<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idda020e7b-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482"><num value="482">§ 482.</num><heading> Facilitating homeland security information sharing procedures</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idda020e7c-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/a"><num value="a" class="bold">(a)</num><heading class="bold"> Procedures for determining extent of sharing of homeland security information</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idda020e7d-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/a/1"><num value="1">(1)</num><chapeau> The President shall prescribe and implement procedures under which relevant Federal agencies—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idda020e7e-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/a/1/A"><num value="A">(A)</num><content> share relevant and appropriate homeland security information with other Federal agencies, including the Department, and appropriate State and local personnel;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idda02358f-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/a/1/B"><num value="B">(B)</num><content> identify and safeguard homeland security information that is sensitive but unclassified; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idda023590-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/a/1/C"><num value="C">(C)</num><content> to the extent such information is in classified form, determine whether, how, and to what extent to remove classified information, as appropriate, and with which such personnel it may be shared after such information is removed.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idda023591-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/a/2"><num value="2">(2)</num><content> The President shall ensure that such procedures apply to all agencies of the Federal Government.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idda023592-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/a/3"><num value="3">(3)</num><content> Such procedures shall not change the substantive requirements for the classification and safeguarding of classified information.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idda023593-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/a/4"><num value="4">(4)</num><content> Such procedures shall not change the requirements and authorities to protect sources and methods.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idda025ca4-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/b"><num value="b" class="bold">(b)</num><heading class="bold"> Procedures for sharing of homeland security information</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idda025ca5-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/b/1"><num value="1">(1)</num><content> Under procedures prescribed by the President, all appropriate agencies, including the intelligence community, shall, through information sharing systems, share homeland security information with Federal agencies and appropriate State and local personnel to the extent such information may be shared, as determined in accordance with subsection (a), together with assessments of the credibility of such information.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idda025ca6-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/b/2"><num value="2">(2)</num><chapeau> Each information sharing system through which information is shared under paragraph (1) shall—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idda025ca7-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/b/2/A"><num value="A">(A)</num><content> have the capability to transmit unclassified or classified information, though the procedures and recipients for each capability may differ;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idda0283b8-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/b/2/B"><num value="B">(B)</num><content> have the capability to restrict delivery of information to specified subgroups by geographic location, type of organization, position of a recipient within an organization, or a recipient’s need to know such information;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idda0283b9-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/b/2/C"><num value="C">(C)</num><content> be configured to allow the efficient and effective sharing of information; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idda0283ba-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/b/2/D"><num value="D">(D)</num><content> be accessible to appropriate State and local personnel.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idda0283bb-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/b/3"><num value="3">(3)</num><chapeau> The procedures prescribed under paragraph (1) shall establish conditions on the use of information shared under paragraph (1)—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idda0283bc-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/b/3/A"><num value="A">(A)</num><content> to limit the redissemination of such information to ensure that such information is not used for an unauthorized purpose;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idda0283bd-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/b/3/B"><num value="B">(B)</num><content> to ensure the security and confidentiality of such information;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idda02aace-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/b/3/C"><num value="C">(C)</num><content> to protect the constitutional and statutory rights of any individuals who are subjects of such information; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idda02aacf-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/b/3/D"><num value="D">(D)</num><content> to provide data integrity through the timely removal and destruction of obsolete or erroneous names and information.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idda02aad0-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/b/4"><num value="4">(4)</num><content> The procedures prescribed under paragraph (1) shall ensure, to the greatest extent practicable, that the information sharing system through which information is shared under such paragraph include existing information sharing systems, including, but not limited to, the National Law Enforcement Telecommunications System, the Regional Information Sharing System, and the Terrorist Threat Warning System of the Federal Bureau of Investigation.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idda02d1e1-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/b/5"><num value="5">(5)</num><content> Each appropriate Federal agency, as determined by the President, shall have access to each information sharing system through which information is shared under paragraph (1), and shall therefore have access to all information, as appropriate, shared under such paragraph.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idda02d1e2-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/b/6"><num value="6">(6)</num><chapeau> The procedures prescribed under paragraph (1) shall ensure that appropriate State and local personnel are authorized to use such information sharing systems—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idda02d1e3-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/b/6/A"><num value="A">(A)</num><content> to access information shared with such personnel; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idda02d1e4-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/b/6/B"><num value="B">(B)</num><content> to share, with others who have access to such information sharing systems, the homeland security information of their own jurisdictions, which shall be marked appropriately as pertaining to potential terrorist activity.