L. 113–79, title III, § 3008, Feb. 7, 2014, 128 Stat. 775.)","seq_in_title":1096,"parent_identifier":"/us/usc/t7/ch41/schIV","ancestors":[{"identifier":"/us/usc/t7","level":"title","num":"Title 7—","heading":"AGRICULTURE","status":null,"is_section":false},{"identifier":"/us/usc/t7/ch41","level":"chapter","num":"CHAPTER 41—","heading":"FOOD FOR PEACE","status":null,"is_section":false},{"identifier":"/us/usc/t7/ch41/schIV","level":"subchapter","num":"SUBCHAPTER IV—","heading":"GENERAL AUTHORITIES AND REQUIREMENTS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"ide00a0457-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733\"><num value=\"1733\">§ 1733.</num><heading> General provisions</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide00a0458-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Prohibition</heading><chapeau>No agricultural commodity shall be made available under this chapter unless it is determined that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide00a0459-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/a/1\"><num value=\"1\">(1)</num><content> adequate storage facilities will be available in the recipient country at the time of the arrival of the commodity to prevent the spoilage or waste of the commodity; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide00a045a-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/a/2\"><num value=\"2\">(2)</num><content> the distribution of the commodity in the recipient country will not result in a substantial disincentive to or interference with domestic production or marketing in that country.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide00a045b-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Impact on local farmers and economy</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary or the Administrator, as appropriate, shall ensure that the importation of United States agricultural commodities and the use of local currencies for development purposes will not have a disruptive impact on the farmers or the local economy of the recipient country. The Secretary or the Administrator, as appropriate, shall seek information, as part of the regular proposal and submission process, from implementing agencies on the potential costs and benefits to the local economy of sales of agricultural commodities within the recipient country.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide00a045c-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Transshipment</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary or the Administrator, as appropriate, shall, under such terms and conditions as are determined to be appropriate, require commitments designed to prevent or restrict the resale or transshipment to other countries, or use for other than domestic purposes, of agricultural commodities donated or purchased under this chapter.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide00a045d-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Private trade channels and small business</heading><chapeau>Private trade channels shall be used under this chapter to the maximum extent practicable in the United States and in the recipient countries with respect to—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide00a045e-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/d/1\"><num value=\"1\">(1)</num><content> sales from privately owned stocks;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide00a045f-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/d/2\"><num value=\"2\">(2)</num><content> sales from stocks owned by the Commodity Credit Corporation; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide00a0460-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/d/3\"><num value=\"3\">(3)</num><content> donations.</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">Small businesses shall be provided adequate and fair opportunity to participate in such sales.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide00a0461-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> World prices</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide00a0462-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/e/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In carrying out this chapter, reasonable precautions shall be taken to assure that sales or donations of agricultural commodities will not unduly disrupt world prices for agricultural commodities or normal patterns of commercial trade with foreign countries.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide00a0463-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/e/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Sale price</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Sales of agricultural commodities described in paragraph (1) shall be made at a reasonable market price in the economy where the agricultural commodity is to be sold, as determined by the Secretary or the Administrator, as appropriate.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide00a0464-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Publicity</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Commitments shall be obtained from countries or private entities, as appropriate, receiving commodities under this chapter that such countries or private entities will widely publicize, to the extent practicable, through the use of the public media and through other means, that such commodities are being provided through the friendship of the American people as food for peace.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide00a0465-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Participation of private sector</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary or the Administrator, as appropriate, shall encourage the private sector of the United States and private importers in developing countries to participate in the programs established under this chapter.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide00a0466-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Safeguard usual marketings</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In carrying out this chapter, reasonable precautions shall be taken to safeguard the usual marketings of the United States and to avoid displacing any sales of the United States agricultural commodities that the Secretary or Administrator determines would otherwise be made.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide00a0467-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Military distribution of food aid</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide00a0468-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/i/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary or the Administrator, as appropriate, shall attempt to ensure that agricultural commodities made available under this chapter will be provided without regard to the political affiliation, geographic location, ethnic, tribal, or religious identity of the recipient or without regard to other extraneous factors.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide00a0469-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/i/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Prohibition on handling of commodities by the military</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ide00a046a-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/i/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Except as provided in subparagraph (B), the Secretary or the Administrator, as appropriate, shall not enter into an agreement under this chapter to provide agricultural commodities if such agreement requires or permits the distribution, handling, or allocation of such commodities by the military forces of any government or insurgent group.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ide00a046b-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/i/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Exception</heading><chapeau>Notwithstanding subparagraph (A), the Secretary or the Administrator, as appropriate, may authorize the handling or distribution of commodities by the military forces of a country in exceptional circumstances in which—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide00a046c-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/i/2/B/i\"><num value=\"i\">(i)</num><content> nonmilitary channels are not available for such handling or distribution;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide00a046d-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/i/2/B/ii\"><num value=\"ii\">(ii)</num><content> such action is consistent with the requirements of paragraph (1); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide00a046e-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/i/2/B/iii\"><num value=\"iii\">(iii)</num><content> the Secretary or the Administrator, as appropriate, determines that such action is necessary to meet the emergency health, safety, or nutritional requirements of the recipient population.