<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id7ec4b901-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604"><num value="604">§ 604.</num><heading> Urban Area Security Initiative</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7ec4b902-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/a"><num value="a" class="bold">(a)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I11" class="indent0">There is established an Urban Area Security Initiative to provide grants to assist high-risk urban areas in preventing, preparing for, protecting against, and responding to acts of terrorism.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7ec4b903-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/b"><num value="b" class="bold">(b)</num><heading class="bold"> Assessment and designation of high-risk urban areas</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7ec4b904-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Administrator shall designate high-risk urban areas to receive grants under this section based on procedures under this subsection.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7ec4b905-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Initial assessment</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7ec4b906-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/b/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau>For each fiscal year, the Administrator shall conduct an initial assessment of the relative threat, vulnerability, and consequences from acts of terrorism faced by each eligible metropolitan area, including consideration of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7ec4b907-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/b/2/A/i"><num value="i">(i)</num><content> the factors set forth in subparagraphs (A) through (H) and (K) of <ref href="/us/usc/t6/s608/a/1">section 608(a)(1) of this title</ref>; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7ec4b908-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/b/2/A/ii"><num value="ii">(ii)</num><content> information and materials submitted under subparagraph (B).</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7ec4b909-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/b/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Submission of information by eligible metropolitan areas</heading><chapeau>Prior to conducting each initial assessment under subparagraph (A), the Administrator shall provide each eligible metropolitan area with, and shall notify each eligible metropolitan area of, the opportunity to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7ec4b90a-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/b/2/B/i"><num value="i">(i)</num><content> submit information that the eligible metropolitan area believes to be relevant to the determination of the threat, vulnerability, and consequences it faces from acts of terrorism; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7ec4b90b-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/b/2/B/ii"><num value="ii">(ii)</num><content> review the risk assessment conducted by the Department of that eligible metropolitan area, including the bases for the assessment by the Department of the threat, vulnerability, and consequences from acts of terrorism faced by that eligible metropolitan area, and remedy erroneous or incomplete information.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7ec4b90c-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Designation of high-risk urban areas</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7ec4b90d-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/b/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Designation</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id7ec4b90e-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/b/3/A/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">For each fiscal year, after conducting the initial assessment under paragraph (2), and based on that assessment, the Administrator shall designate high-risk urban areas that may submit applications for grants under this section.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id7ec4b90f-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/b/3/A/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Additional areas</heading><chapeau>Notwithstanding paragraph (2), the Administrator may—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id7ec4b910-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/b/3/A/ii/I"><num value="I">(I)</num><content> in any case where an eligible metropolitan area consists of more than 1 metropolitan division (as that term is defined by the Office of Management and Budget) designate more than 1 high-risk urban area within a single eligible metropolitan area; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id7ec4b911-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/b/3/A/ii/II"><num value="II">(II)</num><content> designate an area that is not an eligible metropolitan area as a high-risk urban area based on the assessment by the Administrator of the relative threat, vulnerability, and consequences from acts of terrorism faced by the area.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id7ec4b912-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/b/3/A/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Rule of construction</heading><chapeau>Nothing in this subsection may be construed to require the Administrator to—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id7ec4b913-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/b/3/A/iii/I"><num value="I">(I)</num><content> designate all eligible metropolitan areas that submit information to the Administrator under paragraph (2)(B)(i) as high-risk urban areas; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id7ec4b914-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/b/3/A/iii/II"><num value="II">(II)</num><content> designate all areas within an eligible metropolitan area as part of the high-risk urban area.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7ec4b915-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/b/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Jurisdictions included in high-risk urban areas</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id7ec4b916-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/b/3/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">In designating high-risk urban areas under subparagraph (A), the Administrator shall determine which jurisdictions, at a minimum, shall be included in each high-risk urban area.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id7ec4b917-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/b/3/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Additional jurisdictions</heading><content><p style="-uslm-lc:I14" class="indent3">A high-risk urban area designated by the Administrator may, in consultation with the State or States in which such high-risk urban area is located, add additional jurisdictions to the high-risk urban area.</p>