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idda02f8f5-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/b/7"><num value="7">(7)</num><content> Under procedures prescribed jointly by the Director of Central Intelligence and the Attorney General, each appropriate Federal agency, as determined by the President, shall review and assess the information shared under paragraph (6) and integrate such information with existing intelligence.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idda02f8f6-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/c"><num value="c" class="bold">(c)</num><heading class="bold"> Sharing of classified information and sensitive but unclassified information with State and local personnel</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idda02f8f7-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/c/1"><num value="1">(1)</num><content> The President shall prescribe procedures under which Federal agencies may, to the extent the President considers necessary, share with appropriate State and local personnel homeland security information that remains classified or otherwise protected after the determinations prescribed under the procedures set forth in subsection (a).</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idda032008-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/c/2"><num value="2">(2)</num><chapeau> It is the sense of Congress that such procedures may include 1 or more of the following means:</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idda032009-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/c/2/A"><num value="A">(A)</num><content> Carrying out security clearance investigations with respect to appropriate State and local personnel.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idda03200a-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/c/2/B"><num value="B">(B)</num><content> With respect to information that is sensitive but unclassified, entering into nondisclosure agreements with appropriate State and local personnel.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idda03200b-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/c/2/C"><num value="C">(C)</num><content> Increased use of information-sharing partnerships that include appropriate State and local personnel, such as the Joint Terrorism Task Forces of the Federal Bureau of Investigation, the Anti-Terrorism Task Forces of the Department of Justice, and regional Terrorism Early Warning Groups.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idda03471c-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/c/3"><num value="3">(3)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="idda03471d-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/c/3/A"><num value="A">(A)</num><chapeau> The Secretary shall establish a program to provide appropriate training to officials described in subparagraph (B) in order to assist such officials in—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="idda03471e-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/c/3/A/i"><num value="i">(i)</num><content> identifying sources of potential terrorist threats through such methods as the Secretary determines appropriate;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idda03471f-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/c/3/A/ii"><num value="ii">(ii)</num><content> reporting information relating to such potential terrorist threats to the appropriate Federal agencies in the appropriate form and manner;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idda034720-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/c/3/A/iii"><num value="iii">(iii)</num><content> assuring that all reported information is systematically submitted to and passed on by the Department for use by appropriate Federal agencies; and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idda034721-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/c/3/A/iv"><num value="iv">(iv)</num><content> understanding the mission and roles of the intelligence community to promote more effective information sharing among Federal, State, and local officials and representatives of the private sector to prevent terrorist attacks against the United States.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idda036e32-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/c/3/B"><num value="B">(B)</num><content> The officials referred to in subparagraph (A) are officials of State and local government agencies and representatives of private sector entities with responsibilities relating to the oversight and management of first responders, counterterrorism activities, or critical infrastructure.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idda036e33-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/c/3/C"><num value="C">(C)</num><content> The Secretary shall consult with the Attorney General to ensure that the training program established in subparagraph (A) does not duplicate the training program established in section 908 of the USA PATRIOT Act (<ref href="/us/pl/107/56">Public Law 107–56</ref>; <ref href="/us/usc/t28/s509">28 U.S.C. 509</ref> note).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idda039544-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/c/3/D"><num value="D">(D)</num><content> The Secretary shall carry out this paragraph in consultation with the Director of Central Intelligence and the Attorney General.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idda039545-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/d"><num value="d" class="bold">(d)</num><heading class="bold"> Responsible officials</heading><content><p style="-uslm-lc:I11" class="indent0">For each affected Federal agency, the head of such agency shall designate an official to administer this chapter with respect to such agency.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idda039546-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/e"><num value="e" class="bold">(e)</num><heading class="bold"> Federal control of information</heading><content><p style="-uslm-lc:I11" class="indent0">Under procedures prescribed under this section, information obtained by a State or local government from a Federal agency under this section shall remain under the control of the Federal agency, and a State or local law authorizing or requiring such a government to disclose information shall not apply to such information.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idda03bc57-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/f"><num value="f" class="bold">(f)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">As used in this section:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idda03bc58-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/f/1"><num value="1">(1)</num><chapeau> The term “homeland security information” means any information possessed by a Federal, State, or local agency that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idda03bc59-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/f/1/A"><num value="A">(A)</num><content> relates to the threat of terrorist activity;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idda03bc5a-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/f/1/B"><num value="B">(B)</num><content> relates to the ability to prevent, interdict, or disrupt terrorist activity;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idda03bc5b-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/f/1/C"><num value="C">(C)</num><content> would improve the identification or investigation of a suspected terrorist or terrorist organization; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idda03bc5c-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/f/1/D"><num value="D">(D)</num><content> would improve the response to a terrorist act.