and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf797853f-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/a/2/C\"><num value=\"C\">(C)</num><content> shall be paid at the same level as the Assistant Secretary of the Bureau of Border Security.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idf7978540-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/a/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Functions</heading><chapeau>The Director of the Bureau of Citizenship and Immigration Services—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf7978541-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/a/3/A\"><num value=\"A\">(A)</num><content> shall establish the policies for performing such functions as are transferred to the Director by this section or this chapter or otherwise vested in the Director by law;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf7978542-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/a/3/B\"><num value=\"B\">(B)</num><content> shall oversee the administration of such policies;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf7978543-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/a/3/C\"><num value=\"C\">(C)</num><content> shall advise the Deputy Secretary with respect to any policy or operation of the Bureau of Citizenship and Immigration Services that may affect the Bureau of Border Security of the Department, including potentially conflicting policies or operations;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf7978544-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/a/3/D\"><num value=\"D\">(D)</num><content> shall establish national immigration services policies and priorities;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf7978545-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/a/3/E\"><num value=\"E\">(E)</num><content> shall meet regularly with the Ombudsman described in <ref href=\"/us/usc/t6/s272\">section 272 of this title</ref> to correct serious service problems identified by the Ombudsman; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf7978546-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/a/3/F\"><num value=\"F\">(F)</num><content> shall establish procedures requiring a formal response to any recommendations submitted in the Ombudsman’s annual report to Congress within 3 months after its submission to Congress.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idf7978547-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/a/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Managerial rotation program</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idf7978548-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/a/4/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau>Not later than 1 year after the effective date specified in section 455,<ref class=\"footnoteRef\" idref=\"fn002028\">1</ref><note type=\"footnote\" id=\"fn002028\"><num>1</num> See References in Text note below.</note> the Director of the Bureau of Citizenship and Immigration Services shall design and implement a managerial rotation program under which employees of such bureau holding positions involving supervisory or managerial responsibility and classified, in accordance with chapter 51 of title 5, as a GS–14 or above, shall—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf7978549-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/a/4/A/i\"><num value=\"i\">(i)</num><content> gain some experience in all the major functions performed by such bureau; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf797854a-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/a/4/A/ii\"><num value=\"ii\">(ii)</num><content> work in at least one field office and one service center of such bureau.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idf797854b-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/a/4/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Report</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Not later than 2 years after the effective date specified in section 455,<sup>1</sup> the Secretary shall submit a report to Congress on the implementation of such program.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idf797854c-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/a/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Pilot initiatives for backlog elimination</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Director of the Bureau of Citizenship and Immigration Services is authorized to implement innovative pilot initiatives to eliminate any remaining backlog in the processing of immigration benefit applications, and to prevent any backlog in the processing of such applications from recurring, in accordance with <ref href=\"/us/usc/t8/s1573/a\">section 1573(a) of title 8</ref>. Such initiatives may include measures such as increasing personnel, transferring personnel to focus on areas with the largest potential for backlog, and streamlining paperwork.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idf797ac5d-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Transfer of functions from Commissioner</heading><chapeau>In accordance with subchapter XII (relating to transition provisions), there are transferred from the Commissioner of Immigration and Naturalization to the Director of the Bureau of Citizenship and Immigration Services the following functions, and all personnel, infrastructure, and funding provided to the Commissioner in support of such functions immediately before the effective date specified in section 455: <sup>1</sup></chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf797ac5e-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/b/1\"><num value=\"1\">(1)</num><content> Adjudications of immigrant visa petitions.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf797ac5f-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/b/2\"><num value=\"2\">(2)</num><content> Adjudications of naturalization petitions.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf797ac60-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/b/3\"><num value=\"3\">(3)</num><content> Adjudications of asylum and refugee applications.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf797ac61-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/b/4\"><num value=\"4\">(4)</num><content> Adjudications performed at service centers.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf797ac62-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/b/5\"><num value=\"5\">(5)</num><content> All other adjudications performed by the Immigration and Naturalization Service immediately before the effective date specified in section 455.<sup>1</sup></content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idf797ac63-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Chief of Policy and Strategy</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idf797ac64-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">There shall be a position of Chief of Policy and Strategy for the Bureau of Citizenship and Immigration Services.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idf797ac65-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Functions</heading><chapeau>In consultation with Bureau of Citizenship and Immigration Services personnel in field offices, the Chief of Policy and Strategy shall be responsible for—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf797ac66-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/c/2/A\"><num value=\"A\">(A)</num><content> making policy recommendations and performing policy research and analysis on immigration services issues; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf797ac67-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/c/2/B\"><num value=\"B\">(B)</num><content> coordinating immigration policy issues with the Chief of Policy and Strategy for the Bureau of Border Security of the Department.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idf797ac68-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Legal advisor</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idf797ac69-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">There shall be a principal legal advisor to the Director of the Bureau of Citizenship and Immigration Services.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idf797ac6a-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Functions</heading><chapeau>The legal advisor shall be responsible for—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf797ac6b-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/d/2/A\"><num value=\"A\">(A)</num><content> providing specialized legal advice, opinions, determinations, regulations, and any other assistance to the Director of the Bureau of Citizenship and Immigration Services with respect to legal matters affecting the Bureau of Citizenship and Immigration Services; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf797ac6c-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/d/2/B\"><num value=\"B\">(B)</num><content> representing the Bureau of Citizenship and Immigration Services in visa petition appeal proceedings before the Executive Office for Immigration Review.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idf797ac6d-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Budget Officer</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idf797ac6e-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/e/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">There shall be a Budget Officer for the Bureau of Citizenship and Immigration Services.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idf797ac6f-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/e/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Functions</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idf797ac70-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/e/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau>The Budget Officer shall be responsible for—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf797ac71-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/e/2/A/i\"><num value=\"i\">(i)</num><content> formulating and executing the budget of the Bureau of Citizenship and Immigration Services;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf797ac72-4154-11e7-bab8-e125cf475dd2\" identifier=\"/us/usc/t6/s271/e/2/A/ii\"><num value=\"ii\">(ii)</num><content> financial management of the Bureau of Citizenship and Immigration Services;
