<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id3513d66a-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1738b"><num value="1738b">§ 1738b.</num><heading> Eligibility for benefits under Facility</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id3513d66b-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1738b/a"><num value="a" class="bold">(a)</num><heading class="bold"> Requirements</heading><chapeau style="-uslm-lc:I11" class="indent0">To be eligible for benefits from the Facility under this subchapter, a country shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3513d66c-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1738b/a/1"><num value="1">(1)</num><content> be a Latin American or Caribbean country;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3513d66d-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1738b/a/2"><num value="2">(2)</num><chapeau> have in effect or have received approval for, or, as appropriate in exceptional circumstances, be making significant progress towards the establishment of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3513d66e-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1738b/a/2/A"><num value="A">(A)</num><content> an International Monetary Fund (hereafter referred to in this subchapter as the “IMF”) standby arrangement, extended IMF arrangement, or an arrangement under the structural adjustment facility or enhanced structural adjustment facility, or in exceptional circumstances, an IMF-monitored program or its equivalent; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3513d66f-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1738b/a/2/B"><num value="B">(B)</num><content> as appropriate, structural or sectoral adjustment loans from the International Bank for Reconstruction and Development (hereafter referred to in this subchapter as the “World Bank”) or the International Development Association (hereafter referred to in this subchapter as the “IDA”);</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3513d670-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1738b/a/3"><num value="3">(3)</num><content> have placed into effect major investment reforms in conjunction with an Inter-American Development Bank (hereafter referred to as the “IDB”) loan or otherwise be implementing, or making significant progress towards an open investment regime; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3513d671-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1738b/a/4"><num value="4">(4)</num><content> if appropriate, have agreed with its commercial bank lenders on a satisfactory financing program, including, as appropriate, debt or debt service reduction.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id3513d672-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1738b/b"><num value="b" class="bold">(b)</num><heading class="bold"> Eligibility determination</heading><content><p style="-uslm-lc:I11" class="indent0">The President shall determine whether a country is an eligible country for purposes of subsection (a).</p>
