<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id9328f6e5-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722"><num value="1722">§ 1722.</num><heading> Provision of agricultural commodities</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id9328f6e6-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/a"><num value="a" class="bold">(a)</num><heading class="bold"> Emergency assistance</heading><content><p style="-uslm-lc:I11" class="indent0">Notwithstanding any other provision of law, the Administrator may provide agricultural commodities to meet emergency food needs under this subchapter through governments and public or private agencies, including intergovernmental organizations such as the World Food Program and other multilateral organizations, in such manner and on such terms and conditions as the Administrator determines appropriate to respond to the emergency.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id9328f6e7-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/b"><num value="b" class="bold">(b)</num><heading class="bold"> Nonemergency assistance</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id9328f6e8-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Administrator may provide agricultural commodities for nonemergency assistance under this subchapter through eligible organizations (as described in subsection (d)) that have entered into an agreement with the Administrator to use the commodities in accordance with this subchapter.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id9328f6e9-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Limitation</heading><chapeau>The Administrator may not use as a sole rationale for denying a request for funds submitted under this subsection because the program for which the funds are requested—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id9328f6ea-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/b/2/A"><num value="A">(A)</num><content> would be carried out by the eligible organization in a foreign country in which the Agency for International Development does not have a mission, office, or other presence; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id9328f6eb-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/b/2/B"><num value="B">(B)</num><content> is not part of a development plan for the country prepared by the Agency.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id9328f6ec-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Program diversity</heading><chapeau>The Administrator shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id9328f6ed-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/b/3/A"><num value="A">(A)</num><content> encourage eligible organizations to propose and implement program plans to address 1 or more aspects of the program under <ref href="/us/usc/t7/s1721">section 1721 of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id9328f6ee-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/b/3/B"><num value="B">(B)</num><content> consider proposals that incorporate a variety of program objectives and strategic plans based on the identification by eligible organizations of appropriate activities, consistent with <ref href="/us/usc/t7/s1721">section 1721 of this title</ref>, to assist development of foreign countries.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id9328f6ef-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/c"><num value="c" class="bold">(c)</num><heading class="bold"> Uses of assistance</heading><content><p style="-uslm-lc:I11" class="indent0">Agricultural commodities provided under this subchapter may be made available for direct distribution, sale, barter, or other appropriate disposition.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id9328f6f0-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/d"><num value="d" class="bold">(d)</num><heading class="bold"> Eligible organizations</heading><chapeau>To be eligible to receive assistance under subsection (b) an organization shall be—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id9328f6f1-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/d/1"><num value="1">(1)</num><content> a private voluntary organization or cooperative that is, to the extent practicable, registered with the Administrator; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9328f6f2-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/d/2"><num value="2">(2)</num><content> an intergovernmental organization, such as the World Food Program.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id9328f6f3-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/e"><num value="e" class="bold">(e)</num><heading class="bold"> Support for eligible organizations</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id9328f6f4-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau>Of the funds made available in each fiscal year under this subchapter to the Administrator, not less than 7.5 percent nor more than 20 percent of the funds shall be made available in each fiscal year to eligible organizations described in subsection (d), to assist the organizations in—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id9328f6f5-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/e/1/A"><num value="A">(A)</num><content> establishing and enhancing programs under this subchapter;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id9328f6f6-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/e/1/B"><num value="B">(B)</num><content> meeting specific administrative, management, personnel, transportation, storage, and distribution costs for carrying out programs in foreign countries under this subchapter;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id9328f6f7-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/e/1/C"><num value="C">(C)</num><content> implementing income-generating, community development, health, nutrition, cooperative development, agricultural, and other developmental activities within 1 or more recipient countries or within 1 or more countries in the same region; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id9328f6f8-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/e/1/D"><num value="D">(D)</num><content> improving and implementing methodologies for food aid programs, including needs assessments (upon the request of the Administrator), monitoring, and evaluation.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id9328f6f9-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Request for funds</heading><content><p style="-uslm-lc:I12" class="indent1">To receive funds made available under paragraph (1), an eligible organization described in subsection (d) shall submit a request for the funds that is subject to approval by the Administrator.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id9328f6fa-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/e/3"><num value="3" class="bold">(3)</num><heading class="bold"> Assistance with respect to sale</heading><content><p style="-uslm-lc:I12" class="indent1">Upon the request of an eligible organization, the Administrator may provide assistance to the eligible organization with respect to the sale of agricultural commodities made available to it under this subchapter.