<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id1ac0a3df-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s441"><num value="441">§ 441.</num><heading> Administration</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id1ac0a3e0-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s441/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall be responsible for the administration of this part.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id1ac0a3e1-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s441/b"><num value="b" class="bold">(b)</num><heading class="bold"> Designation of qualified anti-terrorism technologies</heading><chapeau>The Secretary may designate anti-terrorism technologies that qualify for protection under the system of risk management set forth in this part in accordance with criteria that shall include, but not be limited to, the following:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id1ac0a3e2-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s441/b/1"><num value="1">(1)</num><content> Prior United States Government use or demonstrated substantial utility and effectiveness.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1ac0a3e3-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s441/b/2"><num value="2">(2)</num><content> Availability of the technology for immediate deployment in public and private settings.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1ac0a3e4-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s441/b/3"><num value="3">(3)</num><content> Existence of extraordinarily large or extraordinarily unquantifiable potential third party liability risk exposure to the Seller or other provider of such anti-terrorism technology.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1ac0a3e5-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s441/b/4"><num value="4">(4)</num><content> Substantial likelihood that such anti-terrorism technology will not be deployed unless protections under the system of risk management provided under this part are extended.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1ac0a3e6-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s441/b/5"><num value="5">(5)</num><content> Magnitude of risk exposure to the public if such anti-terrorism technology is not deployed.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1ac0a3e7-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s441/b/6"><num value="6">(6)</num><content> Evaluation of all scientific studies that can be feasibly conducted in order to assess the capability of the technology to substantially reduce risks of harm.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1ac0a3e8-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s441/b/7"><num value="7">(7)</num><content> Anti-terrorism technology that would be effective in facilitating the defense against acts of terrorism, including technologies that prevent, defeat or respond to such acts.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id1ac2edd9-a3d3-11e9-be6e-e752deae1f00" identifier="/us/usc/t6/s441/c"><num value="c" class="bold">(c)</num><heading class="bold"> Regulations</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary may issue such regulations, after notice and comment in accordance with <ref href="/us/usc/t5/s553">section 553 of title 5</ref>, as may be necessary to carry out this part.</p>
