<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a7b7e82-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Invitation for bid</heading><content><p style="-uslm-lc:I12" class="indent1">No purchase of agricultural commodities from private stock or purchase of ocean transportation shall be financed under subchapter II unless such purchases are made on the basis of an invitation for bid that is publicly advertised in the United States, and on the basis of bid offerings that shall conform to such invitation and be received and publicly opened in the United States. All awards in the purchase of commodities or ocean transportation financed under subchapter II shall be consistent with open, competitive, and responsive bid procedures, as determined appropriate by the Secretary. Resulting contracts may contain such terms and conditions as the Secretary determines are necessary and appropriate.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a7b7e83-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/b"><num value="b" class="bold">(b)</num><heading class="bold"> Agents</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a7b7e84-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Authority of Secretary or Commodity Credit Corporation</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a7b7e85-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/b/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> General rule</heading><content><p style="-uslm-lc:I13" class="indent2">Except as provided in subparagraph (B), if it is determined appropriate, the Secretary or the Commodity Credit Corporation may serve as the purchasing or shipping agent, or both, for the importer or importing country in arranging the purchase or shipping of commodities financed under subchapter II.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a7b7e86-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/b/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Exception</heading><content><p style="-uslm-lc:I13" class="indent2">Notwithstanding subparagraph (A), the Secretary or the Commodity Credit Corporation may award, under a competitive bidding process, contracts for establishing freight agents who shall act on behalf of the Secretary or the Corporation to handle the shipping of commodities financed under this chapter.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a7b7e87-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/b/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Avoidance of conflict of interest of contractors</heading><content><p style="-uslm-lc:I13" class="indent2">Freight agents employed by the Secretary or the Commodity Credit Corporation under subchapter II shall not represent any foreign government during the period of their contract with the United States Government.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a7b7e88-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Reasonable fees and commissions</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a7b7e89-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/b/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Fees</heading><content><p style="-uslm-lc:I13" class="indent2">Notwithstanding any other provision of law, the Secretary or the Commodity Credit Corporation may enter into an agreement with the importer or importing country that contains the terms and conditions that will govern the provision of purchasing or shipping agent services by the Secretary or the Corporation, including the establishment of fees for such services. Any such fees shall be fair and reasonable in relation to the services performed and shall be available as reimbursement for costs incurred in providing such services.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a7b7e8a-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/b/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Prohibition on commissions</heading><content><p style="-uslm-lc:I13" class="indent2">Commissions, fees, or other payments to any selling agent or to any agent of a purchaser shall be prohibited in the purchase of agricultural commodities that are financed under subchapter II of this chapter.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a7b7e8b-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Limitations</heading><chapeau>No commission, fees, or other payments to an agent, broker, consultant, or other representative of the importer or importing country for ocean transportation brokerage services in connection with the carriage of commodities provided under subchapter II of this chapter may—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6a7b7e8c-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/b/3/A"><num value="A">(A)</num><content> be paid in excess of an amount determined appropriate by the Secretary; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6a7b7e8d-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/b/3/B"><num value="B">(B)</num><content> be shared by such person with the importer or importing country or any agent thereof.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a7b7e8e-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Avoidance of conflict of interest</heading><content><p style="-uslm-lc:I12" class="indent1">A person may not be an agent, broker, consultant, or other representative of the United States Government, an importer, or an importing country in connection with agricultural commodities provided under this chapter during a fiscal year in which such person provides or acts as an agent, broker, consultant, or other representative of a person engaged in providing ocean transportation or transportation-related services for such commodities. For the purpose of this paragraph, the term “transportation-related services” means lightening, stevedoring, bagging, or inland transportation to the destination point.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a7b7e8f-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/c"><num value="c" class="bold">(c)</num><heading class="bold"> Subchapters III and III–A program</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a7b7e90-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Acquisition</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a7b7e91-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/c/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The Administrator shall transfer, arrange for the transportation, and take other steps necessary to make available agricultural commodities to be provided under subchapter III and subchapter III–A.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a7b7e92-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/c/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Certain commodities made available for nonemergency assistance</heading><content><p style="-uslm-lc:I13" class="indent2">In the case of agricultural commodities made available for nonemergency assistance under subchapter III for least developed countries that meet the poverty and other eligibility criteria established by the International Bank for Reconstruction and Development for financing under the International Development Association, the Administrator may pay the transportation costs incurred in moving the agricultural commodities from designated points of entry or ports of entry abroad to storage and distribution sites and associated storage and distribution costs.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a7b7e93-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Freight procurement</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding chapters 1 to 11 of title 40 and division C (except sections 3302, 3307(e), 3501(b), 3509, 3906, 4710, and 4711) of subtitle I of title 41 or other similar provisions of law relating to the making or performance of Federal Government contracts, ocean transportation under subchapters III and III–A may be procured on the basis of full and open competitive procedures. Resulting contracts may contain such terms and conditions as the Administrator determines are necessary and appropriate.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a7b7e94-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Avoidance of conflict of interest</heading><content><p style="-uslm-lc:I12" class="indent1">Freight agents employed by the Agency for International Development under subchapters III and III–A shall not represent any foreign government during the period of their contract with the United States Government.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a7b7e95-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/c/4"><num value="4" class="bold">(4)</num><heading class="bold"> Prepositioning</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a7b7e96-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/c/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Funds made available for fiscal years 2001 through 2018 to carry out subchapters III and III-A may be used by the Administrator to procure, transport, and store agricultural commodities for prepositioning within the United States and in foreign countries, except that for each of fiscal years 2001 through 2013 not more than $10,000,000 of such funds and for each of fiscal years 2014 through 2018 not more than $15,000,000 of such funds may be used to store agricultural commodities for prepositioning in foreign countries.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a7b7e97-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/c/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Additional prepositioning sites</heading><content><p style="-uslm-lc:I13" class="indent2">The Administrator may establish additional sites for prepositioning in foreign countries or change the location of current sites for prepositioning in foreign countries after conducting, and based on the results of, assessments of need, the availability of appropriate technology for long-term storage, feasibility, and cost.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a7b7e98-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/c/5"><num value="5" class="bold">(5)</num><heading class="bold"> Nonemergency or multiyear agreements</heading><content><p style="-uslm-lc:I12" class="indent1">Annual resource requests for ongoing nonemergency or ongoing multiyear agreements under subchapter III shall be finalized not later than October 1 of the fiscal year in which the agricultural commodities will be shipped under the agreement.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a7b7e99-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/d"><num value="d" class="bold">(d)</num><heading class="bold"> Timing of shipments</heading><chapeau>In determining the timing of the shipment of agricultural commodities to be provided under this chapter, the Secretary or the Administrator, as appropriate, shall consider—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6a7b7e9a-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/d/1"><num value="1">(1)</num><content> the time of harvest of any competing commodities in the recipient country; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6a7b7e9b-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/d/2"><num value="2">(2)</num><content> such other concerns determined to be appropriate.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a7b7e9c-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/e"><num value="e" class="bold">(e)</num><heading class="bold"> Deadline for agreements under subchapters II and III–A</heading><chapeau>An agreement under subchapters II and III–A shall, to the extent practicable, be entered into not later than—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6a7b7e9d-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/e/1"><num value="1">(1)</num><content> November 30 of the first fiscal year in which agricultural commodities are to be shipped under the agreement; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6a7b7e9e-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/e/2"><num value="2">(2)</num><content> 60 days after the date of enactment of the annual Rural Development, Agriculture, and Related Agencies Appropriations Act for the first fiscal year in which agricultural commodities are to be shipped under the agreement,</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a7b7e9f-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/f"><num value="f" class="bold">(f)</num><heading class="bold"> Annual reports</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a7b7ea0-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> Annual report regarding food aid programs and activities</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a7b7ea1-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/f/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Annual report</heading><content><p style="-uslm-lc:I13" class="indent2">Not later than April 1 of each fiscal year, the Administrator and the Secretary shall jointly prepare and submit to the appropriate committees of Congress a report regarding each program and activity carried out under this chapter during the prior fiscal year.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a7b7ea2-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/f/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Contents</heading><chapeau>An annual report described in subparagraph (A) shall include, with respect to the prior fiscal year—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id6a7b7ea3-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/f/1/B/i"><num value="i">(i)</num><content> a list that contains a description of each country and organization that receives food and other assistance under this chapter (including the quantity of food and assistance provided to each country and organization);</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6a7b7ea4-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/f/1/B/ii"><num value="ii">(ii)</num><content> a general description of each project and activity implemented under this chapter (including each activity funded through the use of local currencies) and the total number of beneficiaries of the project and the activities carried out through such project;</content>

