<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idda2415b5-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563"><num value="563">§ 563.</num><heading> 5-year technology investment plan</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idda2415b6-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">The Administrator shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idda2415b7-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/a/1"><num value="1">(1)</num><content> not later than 180 days after <date date="2014-12-18">December 18, 2014</date>, develop and submit to Congress a strategic 5-year technology investment plan, that may include a classified addendum to report sensitive transportation security risks, technology vulnerabilities, or other sensitive security information; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda2415b8-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/a/2"><num value="2">(2)</num><content> to the extent possible, publish the Plan in an unclassified format in the public domain.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idda243cc9-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/b"><num value="b" class="bold">(b)</num><heading class="bold"> Consultation</heading><chapeau style="-uslm-lc:I11" class="indent0">The Administrator shall develop the Plan in consultation with—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idda243cca-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/b/1"><num value="1">(1)</num><content> the Under Secretary for Management;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda243ccb-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/b/2"><num value="2">(2)</num><content> the Under Secretary for Science and Technology;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda243ccc-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/b/3"><num value="3">(3)</num><content> the Chief Information Officer; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda243ccd-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/b/4"><num value="4">(4)</num><content> the aviation industry stakeholder advisory committee established by the Administrator.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idda243cce-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/c"><num value="c" class="bold">(c)</num><heading class="bold"> Approval</heading><content><p style="-uslm-lc:I11" class="indent0">The Administrator may not publish the Plan under subsection (a)(2) until it has been approved by the Secretary.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idda243ccf-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/d"><num value="d" class="bold">(d)</num><heading class="bold"> Contents of Plan</heading><chapeau style="-uslm-lc:I11" class="indent0">The Plan shall include—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idda243cd0-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/d/1"><num value="1">(1)</num><content> an analysis of transportation security risks and the associated capability gaps that would be best addressed by security-related technology, including consideration of the most recent quadrennial homeland security review under <ref href="/us/usc/t6/s347">section 347 of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda243cd1-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/d/2"><num value="2">(2)</num><chapeau> a set of security-related technology acquisition needs that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idda2463e2-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/d/2/A"><num value="A">(A)</num><content> is prioritized based on risk and associated capability gaps identified under paragraph (1); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idda2463e3-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/d/2/B"><num value="B">(B)</num><content> includes planned technology programs and projects with defined objectives, goals, timelines, and measures;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda2463e4-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/d/3"><num value="3">(3)</num><content> an analysis of current and forecast trends in domestic and international passenger travel;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda2463e5-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/d/4"><num value="4">(4)</num><content> an identification of currently deployed security-related technologies that are at or near the end of their lifecycles;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda2463e6-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/d/5"><num value="5">(5)</num><content> an identification of test, evaluation, modeling, and simulation capabilities, including target methodologies, rationales, and timelines necessary to support the acquisition of the security-related technologies expected to meet the needs under paragraph (2);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda2463e7-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/d/6"><num value="6">(6)</num><content> an identification of opportunities for public-private partnerships, small and disadvantaged company participation, intragovernment collaboration, university centers of excellence, and national laboratory technology transfer;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda248af8-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/d/7"><num value="7">(7)</num><content> an identification of the Administration’s acquisition workforce needs for the management of planned security-related technology acquisitions, including consideration of leveraging acquisition expertise of other Federal agencies;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda248af9-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/d/8"><num value="8">(8)</num><content> an identification of the security resources, including information security resources, that will be required to protect security-related technology from physical or cyber theft, diversion, sabotage, or attack;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda248afa-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/d/9"><num value="9">(9)</num><content> an identification of initiatives to streamline the Administration’s acquisition process and provide greater predictability and clarity to small, medium, and large businesses, including the timeline for testing and evaluation;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda248afb-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/d/10"><num value="10">(10)</num><content> an assessment of the impact to commercial aviation passengers;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda248afc-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/d/11"><num value="11">(11)</num><content> a strategy for consulting airport management, air carrier representatives, and Federal security directors whenever an acquisition will lead to the removal of equipment at airports, and how the strategy for consulting with such officials of the relevant airports will address potential negative impacts on commercial passengers or airport operations; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda24b20d-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/d/12"><num value="12">(12)</num><content> in consultation with the National Institutes of Standards and Technology, an identification of security-related technology interface standards, in existence or if implemented, that could promote more interoperable passenger, baggage, and cargo screening systems.