<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id35222e1e-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c"><num value="1926c">§ 1926c.</num><heading> Water and waste facility loans and grants to alleviate health risks</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id35222e1f-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/a"><num value="a" class="bold">(a)</num><heading class="bold"> Loans and grants to persons other than individuals</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id35222e20-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary shall make or insure loans and make grants to rural water supply corporations, cooperatives, or similar entities, Indian tribes on Federal and State reservations and other federally recognized Indian tribes, and public agencies, to provide for the conservation, development, use, and control of water (including the extension or improvement of existing water supply systems), and the installation or improvement of drainage or waste disposal facilities and essential community facilities including necessary related equipment. Such loans and grants shall be available only to provide such water and waste facilities and services to communities whose residents face significant health risks, as determined by the Secretary, due to the fact that a significant proportion of the community’s residents do not have access to, or are not served by, adequate affordable—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id35222e21-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/a/1/A"><num value="A">(A)</num><content> water supply systems; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id35222e22-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/a/1/B"><num value="B">(B)</num><content> waste disposal facilities.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id35222e23-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Certain areas targeted</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id35222e24-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/a/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">Loans and grants under paragraph (1) shall be made only if the loan or grant funds will be used primarily to provide water or waste services, or both, to residents of a county—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id35222e25-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/a/2/A/i"><num value="i">(i)</num><content> the per capita income of the residents of which is not more than 70 percent of the national average per capita income, as determined by the Department of Commerce; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id35222e26-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/a/2/A/ii"><num value="ii">(ii)</num><content> the unemployment rate of the residents of which is not less than 125 percent of the national average unemployment rate, as determined by the Bureau of Labor Statistics.</content>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id35222e27-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/a/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Exception</heading><content><p style="-uslm-lc:I13" class="indent2">Notwithstanding subparagraph (A), loans and grants under paragraph (1) may also be made if the loan or grant funds will be used primarily to provide water or waste services, or both, to residents of a rural area that was recognized as a colonia as of <date date="1989-10-01">October 1, 1989</date>.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id35222e28-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/b"><num value="b" class="bold">(b)</num><heading class="bold"> Loans and grants to individuals</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id35222e29-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall make or insure loans and make grants to individuals who reside in a community described in subsection (a)(1) for the purpose of extending water supply and waste disposal systems, connecting the systems to the residences of the individuals, or installing plumbing and fixtures within the residences of the individuals to facilitate the use of the water supply and waste disposal systems. Such loans shall be at a rate of interest no greater than the Federal Financing Bank rate on loans of a similar term at the time such loans are made. The repayment of such loans shall be amortized over the expected life of the water supply or waste disposal system to which the residence of the borrower will be connected.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id35222e2a-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Manner in which loans and grants are to be made</heading><chapeau style="-uslm-lc:I12" class="indent1">Loans and grants to individuals under paragraph (1) shall be made—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id35222e2b-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/b/2/A"><num value="A">(A)</num><content> directly to such individuals by the Secretary; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id35222e2c-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/b/2/B"><num value="B">(B)</num><content> to such individuals through the rural water supply corporation, cooperative, or similar entity, or public agency, providing such water supply or waste disposal services, pursuant to regulations issued by the Secretary.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id35222e2d-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/c"><num value="c" class="bold">(c)</num><heading class="bold"> Preference</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary shall give preference in the awarding of loans and grants—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id35222e2e-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/c/1"><num value="1">(1)</num><content> under subsection (a) to rural water supply corporations, cooperatives, or similar entities, or public agencies, that propose to provide water supply or waste disposal services to the residents of those rural subdivisions commonly referred to as colonias, that are characterized by substandard housing, inadequate roads and drainage, and a lack of adequate water or waste facilities; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id35222e2f-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/c/2"><num value="2">(2)</num><content> under subsection (b) to individuals who reside in a rural subdivision commonly referred to as a colonia, that is characterized by substandard housing, inadequate roads and drainage, and a lack of adequate water or waste facilities.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id35222e30-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/d"><num value="d" class="bold">(d)</num><heading class="bold"> “Cooperative” defined</heading><content><p style="-uslm-lc:I11" class="indent0">For purposes of this section, the term “cooperative” means a cooperative formed specifically for the purpose of the installation, expansion, improvement, or operation of water supply or waste disposal facilities or systems.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id35222e31-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/e"><num value="e" class="bold">(e)</num><heading class="bold"> Authorization of appropriations</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id35222e32-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Subject to paragraph (2), there are authorized to be appropriated—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id35222e33-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/e/1/A"><num value="A">(A)</num><content> for grants under this section, $30,000,000 for each fiscal year;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id35222e34-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/e/1/B"><num value="B">(B)</num><content> for loans under this section, $30,000,000 for each fiscal year; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id35222e35-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/e/1/C"><num value="C">(C)</num><content> in addition to grants provided under subparagraph (A), for grants under this section to benefit Indian tribes (as defined in <ref href="/us/usc/t25/s5304">section 5304 of title 25</ref>), $20,000,000 for each fiscal year.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id35222e36-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Exception</heading><content><p style="-uslm-lc:I12" class="indent1">An entity eligible to receive funding through a grant made under <ref href="/us/usc/t7/s1926d">section 1926d of this title</ref> shall not be eligible for a grant from funds made available under paragraph (1)(C).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id35222e37-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s1926c/f"><num value="f" class="bold">(f)</num><heading class="bold"> Regulations</heading><content><p style="-uslm-lc:I11" class="indent0">Not later than 30 days after <date date="1992-10-28">October 28, 1992</date>, the Secretary shall issue interim final regulations, with a request for public comments, implementing this section.</p>
