<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id6a8c20ca-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a"><num value="1926a">§ 1926a.</num><heading> Emergency and imminent community water assistance grant program</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a8c20cb-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau>The Secretary shall provide grants in accordance with this section to assist the residents of rural areas and small communities to secure adequate quantities of safe water—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6a8c20cc-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/a/1"><num value="1">(1)</num><content> after a significant decline in the quantity or quality of water available from the water supplies of such rural areas and small communities, or when such a decline is imminent; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6a8c20cd-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/a/2"><num value="2">(2)</num><chapeau> when repairs, partial replacement, or significant maintenance efforts on established water systems would remedy—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6a8c20ce-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/a/2/A"><num value="A">(A)</num><content> an acute, or imminent, shortage of quality water; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6a8c20cf-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/a/2/B"><num value="B">(B)</num><content> a significant decline, or imminent decline, in the quantity or quality of water that is available.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a8c20d0-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/b"><num value="b" class="bold">(b)</num><heading class="bold"> Priority</heading><chapeau>In carrying out subsection (a), the Secretary shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6a8c20d1-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/b/1"><num value="1">(1)</num><content> give priority to projects described in subsection (a)(1); and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6a8c20d2-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/b/2"><num value="2">(2)</num><content> provide at least 70 percent of all such grants to such projects.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a8c20d3-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/c"><num value="c" class="bold">(c)</num><heading class="bold"> Eligibility</heading><chapeau>To be eligible to obtain a grant under this section, an applicant shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6a8c20d4-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/c/1"><num value="1">(1)</num><content> be a public or private nonprofit entity; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6a8c20d5-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/c/2"><num value="2">(2)</num><content> in the case of a grant made under subsection (a)(1), demonstrate to the Secretary that the decline referred to in such subsection occurred, or will occur, within 2 years of the date the application was filed for such grant.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a8c20d6-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/d"><num value="d" class="bold">(d)</num><heading class="bold"> Uses</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a8c20d7-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau>Grants made under this section may be used—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6a8c20d8-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/d/1/A"><num value="A">(A)</num><content> for waterline extensions from existing systems, laying of new waterlines, repairs, significant maintenance, digging of new wells, equipment replacement, and hook and tap fees;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6a8c20d9-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/d/1/B"><num value="B">(B)</num><content> for any other appropriate purpose associated with developing sources of, treating, storing, or distributing water;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6a8c20da-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/d/1/C"><num value="C">(C)</num><content> to assist communities in complying with the requirements of the Federal Water Pollution Control Act (<ref href="/us/usc/t33/s1251">33 U.S.C. 1251</ref> et seq.) or the Safe Drinking Water Act (<ref href="/us/usc/t42/s300f">42 U.S.C. 300f</ref> et seq.); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6a8c20db-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/d/1/D"><num value="D">(D)</num><content> to provide potable water to communities through other means.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a8c20dc-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Joint proposals</heading><content><p style="-uslm-lc:I12" class="indent1">Nothing in this section shall preclude rural communities from submitting joint proposals for emergency water assistance, subject to the restrictions contained in subsection (e). Such restrictions should be considered in the aggregate, depending on the number of communities involved.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a8c20dd-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/e"><num value="e" class="bold">(e)</num><heading class="bold"> Restrictions</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a8c20de-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> Maximum population and income</heading><chapeau>No grant provided under this section shall be used to assist any rural area or community that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6a8c20df-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/e/1/A"><num value="A">(A)</num><content> includes any area in any city or town with a population in excess of 10,000 inhabitants according to the most recent decennial census of the United States; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6a8c20e0-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/e/1/B"><num value="B">(B)</num><content> has a median household income in excess of the State nonmetropolitan median household income according to the most recent decennial census of the United States.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a8c20e1-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Set-aside for smaller communities</heading><content><p style="-uslm-lc:I12" class="indent1">Not less than 50 percent of the funds allocated under this section shall be allocated to rural communities with populations that do not exceed 3,000 inhabitants.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a8c20e2-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/f"><num value="f" class="bold">(f)</num><heading class="bold"> Maximum grants</heading><chapeau>Grants made under this section may not exceed—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6a8c20e3-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/f/1"><num value="1">(1)</num><content> in the case of each grant made under subsection (a)(1), $500,000; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6a8c20e4-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/f/2"><num value="2">(2)</num><content> in the case of each grant made under subsection (a)(2), $150,000.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a8c20e5-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/g"><num value="g" class="bold">(g)</num><heading class="bold"> Full funding</heading><content><p style="-uslm-lc:I11" class="indent0">Subject to subsection (e), grants under this section shall be made in an amount equal to 100 percent of the costs of the projects conducted under this section.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a8c20e6-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/h"><num value="h" class="bold">(h)</num><heading class="bold"> Application</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a8c20e7-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/h/1"><num value="1" class="bold">(1)</num><heading class="bold"> Nationally competitive application process</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall develop a nationally competitive application process to award grants under this section. The process shall include criteria for evaluating applications, including population, median household income, and the severity of the decline, or imminent decline, in quantity or quality of water.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a8c20e8-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/h/2"><num value="2" class="bold">(2)</num><heading class="bold"> Timing of review of applications</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a8c20e9-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/h/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Simplified application</heading><content><p style="-uslm-lc:I13" class="indent2">The application process developed by the Secretary under paragraph (1) shall include a simplified application form that will permit expedited consideration of an application for a grant filed under this section.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a8c20ea-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/h/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Priority review</heading><content><p style="-uslm-lc:I13" class="indent2">In processing applications for any water or waste grant or loan authorized under this chapter, the Secretary shall afford priority processing to an application for a grant under this section to the extent funds will be available for an award on the application at the conclusion of priority processing.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a8c20eb-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/h/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Timing</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall, to the maximum extent practicable, review and act on an application under this section within 60 days after the date on which the application is submitted to the Secretary.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6a8c20ec-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/i"><num value="i" class="bold">(i)</num><heading class="bold"> Funding</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6a8c20ed-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/i/1"><num value="1" class="bold">(1)</num><heading class="bold"> Reservation</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a8c20ee-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/i/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">For each fiscal year, not less than 3 nor more than 5 percent of the total amount made available to carry out <ref href="/us/usc/t7/s1926/a/2">section 1926(a)(2) of this title</ref> for the fiscal year shall be reserved for grants under this section.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6a8c20ef-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s1926a/i/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Release</heading><content><p style="-uslm-lc:I13" class="indent2">Funds reserved under subparagraph (A) for a fiscal year shall be reserved only until July 1 of the fiscal year.</p>

