<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id6a803ad3-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1738f"><num value="1738f">§ 1738f.</num><heading> Environmental framework agreements</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a803ad4-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1738f/a"><num value="a" class="bold">(a)</num><heading class="bold"> Authority</heading><content><p style="-uslm-lc:I11" class="indent0">The President is authorized to enter into an environmental framework agreement with each country eligible for benefits from the Facility concerning the operation and use of an Enterprise for the Americas Environmental Fund (hereafter referred to in this subchapter as the “Environmental Fund”) established under <ref href="/us/usc/t7/s1738g">section 1738g of this title</ref> for that country. The President shall consult with the Board established under <ref href="/us/usc/t7/s1738i">section 1738i of this title</ref> when entering into such agreements.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a803ad5-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1738f/b"><num value="b" class="bold">(b)</num><heading class="bold"> Requirements</heading><chapeau>An environmental framework agreement entered into under this section shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6a803ad6-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1738f/b/1"><num value="1">(1)</num><content> require the eligible country to establish an Environmental Fund;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6a803ad7-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1738f/b/2"><num value="2">(2)</num><content> require the eligible country to make interest payments under <ref href="/us/usc/t7/s1738g/a">section 1738g(a) of this title</ref> into the Environmental Fund;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6a803ad8-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1738f/b/3"><num value="3">(3)</num><content> require the eligible country to make prompt disbursements from the Environmental Fund to the body described in subsection (c);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6a803ad9-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1738f/b/4"><num value="4">(4)</num><content> where appropriate, seek to maintain the value of the local currency resources deposited into the appropriate Environmental Fund in terms of United States dollars;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6a803ada-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1738f/b/5"><num value="5">(5)</num><content> specify, in accordance with <ref href="/us/usc/t7/s1738k">section 1738k of this title</ref>, the purposes for which the Environmental Fund may be used; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6a803adb-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1738f/b/6"><num value="6">(6)</num><content> contain reasonable provisions for the enforcement of the terms of the agreement.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a803adc-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1738f/c"><num value="c" class="bold">(c)</num><heading class="bold"> Administering body</heading><chapeau>Funds disbursed from the Environmental Fund in an eligible country shall be administered by a body constituted under the laws of the country. Such body shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6a803add-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1738f/c/1"><num value="1">(1)</num><chapeau> be composed of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6a803ade-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1738f/c/1/A"><num value="A">(A)</num><content> one or more representatives appointed by the President;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6a803adf-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1738f/c/1/B"><num value="B">(B)</num><content> one or more representatives appointed by the eligible country; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6a803ae0-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1738f/c/1/C"><num value="C">(C)</num><content> representatives from a broad range of environmental and local community development nongovernmental organizations of the host country;</content>
</subparagraph>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">the majority of which shall be local representatives from nongovernmental organizations, and scientific or academic bodies;</continuation>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6a803ae1-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1738f/c/2"><num value="2">(2)</num><content> receive proposals for grant assistance from local organizations, and make grants to such organizations in accordance with the priorities agreed upon in the framework agreement and consistent with the overall purposes of <ref href="/us/usc/t7/s1738k">section 1738k of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6a803ae2-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1738f/c/3"><num value="3">(3)</num><content> be responsible for the management of the program and oversight of grant activities funded from resources of the Environmental Fund;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6a803ae3-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1738f/c/4"><num value="4">(4)</num><content> be subject to fiscal audits by an independent auditor on an annual basis;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id6a803ae4-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1738f/c/5"><num value="5">(5)</num><content> present an annual program for review by the Board established under <ref href="/us/usc/t7/s1738i">section 1738i of this title</ref> each year;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6a803ae5-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1738f/c/6"><num value="6">(6)</num><content> present an annual report on the activities undertaken during the previous year to the Chairman of the Board established under <ref href="/us/usc/t7/s1738i">section 1738i of this title</ref>, and the government of the eligible country each year; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6a803ae6-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1738f/c/7"><num value="7">(7)</num><content> have any grant over $100,000 be subject to veto by the United States and the government of the eligible country.</content>
