<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id1ab70714-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s321a"><num value="321a">§ 321a.</num><heading> Evacuation plans and exercises</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id1ab70715-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s321a/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau>Notwithstanding any other provision of law, and subject to subsection (d), grants made to States or local or tribal governments by the Department through the State Homeland Security Grant Program or the Urban Area Security Initiative may be used to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id1ab70716-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s321a/a/1"><num value="1">(1)</num><content> establish programs for the development and maintenance of mass evacuation plans under subsection (b) in the event of a natural disaster, act of terrorism, or other man-made disaster;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1ab70717-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s321a/a/2"><num value="2">(2)</num><content> prepare for the execution of such plans, including the development of evacuation routes and the purchase and stockpiling of necessary supplies and shelters; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1ab70718-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s321a/a/3"><num value="3">(3)</num><content> conduct exercises of such plans.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id1ab70719-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s321a/b"><num value="b" class="bold">(b)</num><heading class="bold"> Plan development</heading><chapeau>In developing the mass evacuation plans authorized under subsection (a), each State, local, or tribal government shall, to the maximum extent practicable—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id1ab7071a-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s321a/b/1"><num value="1">(1)</num><content> establish incident command and decision making processes;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1ab7071b-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s321a/b/2"><num value="2">(2)</num><content> ensure that State, local, and tribal government plans, including evacuation routes, are coordinated and integrated;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1ab7071c-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s321a/b/3"><num value="3">(3)</num><content> identify primary and alternative evacuation routes and methods to increase evacuation capabilities along such routes such as conversion of two-way traffic to one-way evacuation routes;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1ab7071d-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s321a/b/4"><num value="4">(4)</num><content> identify evacuation transportation modes and capabilities, including the use of mass and public transit capabilities, and coordinating and integrating evacuation plans for all populations including for those individuals located in hospitals, nursing homes, and other institutional living facilities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1ab7071e-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s321a/b/5"><num value="5">(5)</num><chapeau> develop procedures for informing the public of evacuation plans before and during an evacuation, including individuals—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id1ab7071f-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s321a/b/5/A"><num value="A">(A)</num><content> with disabilities or other special needs, including the elderly;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1ab70720-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s321a/b/5/B"><num value="B">(B)</num><content> with limited English proficiency; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1ab70721-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s321a/b/5/C"><num value="C">(C)</num><content> who might otherwise have difficulty in obtaining such information; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1ab70722-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s321a/b/6"><num value="6">(6)</num><content> identify shelter locations and capabilities.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id1ab70723-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s321a/c"><num value="c" class="bold">(c)</num><heading class="bold"> Assistance</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1ab70724-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s321a/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Administrator may establish any guidelines, standards, or requirements determined appropriate to administer this section and to ensure effective mass evacuation planning for State, local, and tribal areas.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1ab70725-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s321a/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Requested assistance</heading><content><p style="-uslm-lc:I12" class="indent1">The Administrator shall make assistance available upon request of a State, local, or tribal government to assist hospitals, nursing homes, and other institutions that house individuals with special needs to establish, maintain, and exercise mass evacuation plans that are coordinated and integrated into the plans developed by that State, local, or tribal government under this section.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id1ab70726-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s321a/d"><num value="d" class="bold">(d)</num><heading class="bold"> Multipurpose funds</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this section may be construed to preclude a State, local, or tribal government from using grant funds in a manner that enhances preparedness for a natural or man-made disaster unrelated to an act of terrorism, if such use assists such government in building capabilities for terrorism preparedness.</p>