</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7ec4b918-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/c"><num value="c" class="bold">(c)</num><heading class="bold"> Application</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7ec4b919-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">An area designated as a high-risk urban area under subsection (b) may apply for a grant under this section.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7ec4b91a-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Minimum contents of application</heading><chapeau>In an application for a grant under this section, a high-risk urban area shall submit—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7ec4b91b-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/c/2/A"><num value="A">(A)</num><content> a plan describing the proposed division of responsibilities and distribution of funding among the local and tribal governments in the high-risk urban area;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7ec4b91c-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/c/2/B"><num value="B">(B)</num><content> the name of an individual to serve as a high-risk urban area liaison with the Department and among the various jurisdictions in the high-risk urban area; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7ec4b91d-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/c/2/C"><num value="C">(C)</num><content> such information in support of the application as the Administrator may reasonably require.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7ec4b91e-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Annual applications</heading><content><p style="-uslm-lc:I12" class="indent1">Applicants for grants under this section shall apply or reapply on an annual basis.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7ec4b91f-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/c/4"><num value="4" class="bold">(4)</num><heading class="bold"> State review and transmission</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7ec4b920-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/c/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">To ensure consistency with State homeland security plans, a high-risk urban area applying for a grant under this section shall submit its application to each State within which any part of that high-risk urban area is located for review before submission of such application to the Department.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7ec4b921-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/c/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Deadline</heading><content><p style="-uslm-lc:I13" class="indent2">Not later than 30 days after receiving an application from a high-risk urban area under subparagraph (A), a State shall transmit the application to the Department.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7ec4b922-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/c/4/C"><num value="C" class="bold">(C)</num><heading class="bold"> Opportunity for State comment</heading><chapeau>If the Governor of a State determines that an application of a high-risk urban area is inconsistent with the State homeland security plan of that State, or otherwise does not support the application, the Governor shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7ec4b923-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/c/4/C/i"><num value="i">(i)</num><content> notify the Administrator, in writing, of that fact; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7ec4b924-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/c/4/C/ii"><num value="ii">(ii)</num><content> provide an explanation of the reason for not supporting the application at the time of transmission of the application.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7ec4b925-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/c/5"><num value="5" class="bold">(5)</num><heading class="bold"> Opportunity to amend</heading><content><p style="-uslm-lc:I12" class="indent1">In considering applications for grants under this section, the Administrator shall provide applicants with a reasonable opportunity to correct defects in the application, if any, before making final awards.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7ec4b926-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/d"><num value="d" class="bold">(d)</num><heading class="bold"> Distribution of awards</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7ec4b927-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">If the Administrator approves the application of a high-risk urban area for a grant under this section, the Administrator shall distribute the grant funds to the State or States in which that high-risk urban area is located.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7ec4b928-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> State distribution of funds</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7ec4b929-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/d/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Not later than 45 days after the date that a State receives grant funds under paragraph (1), that State shall provide the high-risk urban area awarded that grant not less than 80 percent of the grant funds. Any funds retained by a State shall be expended on items, services, or activities that benefit the high-risk urban area.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7ec4b92a-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/d/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Funds retained</heading><content><p style="-uslm-lc:I13" class="indent2">A State shall provide each relevant high-risk urban area with an accounting of the items, services, or activities on which any funds retained by the State under subparagraph (A) were expended.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7ec4b92b-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Interstate urban areas</heading><chapeau>If parts of a high-risk urban area awarded a grant under this section are located in 2 or more States, the Administrator shall distribute to each such State—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7ec4b92c-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/d/3/A"><num value="A">(A)</num><content> a portion of the grant funds in accordance with the proposed distribution set forth in the application; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7ec4b92d-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/d/3/B"><num value="B">(B)</num><content> if no agreement on distribution has been reached, a portion of the grant funds determined by the Administrator to be appropriate.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7ec4b92e-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/d/4"><num value="4" class="bold">(4)</num><heading class="bold"> Certifications regarding distribution of grant funds to high-risk urban areas</heading><content><p style="-uslm-lc:I12" class="indent1">A State that receives grant funds under paragraph (1) shall certify to the Administrator that the State has made available to the applicable high-risk urban area the required funds under paragraph (2).</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7ec4b92f-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/e"><num value="e" class="bold">(e)</num><heading class="bold"> Authorization of appropriations</heading><chapeau>There are authorized to be appropriated for grants under this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7ec4b930-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/e/1"><num value="1">(1)</num><content> $850,000,000 for fiscal year 2008;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7ec4b931-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/e/2"><num value="2">(2)</num><content> $950,000,000 for fiscal year 2009;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7ec4b932-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/e/3"><num value="3">(3)</num><content> $1,050,000,000 for fiscal year 2010;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7ec4b933-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/e/4"><num value="4">(4)</num><content> $1,150,000,000 for fiscal year 2011;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7ec4b934-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/e/5"><num value="5">(5)</num><content> $1,300,000,000 for fiscal year 2012; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7ec4b935-8841-11e3-9a38-c5f921184fc2" identifier="/us/usc/t6/s604/e/6"><num value="6">(6)</num><content> such sums as are necessary for fiscal year 2013, and each fiscal year thereafter.</content>