<paragraph style="-uslm-lc:I21" class="indent0"><num value="1">“(1)</num><heading> <inline class="small-caps">Regulations</inline>.—</heading><chapeau>The Secretary of Agriculture shall publish—</chapeau><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">“(A)</num><content> interim final regulations to carry out section 306A of the Consolidated Farm and Rural Development Act [<ref href="/us/usc/t7/s1926a">7 U.S.C. 1926a</ref>] (as added by subsection (a) of this section) not later than 45 days after the date of enactment of this Act [<date date="1989-08-14">Aug. 14, 1989</date>]; and</content>

<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><content> final regulations to carry out section 306A of such Act not later than 90 days after the date of enactment of this Act.</content>

<paragraph style="-uslm-lc:I21" class="indent0"><num value="2">“(2)</num><heading> Funds.—</heading><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">“(A)</num><heading> <inline class="small-caps">Obligation</inline>.—</heading><content>The Secretary shall designate 70 percent of the funds made available for the first fiscal year for which appropriations are made under section 306A(i) of the Consolidated Farm and Rural Development Act not later than 5 months after the date such funds are appropriated.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><heading> <inline class="small-caps">Release</inline>.—</heading><content>The Secretary may release funds prior to the issuance of final regulations under paragraph (1)(B) for grants under section 306A(a)(1) of the Consolidated Farm and Rural Development Act.”</content>