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide00a046f-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/i/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Encouragement of safe passage</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">When entering into agreements under this chapter that involve areas within recipient countries that are experiencing protracted warfare or civil strife, the Secretary or the Administrator, as appropriate, shall, to the extent practicable, encourage all parties to the conflict to permit safe passage of the commodities and other relief supplies and to establish safe zones for medical and humanitarian treatment and evacuation of injured persons.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide00a0470-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/j\"><num value=\"j\" class=\"bold\">(j)</num><heading class=\"bold\"> Violations of human rights</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide00a0471-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/j/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Ineligible countries</heading><chapeau>The Secretary or the Administrator, as appropriate, shall not enter into any agreement under this chapter to provide agricultural commodities, or to finance the sale of agricultural commodities, to the government of any country determined by the President to engage in a consistent pattern of gross violations of internationally recognized human rights, including—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide00a0472-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/j/1/A\"><num value=\"A\">(A)</num><content> the torture or cruel, inhuman, or degrading treatment or punishment of individuals;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide00a0473-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/j/1/B\"><num value=\"B\">(B)</num><content> the prolonged detention of individuals without charges;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide00a0474-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/j/1/C\"><num value=\"C\">(C)</num><content> the responsibility for causing the disappearance of individuals through the abduction and clandestine detention of such individuals; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide00a0475-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/j/1/D\"><num value=\"D\">(D)</num><content> other flagrant denials of the right to life, liberty, and the security of persons.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide00a0476-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/j/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Waiver</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Paragraph (1) shall not prohibit the provision of assistance to such a country if the assistance is targeted to the most needy people in such country and is made available in such country through channels other than the government.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide00a0477-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/k\"><num value=\"k\" class=\"bold\">(k)</num><heading class=\"bold\"> Abortion prohibition</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Local currencies that are made available for use under this chapter may not be used to pay for the performance of abortions as a method of family planning or to motivate or coerce any person to practice abortions.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide00a0478-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/l\"><num value=\"l\" class=\"bold\">(l)</num><heading class=\"bold\"> Sale procedure</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide00a0479-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/l/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau>Subsections (b) and (h) shall apply to sales of commodities in recipient countries to generate proceeds to carry out projects under—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide00a047a-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/l/1/A\"><num value=\"A\">(A)</num><content> subchapters II and III;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide00a047b-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/l/1/B\"><num value=\"B\">(B)</num><content> <ref href=\"/us/usc/t7/s1431/b\">section 1431(b) of this title</ref>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide00a047c-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/l/1/C\"><num value=\"C\">(C)</num><content> the Food for Progress Act of 1985 (<ref href=\"/us/usc/t7/s1736\">7 U.S.C. 1736</ref><i>o</i>).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide00a047d-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/l/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Currency</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A sale described in paragraph (1) may be made in United States dollars or other currencies.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide00a047e-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/m\"><num value=\"m\" class=\"bold\">(m)</num><heading class=\"bold\"> Report on use of funds</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide00a047f-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/m/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Report required</heading><chapeau>Not later than 180 days after <date date=\"2014-02-07\">February 7, 2014</date>, and annually thereafter, the Administrator shall submit to Congress a report that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide00a0480-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/m/1/A\"><num value=\"A\">(A)</num><content> specifies the amount of funds (including funds for administrative costs, indirect cost recovery, internal transportation, storage, and handling, and associated distribution costs) provided to each eligible organization that received assistance under this chapter in the previous fiscal year;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide00a0481-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/m/1/B\"><num value=\"B\">(B)</num><content> describes how those funds were used by the eligible organization;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide00a0482-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/m/1/C\"><num value=\"C\">(C)</num><chapeau> describes the actual rate of return for each commodity made available under this chapter, including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide00a0483-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/m/1/C/i\"><num value=\"i\">(i)</num><content> factors that influenced the rate of return; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide00a0484-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/m/1/C/ii\"><num value=\"ii\">(ii)</num><content> for the commodity, the costs of bagging or further processing, ocean transportation, inland transportation in the recipient country, storage costs, and any other information that the Administrator determines to be necessary; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide00a0485-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/m/1/D\"><num value=\"D\">(D)</num><content> for each instance in which a commodity was made available under this chapter at a rate of return less than 70 percent, describes the reasons for the rate of return realized.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide00a0486-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/m/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Rate of return described</heading><chapeau>For purposes of applying paragraph (1)(C), the rate of return for a commodity shall be equal to the proportion that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide00a0487-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/m/2/A\"><num value=\"A\">(A)</num><content> the proceeds the implementing partners generate through monetization; bears to</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide00a0488-7a5c-11e4-980b-989095636810\" identifier=\"/us/usc/t7/s1733/m/2/B\"><num value=\"B\">(B)</num><content> the cost to the Federal Government to
