<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id6a76c3eb-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a"><num value="1726a">§ 1726a.</num><heading> Administration</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a76c3ec-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/a"><num value="a" class="bold">(a)</num><heading class="bold"> Proposals</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a76c3ed-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Recipient countries</heading><content><p style="-uslm-lc:I12" class="indent1">A proposal to enter into a nonemergency food assistance agreement under this subchapter shall identify the recipient country or countries that are the subject of the agreement.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a76c3ee-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Timing</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 120 days after the date of receipt by the Administrator of a proposal submitted by an eligible organization under this subchapter, the Administrator shall determine whether to accept the proposal.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a76c3ef-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Denial</heading><content><p style="-uslm-lc:I12" class="indent1">If a proposal under paragraph (1) is denied, the response shall specify the reasons for denial.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a76c3f0-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/b"><num value="b" class="bold">(b)</num><heading class="bold"> Notice and comment</heading><chapeau>Not later than 30 days prior to the issuance of a final guideline or annual policy guidance to carry out this subchapter, the Administrator shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6a76c3f1-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/b/1"><num value="1">(1)</num><content> provide notice of the existence of a proposed guideline or annual policy guidance, and that such guideline or annual policy guidance is available for review and comment, to eligible organizations that participate in programs under this subchapter, and to other interested persons;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6a76c3f2-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/b/2"><num value="2">(2)</num><content> make the proposed guideline or annual policy guidance available, on request, to the eligible organizations and other persons referred to in paragraph (1); and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6a76c3f3-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/b/3"><num value="3">(3)</num><content> take any comments received into consideration prior to the issuance of the final guideline or annual policy guidance.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a76c3f4-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/c"><num value="c" class="bold">(c)</num><heading class="bold"> Regulations and guidance</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a76c3f5-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Administrator shall promptly issue all necessary regulations and make revisions to agency guidelines with respect to changes in the operation or implementation of the program established under this subchapter. Not later than 270 days after the date of the enactment of the Agricultural Act of 2014, the Administrator shall issue all regulations and revisions to agency guidance necessary to implement the amendments made to this subchapter by such Act.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a76c3f6-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Requirements</heading><chapeau>The Administrator shall develop regulations and guidance with the intent of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6a76c3f7-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/c/2/A"><num value="A">(A)</num><content> simplifying procedures for participation in the programs established under this subchapter;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6a76c3f8-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/c/2/B"><num value="B">(B)</num><content> reducing paperwork requirements under such programs;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6a76c3f9-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/c/2/C"><num value="C">(C)</num><content> establishing reasonable and realistic accountability standards to be applied to eligible organizations participating in the programs established under this subchapter, taking into consideration the problems associated with carrying out programs in developing countries; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6a76c3fa-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/c/2/D"><num value="D">(D)</num><content> providing flexibility for carrying out programs under this subchapter.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a76c3fb-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/d"><num value="d" class="bold">(d)</num><heading class="bold"> Timely provision of commodities</heading><content><p style="-uslm-lc:I11" class="indent0">The Administrator, in consultation with the Secretary, shall develop procedures that ensure expedited processing of commodity call forwards in order to provide commodities overseas in a timely manner and to the extent feasible, according to planned delivery schedules.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a76c3fc-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/e"><num value="e" class="bold">(e)</num><heading class="bold"> Timely approval</heading><content><p style="-uslm-lc:I11" class="indent0">The Administrator is encouraged to finalize program agreements and resource requests for programs under this section before the beginning of each fiscal year.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a76c3fd-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/f"><num value="f" class="bold">(f)</num><heading class="bold"> Program oversight, monitoring, and evaluation</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a76c3fe-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> Duties of Administrator</heading><chapeau>The Administrator, in consultation with the Secretary, shall establish systems and carry out activities—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6a76c3ff-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/f/1/A"><num value="A">(A)</num><content> to determine the need for assistance provided under this subchapter; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6a76c400-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/f/1/B"><num value="B">(B)</num><content> to improve, monitor, and evaluate the effectiveness and efficiency of the assistance provided under this subchapter to maximize the impact of the assistance.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a76c401-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Requirements of systems and activities</heading><chapeau>The systems and activities described in paragraph (1) shall include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6a76c402-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/f/2/A"><num value="A">(A)</num><content> program monitors in countries that receive assistance under this subchapter;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6a76c403-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/f/2/B"><num value="B">(B)</num><content> country and regional food aid impact evaluations;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6a76c404-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/f/2/C"><num value="C">(C)</num><content> the identification and implementation of best practices for food aid programs;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6a76c405-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/f/2/D"><num value="D">(D)</num><content> the evaluation of monetization programs;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6a76c406-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/f/2/E"><num value="E">(E)</num><content> early warning assessments and systems to help prevent famines; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6a76c407-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/f/2/F"><num value="F">(F)</num><content> maintenance of information technology systems.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a76c408-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/f/3"><num value="3" class="bold">(3)</num><heading class="bold"> Contract authority</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a76c409-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/f/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Subject to subparagraphs (B) and (C), in carrying out administrative and management activities relating to each activity carried out by the Administrator under paragraph (1), the Administrator may enter into contracts with 1 or more individuals for personal service to be performed in recipient countries or neighboring countries.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a76c40a-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/f/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Prohibition</heading><content><p style="-uslm-lc:I13" class="indent2">An individual who enters into a contract with the Administrator under subparagraph (A) shall not be considered to be an employee of the Federal Government for the purpose of any law (including regulations) administered by the Office of Personnel Management.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a76c40b-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/f/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Personal service</heading><content><p style="-uslm-lc:I13" class="indent2">Subparagraph (A) does not limit the ability of the Administrator to enter into a contract with any individual for personal service under <ref href="/us/usc/t7/s1722/a">section 1722(a) of this title</ref>.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a76c40c-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/f/4"><num value="4" class="bold">(4)</num><heading class="bold"> Funding</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a76c40d-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/f/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Subject to <ref href="/us/usc/t7/s1722/h/3">section 1722(h)(3) of this title</ref>, in addition to other funds made available to the Administrator to carry out the monitoring of emergency food assistance, the Administrator may implement this subsection using up to $17,000,000 of the funds made available under this subchapter for each of fiscal years 2014 through 2018, except for paragraph (2)(F), for which not more than $500,000 shall be made available for each of the fiscal years 2014 through 2018.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a76c40e-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/f/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Limitations</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id6a76c40f-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1726a/f/4/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">Subject to clause (ii), of the funds made available under subparagraph (A), for each of fiscal years 2009 through 2018, not more than $8,000,000 may be used by the Administrator to carry out paragraph (2)(E).</p>