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id9328f6fb-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/e/4"><num value="4" class="bold">(4)</num><heading class="bold"> Investment authority</heading><content><p style="-uslm-lc:I12" class="indent1">An eligible organization that receives funds made available under paragraph (1) may invest the funds pending the eligible organization’s use of the funds. Any interest earned on such investment may be used for the purposes for which the assistance was provided to the eligible organization without further appropriation by Congress.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id9328f6fc-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/f"><num value="f" class="bold">(f)</num><heading class="bold"> Effective use of commodities</heading><chapeau>To ensure that agricultural commodities made available under this subchapter are used effectively and in the areas of greatest need, organizations or cooperatives through which such commodities are distributed shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id9328f6fd-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/f/1"><num value="1">(1)</num><content> to the extent feasible, work with indigenous institutions and employ indigenous workers;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9328f6fe-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/f/2"><num value="2">(2)</num><content> assess and take into account nutritional and other needs of beneficiary groups;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9328f6ff-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/f/3"><num value="3">(3)</num><content> help such beneficiary groups design and carry out mutually acceptable projects;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9328f700-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/f/4"><num value="4">(4)</num><content> recommend to the Administrator methods of making assistance available that are the most appropriate for each local setting;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9328f701-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/f/5"><num value="5">(5)</num><content> supervise the distribution of commodities provided and the implementation of programs carried out under this subchapter; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9328f702-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/f/6"><num value="6">(6)</num><content> periodically evaluate the effectiveness of projects undertaken under this subchapter.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id9328f703-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/g"><num value="g" class="bold">(g)</num><heading class="bold"> Labeling</heading><content><p style="-uslm-lc:I11" class="indent0">Commodities provided under this subchapter shall, to the extent practicable, be clearly identified with appropriate markings on the package or container of such commodity in the language of the locality in which such commodities are distributed, as being furnished by the people of the United States of America.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id9328f704-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/h"><num value="h" class="bold">(h)</num><heading class="bold"> Food aid quality</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id9328f705-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/h/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau>The Administrator shall use funds made available for fiscal year 2014 and subsequent fiscal years to carry out this subchapter—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id9328f706-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/h/1/A"><num value="A">(A)</num><content> to assess the types and quality of agricultural commodities and products donated for food aid;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id9328f707-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/h/1/B"><num value="B">(B)</num><content> to adjust products and formulations, including potential introduction of new fortificants and products, as necessary to cost-effectively meet nutrient needs of target populations;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id9328f708-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/h/1/C"><num value="C">(C)</num><content> to test prototypes;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id9328f709-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/h/1/D"><num value="D">(D)</num><content> to adopt new specifications or improve existing specifications for micronutrient fortified food aid products, based on the latest developments in food and nutrition science, and in coordination with other international partners;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id9328f70a-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/h/1/E"><num value="E">(E)</num><content> to develop new program guidance to facilitate improved matching of products to purposes having nutritional intent, in coordination with other international partners;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id9328f70b-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/h/1/F"><num value="F">(F)</num><content> to develop improved guidance for implementing partners on how to address nutritional deficiencies that emerge among recipients for whom food assistance is the sole source of diet in emergency programs that extend beyond 1 year, in coordination with other international partners; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id9328f70c-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/h/1/G"><num value="G">(G)</num><content> to evaluate, in appropriate settings and as necessary, the performance and cost-effectiveness of new or modified specialized food products and program approaches designed to meet the nutritional needs of the most vulnerable groups, such as pregnant and lactating mothers, and children under the age of 5.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id9328f70d-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/h/2"><num value="2" class="bold">(2)</num><heading class="bold"> Administration</heading><chapeau>The Administrator—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id9328f70e-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/h/2/A"><num value="A">(A)</num><content> shall carry out this subsection in consultation with and through independent entities with proven expertise in food aid commodity quality enhancements;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id9328f70f-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/h/2/B"><num value="B">(B)</num><content> may enter into contracts to obtain the services of such entities; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id9328f710-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s1722/h/2/C"><num value="C">(C)</num><content> shall consult with the Food Aid Consultative Group on how to carry out this subsection.</content>
</subparagraph>
