<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idf270d037-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d"><num value="665d">§ 665d.</num><heading> Sector Risk Management Agencies</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf270d038-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">Consistent with applicable law, Presidential directives, Federal regulations, and strategic guidance from the Secretary, each Sector Risk Management Agency, in coordination with the Director, shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idf270d039-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/a/1"><num value="1">(1)</num><content> provide specialized sector-specific expertise to critical infrastructure owners and operators within its designated critical infrastructure sector or subsector of such sector; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf270d03a-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/a/2"><num value="2">(2)</num><content> support programs and associated activities of such sector or subsector of such sector.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf270d03b-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/b"><num value="b" class="bold">(b)</num><heading class="bold"> Implementation</heading><chapeau style="-uslm-lc:I11" class="indent0">In carrying out this section, Sector Risk Management Agencies shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idf270d03c-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/b/1"><num value="1">(1)</num><content> coordinate with the Department and, as appropriate, other relevant Federal departments and agencies;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf270d03d-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/b/2"><num value="2">(2)</num><content> collaborate with critical infrastructure owners and operators within the designated critical infrastructure sector or subsector of such sector; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf270d03e-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/b/3"><num value="3">(3)</num><content> coordinate with independent regulatory agencies, and State, local, Tribal, and territorial entities, as appropriate.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf270d03f-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c"><num value="c" class="bold">(c)</num><heading class="bold"> Responsibilities</heading><chapeau style="-uslm-lc:I11" class="indent0">Consistent with applicable law, Presidential directives, Federal regulations, and strategic guidance from the Secretary, each Sector Risk Management Agency shall utilize its specialized expertise regarding its designated critical infrastructure sector or subsector of such sector and authorities under applicable law to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idf270d040-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/1"><num value="1">(1)</num><chapeau> support sector risk management, in coordination with the Director, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf270d041-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/1/A"><num value="A">(A)</num><content> establishing and carrying out programs to assist critical infrastructure owners and operators within the designated sector or subsector of such sector in identifying, understanding, and mitigating threats, vulnerabilities, and risks to their systems or assets, or within a region, sector, or subsector of such sector; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf270d042-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/1/B"><num value="B">(B)</num><content> recommending security measures to mitigate the consequences of destruction, compromise, and disruption of systems and assets;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf270d043-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/2"><num value="2">(2)</num><chapeau> assess sector risk, in coordination with the Director, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf270d044-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/2/A"><num value="A">(A)</num><content> identifying, assessing, and prioritizing risks within the designated sector or subsector of such sector, considering physical security and cybersecurity threats, vulnerabilities, and consequences; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf270d045-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/2/B"><num value="B">(B)</num><content> supporting national risk assessment efforts led by the Department;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf270d046-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/3"><num value="3">(3)</num><chapeau> sector coordination, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf270d047-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/3/A"><num value="A">(A)</num><content> serving as a day-to-day Federal interface for the prioritization and coordination of sector-specific activities and responsibilities under this title;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf270d048-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/3/B"><num value="B">(B)</num><content> serving as the Federal Government coordinating council chair for the designated sector or subsector of such sector; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf2734049-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/3/C"><num value="C">(C)</num><content> participating in cross-sector coordinating councils, as appropriate;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf273404a-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/4"><num value="4">(4)</num><chapeau> facilitating, in coordination with the Director, the sharing with the Department and other appropriate Federal department of information regarding physical security and cybersecurity threats within the designated sector or subsector of such sector, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf273404b-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/4/A"><num value="A">(A)</num><content> facilitating, in coordination with the Director, access to, and exchange of, information and intelligence necessary to strengthen the security of critical infrastructure, including through Information Sharing and Analysis Organizations and the national cybersecurity and communications integration center established pursuant to <ref href="/us/usc/t6/s659">section 659 of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf273404c-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/4/B"><num value="B">(B)</num><content> facilitating the identification of intelligence needs and priorities of critical infrastructure owners and operators in the designated sector or subsector of such sector, in coordination with the Director of National Intelligence and the heads of other Federal departments and agencies, as appropriate;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf273404d-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/4/C"><num value="C">(C)</num><content> providing the Director, and facilitating awareness within the designated sector or subsector of such sector, of ongoing, and where possible, real-time awareness of identified threats, vulnerabilities, mitigations, and other actions related to the security of such sector or subsector of such sector; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf273404e-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/4/D"><num value="D">(D)</num><content> supporting the reporting requirements of the Department under applicable law by providing, on an annual basis, sector-specific critical infrastructure information;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf273404f-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/5"><num value="5">(5)</num><chapeau> supporting incident management, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf2734050-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/5/A"><num value="A">(A)</num><content> supporting, in coordination with the Director, incident management and restoration efforts during or following a security incident; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf2734051-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/5/B"><num value="B">(B)</num><content> supporting the Director, upon request, in national cybersecurity asset response activities for critical infrastructure; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf2734052-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/6"><num value="6">(6)</num><chapeau> contributing to emergency preparedness efforts, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf2734053-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/6/A"><num value="A">(A)</num><content> coordinating with critical infrastructure owners and operators within the designated sector or subsector of such sector and the Director in the development of planning documents for coordinated action in the event of a natural disaster, act of terrorism, or other man-made disaster or emergency;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf2734054-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/6/B"><num value="B">(B)</num><content> participating in and, in coordination with the Director, conducting or facilitating, exercises and simulations of potential natural disasters, acts of terrorism, or other man-made disasters or emergencies within the designated sector or subsector of such sector; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf2734055-d96f-11ed-abb0-d425fd4ecaef" identifier="/us/usc/t6/s665d/c/6/C"><num value="C">(C)</num><content> supporting the Department and other Federal departments or agencies in developing planning documents or conducting exercises or simulations when relevant to the designated sector or subsector or such sector.</content>
