Bureau of Border Security personnel in local offices, the Chief of Policy and Strategy shall be responsible for—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id59c5a343-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/b/2/A"><num value="A">(A)</num><content> making policy recommendations and performing policy research and analysis on immigration enforcement issues; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id59c5a344-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/b/2/B"><num value="B">(B)</num><content> coordinating immigration policy issues with the Chief of Policy and Strategy for the Bureau of Citizenship and Immigration Services (established under part E of this subchapter), as appropriate.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id59c5a345-f67c-11e5-b96b-f3e1d2b9a904" identifier="/us/usc/t6/s252/c"><num value="c" class="bold">(c)</num><heading class="bold"> Legal advisor</heading><content><p style="-uslm-lc:I11" class="indent0">There shall be a principal legal advisor to the Assistant Secretary of the Bureau of Border Security. The legal advisor shall provide specialized legal advice to the Assistant Secretary of the Bureau of Border Security and shall represent the bureau in all exclusion, deportation, and removal proceedings before the Executive Office for Immigration Review.</p>