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda03bc5d-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/f/2"><num value="2">(2)</num><content> The term “intelligence community” has the meaning given such term in <ref href="/us/usc/t50/s3003/4">section 3003(4) of title 50</ref>.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda03bc5e-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/f/3"><num value="3">(3)</num><chapeau> The term “State and local personnel” means any of the following persons involved in prevention, preparation, or response for terrorist attack:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idda03e36f-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/f/3/A"><num value="A">(A)</num><content> State Governors, mayors, and other locally elected officials.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idda03e370-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/f/3/B"><num value="B">(B)</num><content> State and local law enforcement personnel and firefighters.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idda03e371-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/f/3/C"><num value="C">(C)</num><content> Public health and medical professionals.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idda03e372-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/f/3/D"><num value="D">(D)</num><content> Regional, State, and local emergency management agency personnel, including State adjutant generals.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idda03e373-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/f/3/E"><num value="E">(E)</num><content> Other appropriate emergency response agency personnel.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idda03e374-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/f/3/F"><num value="F">(F)</num><content> Employees of private-sector entities that affect critical infrastructure, cyber, economic, or public health security, as designated by the Federal Government in procedures developed pursuant to this section.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda040a85-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/f/4"><num value="4">(4)</num><content> The term “State” includes the District of Columbia and any commonwealth, territory, or possession of the United States.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idda040a86-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s482/g"><num value="g" class="bold">(g)</num><heading class="bold"> Construction</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this chapter shall be construed as authorizing any department, bureau, agency, officer, or employee of the Federal Government to request, receive, or transmit to any other Government entity or personnel, or transmit to any State or local entity or personnel otherwise authorized by this chapter to receive homeland security information, any information collected by the Federal Government solely for statistical purposes in violation of any other provision of law relating to the confidentiality of such information.</p>

<p style="-uslm-lc:I21" class="indent0">Ex. Ord. No. 13311, <date date="2003-07-29">July 29, 2003</date>, 68 F.R. 45149, as amended by Ex. Ord. No. 13388, § 8(a), <date date="2005-10-25">Oct. 25, 2005</date>, 70 F.R. 62025, provided:</p>
<p>By the authority vested in me by the Constitution and the laws of the United States, including sections 892 and 893 of the Homeland Security Act of 2002 (the “Act”) (<ref href="/us/usc/t6/s482">6 U.S.C. 482</ref> and 483) and <ref href="/us/usc/t3/s301">section 301 of title 3</ref>, United States Code, it is hereby ordered as follows:</p>
<p style="-uslm-lc:I21" class="indent0"><inline class="small-caps">Section</inline> 1. <i>Assignment of Functions</i>. (a) The functions of the President under section 892 of the Act are assigned to the Secretary of Homeland Security (the “Secretary”), except the functions of the President under subsections 892(a)(2) and 892(b)(7).</p>
<p style="-uslm-lc:I21" class="indent0">(b) Subject to section 2(b) of this order, the function of the President under section 893 of the Act is assigned to the Secretary.</p>
<p style="-uslm-lc:I21" class="indent0">(c) Procedures issued by the Secretary in the performance of the function of the President under section 892(a)(1) of the Act shall apply to all agencies of the Federal Government. Such procedures shall specify that the President may make, or may authorize another officer of the United States to make, exceptions to the procedures.</p>
<p style="-uslm-lc:I21" class="indent0">(d) The function of the President under section 892(b)(7) of the Act is delegated to the Attorney General and the Director of National Intelligence, to be exercised jointly.</p>
<p style="-uslm-lc:I21" class="indent0">(e) In performing the functions assigned to the Secretary by subsection (a) of this section, the Secretary shall coordinate with the Secretary of State, the Secretary of Defense, the Attorney General, the Secretary of Energy, the Director of the Office of Management and Budget, the Director of National Intelligence, the Archivist of the United States, and as the Secretary deems appropriate, other officers of the United States.</p>
<p style="-uslm-lc:I21" class="indent0">(f) A determination, under the procedures issued by the Secretary in the performance of the function of the President under section 892(a)(1) of the Act, as to whether, or to what extent, an individual who falls within the category of “State and local personnel” as defined in sections 892(f)(3) and (f)(4) of the Act shall have access to information classified pursuant to [former] Executive Order 12958 of <date date="1995-04-17">April 17, 1995</date>, as amended, is a discretionary determination and shall be conclusive and not subject to review or appeal.</p>
<p style="-uslm-lc:I21" class="indent0"><inline class="small-caps">Sec</inline>. 2. <i>Rules of Construction</i>. Nothing in this order shall be construed to impair or otherwise affect:</p>
<p style="-uslm-lc:I21" class="indent0">(a) the authority of the Director of National Intelligence under section 102A(i)(1) of the National Security Act of 1947, as amended (<ref href="/us/usc/t50/s403–3/c/7">50 U.S.C. 403–3(c)(7)</ref> [sic]) [<ref href="/us/usc/t50/s3024/i/1">50 U.S.C. 3024(i)(1)</ref>], to protect intelligence sources and methods from unauthorized disclosure;</p>
<p style="-uslm-lc:I21" class="indent0">(b) the functions of the Director of the Office of Management and Budget relating to budget, administrative, or legislative proposals; or</p>
<p style="-uslm-lc:I21" class="indent0">(c) the provisions of Executive Orders 12958 of <date date="1995-04-17">April 17, 1995</date> [former <ref href="/us/usc/t50/s435">50 U.S.C. 435</ref> note], as amended, and 12968 of <date date="1995-08-02">August 2, 1995</date> [<ref href="/us/usc/t50/s3161">50 U.S.C. 3161</ref> note], as amended.</p>
<p style="-uslm-lc:I21" class="indent0"><inline class="small-caps">Sec</inline>. 3. <i>General Provision</i>. This order is intended only to improve the internal management of the Federal Government and is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity, against the United States, its departments, agencies, or other entities, its officers or employees, or any other person.</p>
