<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id29454115-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474"><num value="474">§ 474.</num><heading> Homeland security critical domain research and development</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id29454116-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id29454117-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Research and development</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary is authorized to conduct research and development to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id29454118-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a/1/A"><num value="A">(A)</num><content> identify United States critical domains for economic security and homeland security; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id29454119-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a/1/B"><num value="B">(B)</num><content> evaluate the extent to which disruption, corruption, exploitation, or dysfunction of any of such domain poses a substantial threat to homeland security.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2945411a-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Requirements</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2945411b-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Risk analysis of critical domains</heading><chapeau style="-uslm-lc:I13" class="indent2">The research under paragraph (1) shall include a risk analysis of each identified United States critical domain for economic security to determine the degree to which there exists a present or future threat to homeland security in the event of disruption, corruption, exploitation, or dysfunction to such domain. Such research shall consider, to the extent possible, the following:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id2945411c-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a/2/A/i"><num value="i">(i)</num><content> The vulnerability and resilience of relevant supply chains.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2945411d-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a/2/A/ii"><num value="ii">(ii)</num><content> Foreign production, processing, and manufacturing methods.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2945411e-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a/2/A/iii"><num value="iii">(iii)</num><content> Influence of malign economic actors.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2945411f-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a/2/A/iv"><num value="iv">(iv)</num><content> Asset ownership.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id29454120-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a/2/A/v"><num value="v">(v)</num><content> Relationships within the supply chains of such domains.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id29454121-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a/2/A/vi"><num value="vi">(vi)</num><content> The degree to which the conditions referred to in clauses (i) through (v) would place such a domain at risk of disruption, corruption, exploitation, or dysfunction.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id29454122-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Additional research into high-risk critical domains</heading><chapeau style="-uslm-lc:I13" class="indent2">Based on the identification and risk analysis of United States critical domains for economic security pursuant to paragraph (1) and subparagraph (A) of this paragraph, respectively, the Secretary may conduct additional research into those critical domains, or specific elements thereof, with respect to which there exists the highest degree of a present or future threat to homeland security in the event of disruption, corruption, exploitation, or dysfunction to such a domain. For each such high-risk domain, or element thereof, such research shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id29454123-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a/2/B/i"><num value="i">(i)</num><content> describe the underlying infrastructure and processes;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id29454124-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a/2/B/ii"><num value="ii">(ii)</num><content> analyze present and projected performance of industries that comprise or support such domain;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id29454125-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a/2/B/iii"><num value="iii">(iii)</num><content> examine the extent to which the supply chain of a product or service necessary to such domain is concentrated, either through a small number of sources, or if multiple sources are concentrated in one geographic area;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id29454126-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a/2/B/iv"><num value="iv">(iv)</num><content> examine the extent to which the demand for supplies of goods and services of such industries can be fulfilled by present and projected performance of other industries, identify strategies, plans, and potential barriers to expand the supplier industrial base, and identify the barriers to the participation of such other industries;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id29454127-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a/2/B/v"><num value="v">(v)</num><content> consider each such domain’s performance capacities in stable economic environments, adversarial supply conditions, and under crisis economic constraints;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id29454128-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a/2/B/vi"><num value="vi">(vi)</num><content> identify and define needs and requirements to establish supply resiliency within each such domain; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id29454129-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a/2/B/vii"><num value="vii">(vii)</num><content> consider the effects of sector consolidation, including foreign consolidation, either through mergers or acquisitions, or due to recent geographic realignment, on such industries’ performances.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2945412a-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Consultation</heading><content><p style="-uslm-lc:I12" class="indent1">In conducting the research under paragraph (1) and subparagraph (B) of paragraph (2), the Secretary may consult with appropriate Federal agencies, State agencies, and private sector stakeholders.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2945412b-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> Publication</heading><content><p style="-uslm-lc:I12" class="indent1">Beginning one year after <date date="2021-12-27">December 27, 2021</date>, the Secretary shall publish a report containing information relating to the research under paragraph (1) and subparagraph (B) of paragraph (2), including findings, evidence, analysis, and recommendations. Such report shall be updated annually through 2026.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2945412c-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/b"><num value="b" class="bold">(b)</num><heading class="bold"> Submission to Congress</heading><content><p style="-uslm-lc:I11" class="indent0">Not later than 90 days after the publication of each report required under paragraph (4) of subsection (a), the Secretary shall transmit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate each such report, together with a description of actions the Secretary, in consultation with appropriate Federal agencies, will undertake or has undertaken in response to each such report.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2945412d-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/c"><num value="c" class="bold">(c)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">In this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2945412e-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> United states critical domains for economic security</heading><content><p style="-uslm-lc:I12" class="indent1">The term “United States critical domains for economic security” means the critical infrastructure and other associated industries, technologies, and intellectual property, or any combination thereof, that are essential to the economic security of the United States.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2945412f-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Economic security</heading><content><p style="-uslm-lc:I12" class="indent1">The term “economic security” means the condition of having secure and resilient domestic production capacity, combined with reliable access to the global resources necessary to maintain an acceptable standard of living and to protect core national values.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id29454130-a6d2-11ec-b715-952873bb6ea0" identifier="/us/usc/t6/s474/d"><num value="d" class="bold">(d)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I11" class="indent0">There is authorized to be appropriated $1,000,000 for each of fiscal years 2022 through 2026 to carry out this section.</p>
