L. 110–53, title I, § 103, title IV, § 406, Aug. 3, 2007, 121 Stat. 293, 304.)","seq_in_title":363,"parent_identifier":"/us/usc/t6/ch2/schII/ptA","ancestors":[{"identifier":"/us/usc/t6","level":"title","num":"Title 6—","heading":"DOMESTIC SECURITY","status":null,"is_section":false},{"identifier":"/us/usc/t6/ch2","level":"chapter","num":"CHAPTER 2—","heading":"NATIONAL EMERGENCY MANAGEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t6/ch2/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"COMPREHENSIVE PREPAREDNESS SYSTEM","status":null,"is_section":false},{"identifier":"/us/usc/t6/ch2/schII/ptA","level":"part","num":"Part A—","heading":"National Preparedness System","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id1aedcf5c-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752\"><num value=\"752\">§ 752.</num><heading> Reporting requirements</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id1aedcf5d-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Federal preparedness report</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id1aedcf5e-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Not later than 12 months after <date date=\"2006-10-04\">October 4, 2006</date>, and annually thereafter, the Administrator, in coordination with the heads of appropriate Federal agencies, shall submit to the appropriate committees of Congress a report on the Nation’s level of preparedness for all hazards, including natural disasters, acts of terrorism, and other man-made disasters.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id1aedcf5f-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Contents</heading><chapeau>Each report shall include—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1aedcf60-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/a/2/A\"><num value=\"A\">(A)</num><content> an assessment of how Federal assistance supports the national preparedness system;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1aedcf61-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/a/2/B\"><num value=\"B\">(B)</num><content> the results of the comprehensive assessment carried out under <ref href=\"/us/usc/t6/s749\">section 749 of this title</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1aedcf62-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/a/2/C\"><num value=\"C\">(C)</num><content> a review of the inventory described in <ref href=\"/us/usc/t6/s751\">section 751 of this title</ref>, including the number and type of credentialed personnel in each category of personnel trained and ready to respond to a natural disaster, act of terrorism, or other man-made disaster;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1aedcf63-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/a/2/D\"><num value=\"D\">(D)</num><chapeau> an assessment of resource needs to meet preparedness priorities established under <ref href=\"/us/usc/t6/s746/e\">section 746(e) of this title</ref>, including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id1aedcf64-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/a/2/D/i\"><num value=\"i\">(i)</num><content> an estimate of the amount of Federal, State, local, and tribal expenditures required to attain the preparedness priorities; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id1aedcf65-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/a/2/D/ii\"><num value=\"ii\">(ii)</num><content> the extent to which the use of Federal assistance during the preceding fiscal year achieved the preparedness priorities;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1aedcf66-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/a/2/E\"><num value=\"E\">(E)</num><chapeau> an evaluation of the extent to which grants administered by the Department, including grants under title XX of the Homeland Security Act of 2002 [<ref href=\"/us/usc/t6/s601\">6 U.S.C. 601</ref> et seq.]—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id1aedcf67-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/a/2/E/i\"><num value=\"i\">(i)</num><content> have contributed to the progress of State, local, and tribal governments in achieving target capabilities; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id1aedcf68-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/a/2/E/ii\"><num value=\"ii\">(ii)</num><content> have led to the reduction of risk from natural disasters, acts of terrorism, or other man-made disasters nationally and in State, local, and tribal jurisdictions; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1aedcf69-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/a/2/F\"><num value=\"F\">(F)</num><chapeau> a discussion of whether the list of credentialed personnel of the Agency described in <ref href=\"/us/usc/t6/s751/b/2\">section 751(b)(2) of this title</ref>—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id1aedcf6a-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/a/2/F/i\"><num value=\"i\">(i)</num><content> complies with the strategic human capital plan developed under <ref href=\"/us/usc/t5/s10102\">section 10102 of title 5</ref>; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id1aedcf6b-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/a/2/F/ii\"><num value=\"ii\">(ii)</num><content> is sufficient to respond to a natural disaster, act of terrorism, or other man-made disaster, including a catastrophic incident.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id1aedcf6c-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Catastrophic resource report</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id1aedcf6d-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Administrator shall develop and submit to the appropriate committees of Congress annually an estimate of the resources of the Agency and other Federal agencies needed for and devoted specifically to developing the capabilities of Federal, State, local, and tribal governments necessary to respond to a catastrophic incident.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id1aedcf6e-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Contents</heading><chapeau>Each estimate under paragraph (1) shall include the resources both necessary for and devoted to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1aedcf6f-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/b/2/A\"><num value=\"A\">(A)</num><content> planning;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1aedcf70-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/b/2/B\"><num value=\"B\">(B)</num><content> training and exercises;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1aedcf71-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/b/2/C\"><num value=\"C\">(C)</num><content> Regional Office enhancements;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1aedcf72-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/b/2/D\"><num value=\"D\">(D)</num><content> staffing, including for surge capacity during a catastrophic incident;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1aedcf73-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/b/2/E\"><num value=\"E\">(E)</num><content> additional logistics capabilities;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1aedcf74-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/b/2/F\"><num value=\"F\">(F)</num><content> other responsibilities under the catastrophic incident annex and the catastrophic incident supplement of the National Response Plan;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1aedcf75-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/b/2/G\"><num value=\"G\">(G)</num><content> State, local, and tribal government catastrophic incident preparedness; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1aedcf76-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/b/2/H\"><num value=\"H\">(H)</num><content> covering increases in the fixed costs or expenses of the Agency, including rent or property acquisition costs or expenses, taxes, contributions to the working capital fund of the Department, and security costs for the year after the year in which such estimate is submitted.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id1aedcf77-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> State preparedness report</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id1aedcf78-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Not later than 15 months after <date date=\"2006-10-04\">October 4, 2006</date>, and annually thereafter, a State receiving Federal preparedness assistance administered by the Department shall submit a report to the Administrator on the State’s level of preparedness.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id1aedcf79-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Contents</heading><chapeau>Each report shall include—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1aedcf7a-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/c/2/A\"><num value=\"A\">(A)</num><content> an assessment of State compliance with the national preparedness system, National Incident Management System, National Response Plan, and other related plans and strategies;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1aedcf7b-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/c/2/B\"><num value=\"B\">(B)</num><content> an assessment of current capability levels and a description of target capability levels; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1aedcf7c-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/c/2/C\"><num value=\"C\">(C)</num><chapeau> a discussion of the extent to which target capabilities identified in the applicable State homeland security plan and other applicable plans remain unmet and an assessment of resources needed to meet the preparedness priorities established under <ref href=\"/us/usc/t6/s746/e\">section 746(e) of this title</ref>, including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id1aedcf7d-a3d3-11e9-be6e-e752deae1f00\" identifier=\"/us/usc/t6/s752/c/2/C/i\"><num value=\"i\">(i)</num><content> an estimate of the amount of expenditures required to attain the preparedness priorities;
