<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id6ea948d9-a3fe-11ea-a0f5-ea66c03e78d5" identifier="/us/usc/t6/s609a"><num value="609a">§ 609a.</num><heading> Nonprofit Security Grant Program</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6ea948da-a3fe-11ea-a0f5-ea66c03e78d5" identifier="/us/usc/t6/s609a/a"><num value="a" class="bold">(a)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I11" class="indent0">There is established in the Department a program to be known as the “Nonprofit Security Grant Program” (in this section referred to as the “Program”). Under the Program, the Secretary, acting through the Administrator, shall make grants to eligible nonprofit organizations described in subsection (b), through the State in which such organizations are located, for target hardening and other security enhancements to protect against terrorist attacks.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6ea948db-a3fe-11ea-a0f5-ea66c03e78d5" identifier="/us/usc/t6/s609a/b"><num value="b" class="bold">(b)</num><heading class="bold"> Eligible recipients</heading><chapeau>Eligible nonprofit organizations described in this <ref class="footnoteRef" idref="fn002084">1</ref><note type="footnote" id="fn002084"><num>1</num> So in original. The word “this” probably should not appear.</note> subsection (a) are organizations that are—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6ea948dc-a3fe-11ea-a0f5-ea66c03e78d5" identifier="/us/usc/t6/s609a/b/1"><num value="1">(1)</num><content> described in <ref href="/us/usc/t26/s501/c/3">section 501(c)(3) of title 26</ref> and exempt from tax under section 501(a) of such title; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6ea948dd-a3fe-11ea-a0f5-ea66c03e78d5" identifier="/us/usc/t6/s609a/b/2"><num value="2">(2)</num><content> determined to be at risk of a terrorist attack by the Administrator.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6ea948de-a3fe-11ea-a0f5-ea66c03e78d5" identifier="/us/usc/t6/s609a/c"><num value="c" class="bold">(c)</num><heading class="bold"> Permitted uses</heading><chapeau>The recipient of a grant under this section may use such grant for any of the following uses:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6ea948df-a3fe-11ea-a0f5-ea66c03e78d5" identifier="/us/usc/t6/s609a/c/1"><num value="1">(1)</num><content> Target hardening activities, including physical security enhancement equipment and inspection and screening systems.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6ea96ff0-a3fe-11ea-a0f5-ea66c03e78d5" identifier="/us/usc/t6/s609a/c/2"><num value="2">(2)</num><content> Fees for security training relating to physical security and cybersecurity, target hardening, terrorism awareness, and employee awareness.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6ea96ff1-a3fe-11ea-a0f5-ea66c03e78d5" identifier="/us/usc/t6/s609a/c/3"><num value="3">(3)</num><content> Any other appropriate activity, including cybersecurity resilience activities, as determined by the Administrator.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6ea96ff2-a3fe-11ea-a0f5-ea66c03e78d5" identifier="/us/usc/t6/s609a/d"><num value="d" class="bold">(d)</num><heading class="bold"> Period of performance</heading><content><p style="-uslm-lc:I11" class="indent0">The Administrator shall make funds provided under this section available for use by a recipient of a grant for a period of not less than 36 months.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6ea96ff3-a3fe-11ea-a0f5-ea66c03e78d5" identifier="/us/usc/t6/s609a/e"><num value="e" class="bold">(e)</num><heading class="bold"> Report</heading><content><p style="-uslm-lc:I11" class="indent0">The Administrator shall annually for each of fiscal years 2020 through 2024 submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report containing information on the expenditure by each grant recipient of grant funds made under this section.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6ea96ff4-a3fe-11ea-a0f5-ea66c03e78d5" identifier="/us/usc/t6/s609a/f"><num value="f" class="bold">(f)</num><heading class="bold"> Authorization of Appropriations</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6ea96ff5-a3fe-11ea-a0f5-ea66c03e78d5" identifier="/us/usc/t6/s609a/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">There is authorized to be appropriated $75 million for each of fiscal years 2020 through 2024 to carry out this section.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6ea96ff6-a3fe-11ea-a0f5-ea66c03e78d5" identifier="/us/usc/t6/s609a/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Specification</heading><chapeau>Of the amounts authorized to be appropriated pursuant to paragraph (1)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6ea96ff7-a3fe-11ea-a0f5-ea66c03e78d5" identifier="/us/usc/t6/s609a/f/2/A"><num value="A">(A)</num><content> $50 million is authorized for eligible recipients located in jurisdictions that receive funding under <ref href="/us/usc/t6/s604">section 604 of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6ea96ff8-a3fe-11ea-a0f5-ea66c03e78d5" identifier="/us/usc/t6/s609a/f/2/B"><num value="B">(B)</num><content> $25 million is authorized for eligible recipients in jurisdictions not receiving funding under <ref href="/us/usc/t6/s604">section 604 of this title</ref>.</content>