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idda24b20e-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/e"><num value="e" class="bold">(e)</num><heading class="bold"> Leveraging the private sector</heading><chapeau style="-uslm-lc:I11" class="indent0">To the extent possible, and in a manner that is consistent with fair and equitable practices, the Plan shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idda24b20f-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/e/1"><num value="1">(1)</num><content> leverage emerging technology trends and research and development investment trends within the public and private sectors;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda24b210-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/e/2"><num value="2">(2)</num><content> incorporate private sector input, including from the aviation industry stakeholder advisory committee established by the Administrator, through requests for information, industry days, and other innovative means consistent with the Federal Acquisition Regulation; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda24d921-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/e/3"><num value="3">(3)</num><content> in consultation with the Under Secretary for Science and Technology, identify technologies in existence or in development that, with or without adaptation, are expected to be suitable to meeting mission needs.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idda24d922-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/f"><num value="f" class="bold">(f)</num><heading class="bold"> Disclosure</heading><content><p style="-uslm-lc:I11" class="indent0">The Administrator shall include with the Plan a list of nongovernment persons that contributed to the writing of the Plan.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idda24d923-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/g"><num value="g" class="bold">(g)</num><heading class="bold"> Update and report</heading><chapeau style="-uslm-lc:I11" class="indent0">The Administrator shall, in collaboration with relevant industry and government stakeholders, annually submit to Congress in an appendix to the budget request and publish in an unclassified format in the public domain—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idda24d924-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/g/1"><num value="1">(1)</num><content> an update of the Plan;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda24d925-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/g/2"><num value="2">(2)</num><content> a report on the extent to which each security-related technology acquired by the Administration since the last issuance or update of the Plan is consistent with the planned technology programs and projects identified under subsection (d)(2) for that security-related technology; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda250036-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/g/3"><num value="3">(3)</num><content> information about acquisitions completed during the fiscal year preceding the fiscal year during which the report is submitted.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idda250037-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/h"><num value="h" class="bold">(h)</num><heading class="bold"> Additional update requirements</heading><chapeau style="-uslm-lc:I11" class="indent0">Updates and reports under subsection (g) shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idda250038-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/h/1"><num value="1">(1)</num><chapeau> be prepared in consultation with—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idda250039-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/h/1/A"><num value="A">(A)</num><content> the persons described in subsection (b); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idda25003a-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/h/1/B"><num value="B">(B)</num><content> the Surface Transportation Security Advisory Committee established under <ref href="/us/usc/t6/s204">section 204 of this title</ref>; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idda25003b-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/h/2"><num value="2">(2)</num><chapeau> include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idda25003c-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/h/2/A"><num value="A">(A)</num><content> information relating to technology investments by the Transportation Security Administration and the private sector that the Department supports with research, development, testing, and evaluation for aviation, including air cargo, and surface transportation security;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idda25003d-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/h/2/B"><num value="B">(B)</num><content> information about acquisitions completed during the fiscal year preceding the fiscal year during which the report is submitted;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idda25274e-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/h/2/C"><num value="C">(C)</num><content> information relating to equipment of the Transportation Security Administration that is in operation after the end of the life-cycle of the equipment specified by the manufacturer of the equipment; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idda25274f-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/h/2/D"><num value="D">(D)</num><content> to the extent practicable, a classified addendum to report sensitive transportation security risks and associated capability gaps that would be best addressed by security-related technology described in subparagraph (A).</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idda252750-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/i"><num value="i" class="bold">(i)</num><heading class="bold"> Notice of covered changes to plan</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idda252751-099f-11eb-8f89-efd6e4a0cb8a" identifier="/us/usc/t6/s563/i/1"><num value="1" class="bold">(1)</num><heading class="bold"> Notice required</heading><content><p style="-uslm-lc:I12" class="indent1">The Administrator shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Homeland Security of the House of Representatives notice of any covered change to the Plan not later than 90 days after the date that the covered change is made.</p>