<clause style="-uslm-lc:I14" class="indent3" id="id6a7b7ea5-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/f/1/B/iii"><num value="iii">(iii)</num><chapeau> a statement describing the quantity of agricultural commodities made available to, and the total number of beneficiaries in, each country pursuant to—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id6a7b7ea6-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/f/1/B/iii/I"><num value="I">(I)</num><content> <ref href="/us/usc/t7/s1431/b">section 1431(b) of this title</ref>;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id6a7b7ea7-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/f/1/B/iii/II"><num value="II">(II)</num><content> the Food for Progress Act of 1985 (<ref href="/us/usc/t7/s1736">7 U.S.C. 1736</ref><i>o</i>); and</content>

<clause style="-uslm-lc:I14" class="indent3" id="id6a7b7ea9-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/f/1/B/iv"><num value="iv">(iv)</num><content> an assessment of the progress made through programs under this chapter towards reducing food insecurity in the populations receiving food assistance from the United States;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6a7b7eaa-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/f/1/B/v"><num value="v">(v)</num><content> a description of efforts undertaken by the Food Aid Consultative Group under <ref href="/us/usc/t7/s1725">section 1725 of this title</ref> to achieve an integrated and effective food assistance program;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6a7b7eab-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/f/1/B/vi"><num value="vi">(vi)</num><chapeau> an assessment of—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id6a7b7eac-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/f/1/B/vi/I"><num value="I">(I)</num><content> each program oversight, monitoring, and evaluation system implemented under <ref href="/us/usc/t7/s1726a/f">section 1726a(f) of this title</ref>; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id6a7b7ead-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/f/1/B/vi/II"><num value="II">(II)</num><content> the impact of each program oversight, monitoring, and evaluation system on the effectiveness and efficiency of assistance provided under this subchapter; and</content>

<clause style="-uslm-lc:I14" class="indent3" id="id6a7b7eae-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/f/1/B/vii"><num value="vii">(vii)</num><content> an assessment of the progress made by the Administrator in addressing issues relating to quality with respect to the provision of food assistance.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a7b7eaf-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Annual report regarding the provision of agricultural commodities to foreign countries</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a7b7eb0-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1736a/f/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Annual report</heading><content><p style="-uslm-lc:I13" class="indent2">Not later than February 1 of each fiscal year, the Administrator shall prepare and submit to the appropriate committees of Congress a report regarding the administration of food assistance programs under subchapter III to benefit foreign countries during the prior fiscal year.</p>
