<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idbdcc7818-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s1736e"><num value="1736e">§ 1736e.</num><heading> Debt forgiveness</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idbdcc7819-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s1736e/a"><num value="a" class="bold">(a)</num><heading class="bold"> Authority</heading><chapeau>The President, taking into account the financial resources of a country, may waive payments of principal and interest that such country would otherwise be required to make to the Commodity Credit Corporation under dollar sales agreements under subchapter II of this chapter if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idbdcc781a-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s1736e/a/1"><num value="1">(1)</num><content> that country is a least developed country; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbdcc781b-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s1736e/a/2"><num value="2">(2)</num><chapeau> either—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idbdcc781c-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s1736e/a/2/A"><num value="A">(A)</num><content> an International Monetary Fund standby agreement is in effect with respect to that country;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbdcc781d-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s1736e/a/2/B"><num value="B">(B)</num><content> a structural adjustment program of the International Bank for Reconstruction and Development or of the International Development Association is in effect with respect to that country;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbdcc781e-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s1736e/a/2/C"><num value="C">(C)</num><content> a structural adjustment facility, enhanced structural adjustment facility, or similar supervised arrangement with the International Monetary Fund is in effect with respect to that country; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbdcc781f-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s1736e/a/2/D"><num value="D">(D)</num><content> even though such an agreement, program, facility, or arrangement is not in effect, the country is pursuing national economic policy reforms that would promote democratic, market-oriented, and long term economic development.</content>
</subparagraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idbdcc7820-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s1736e/b"><num value="b" class="bold">(b)</num><heading class="bold"> Request for debt relief by President</heading><chapeau>The President may provide debt relief under subsection (a) of this section only if a notification is submitted to Congress at least 10 days prior to providing the debt relief. Such a notification shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idbdcc7821-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s1736e/b/1"><num value="1">(1)</num><content> specify the amount of official debt the President proposes to liquidate; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbdcc7822-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s1736e/b/2"><num value="2">(2)</num><content> identify the countries for which debt relief is proposed and the basis for their eligibility for such relief.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idbdcc7823-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s1736e/c"><num value="c" class="bold">(c)</num><heading class="bold"> Appropriations action required</heading><content><p style="-uslm-lc:I11" class="indent0">The aggregate amount of principal and interest waived under this section may not exceed the amount approved for such purpose in an Act appropriating funds to carry out this chapter.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idbdcc7824-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s1736e/d"><num value="d" class="bold">(d)</num><heading class="bold"> Limitation on new credit assistance</heading><content><p style="-uslm-lc:I11" class="indent0">If the authority of this section is used to waive payments otherwise required to be made by a country pursuant to this chapter, the President may not provide any new credit assistance for that country under this chapter during the 2-year period beginning on the date such waiver authority is exercised, unless the President provides to the Congress, before the assistance is provided, a written justification for the provision of such new credit assistance.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idbdcc7825-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s1736e/e"><num value="e" class="bold">(e)</num><heading class="bold"> Applicability</heading><content><p style="-uslm-lc:I11" class="indent0">The authority of this section applies with respect to credit sales agreements entered into before <date date="1990-11-28">November 28, 1990</date>.</p>
