<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" id="id912d4d7e-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932"><num value="1932">§ 1932.</num><heading> Assistance for rural entities</heading><subsection class="indent0" id="id912d4d7f-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/a"><num value="a">(a)</num><heading> Loans to private business enterprises</heading><paragraph class="indent1" id="id912d4d80-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/a/1"><num value="1">(1)</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I12" class="blockIndent1">In this subsection:</chapeau><subparagraph class="indent2" id="id912d4d81-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/a/1/A"><num value="A">(A)</num><heading> Aquaculture</heading><content><p style="-uslm-lc:I13" class="indent2">The term “aquaculture” means the culture or husbandry of aquatic animals or plants by private industry for commercial purposes including the culture and growing of fish by private industry for the purpose of creating or augmenting publicly owned and regulated stocks of fish.</p>
</content>
</subparagraph>
<subparagraph class="indent2" id="id912d4d82-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/a/1/B"><num value="B">(B)</num><heading> Solar energy</heading><content><p style="-uslm-lc:I13" class="indent2">The term “solar energy” means energy derived from sources (other than fossil fuels) and technologies included in the Federal Nonnuclear Energy Research and Development Act of 1974, as amended [<ref href="/us/usc/t42/s5901">42 U.S.C. 5901</ref> et seq.].</p>
</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id912d7493-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/a/2"><num value="2">(2)</num><heading> Loan purposes</heading>
<chapeau style="-uslm-lc:I12" class="blockIndent1">The Secretary may make and insure loans to public, private, or cooperative organizations organized for profit or nonprofit and private investment funds that invest primarily in cooperative organizations, to Indian tribes on Federal and State reservations or other federally recognized Indian tribal groups, or to individuals for the purposes of—</chapeau><subparagraph class="indent2" id="id912d7494-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/a/2/A"><num value="A">(A)</num><content> improving, developing, or financing business, industry, and employment and improving the economic and environmental climate in rural communities, including pollution abatement and control;</content>
</subparagraph>
<subparagraph class="indent2" id="id912d7495-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/a/2/B"><num value="B">(B)</num><content> the conservation, development, and use of water for aquaculture purposes in rural areas;</content>
</subparagraph>
<subparagraph class="indent2" id="id912d7496-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/a/2/C"><num value="C">(C)</num><content> reducing the reliance on nonrenewable energy resources by encouraging the development and construction of solar energy systems and other renewable energy systems (including wind energy systems and anaerobic digestors for the purpose of energy generation), including the modification of existing systems, in rural areas; and</content>
</subparagraph>
<subparagraph class="indent2" id="id912d9ba7-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/a/2/D"><num value="D">(D)</num><content> to facilitate economic opportunity for industries undergoing adjustment from terminated Federal agricultural price and income support programs or increased competition from foreign trade.</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id912d9ba8-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/a/3"><num value="3">(3)</num><heading> Loan guarantees</heading><content><p style="-uslm-lc:I12" class="indent1">Loans described in paragraph (2), when originated, held, and serviced by other lenders, may be guaranteed by the Secretary under this section without regard to paragraphs (1) and (4) of <ref href="/us/usc/t7/s1983">section 1983 of this title</ref>.</p>
</content>
</paragraph>
<paragraph class="indent1" id="id912d9ba9-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/a/4"><num value="4">(4)</num><heading> Maximum amount of principal</heading><content><p style="-uslm-lc:I12" class="indent1">No loan may be made, insured, or guaranteed under this subsection that exceeds $25,000,000 in principal amount.</p>

</paragraph>
</subsection>
<subsection class="indent0" id="id912d9baa-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/b"><num value="b">(b)</num><heading> Solid waste management grants</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary may make grants to nonprofit organizations for the provision of regional technical assistance to local and regional governments and related agencies for the purpose of reducing or eliminating pollution of water resources and improving the planning and management of solid waste disposal facilities. Grants made under this paragraph for the provision of technical assistance shall be made for 100 percent of the cost of such assistance.</p>
</content>
</subsection>
<subsection class="indent0" id="id912dc2bb-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/c"><num value="c">(c)</num><heading> Rural business enterprise grants</heading><paragraph class="indent1" id="id912dc2bc-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/c/1"><num value="1">(1)</num><heading> Grants</heading><subparagraph class="indent2" id="id912dc2bd-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/c/1/A"><num value="A">(A)</num><heading> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary may also make grants, not to exceed $50,000,000 annually, to public bodies and private nonprofit corporations for measures designed to finance and facilitate development of small and emerging private business enterprises (including nonprofit entities) or the creation, expansion, and operation of rural distance learning networks or rural learning programs that provide educational instruction or job training instruction related to potential employment or job advancement to adult students, including the development, construction or acquisition of land, buildings, plants, equipment, access streets and roads, parking areas, utility extensions, necessary water supply and waste disposal facilities, refinancing, services and fees.</p>
</content>
</subparagraph>
<subparagraph class="indent2" id="id912dc2be-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/c/1/B"><num value="B">(B)</num><heading> Small and emerging private business enterprises</heading><clause class="indent3" id="id912dc2bf-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/c/1/B/i"><num value="i">(i)</num><heading> In general</heading>
<chapeau style="-uslm-lc:I14" class="blockIndent3">For the purpose of subparagraph (A), a small and emerging private business enterprise shall include (regardless of the number of employees or operating capital of the enterprise) an eligible nonprofit entity, or other tax-exempt organization, with a principal office in an area that is located—</chapeau><subclause class="indent4" id="id912de8d0-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/c/1/B/i/I"><num value="I">(I)</num><content> on land of an existing or former Native American reservation; and</content>
</subclause>
<subclause class="indent4" id="id912de8d1-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/c/1/B/i/II"><num value="II">(II)</num><content> in a city, town, or unincorporated area that has a population of not more than 5,000 inhabitants.</content>
</subclause>
</clause>
<clause class="indent3" id="id912de8d2-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/c/1/B/ii"><num value="ii">(ii)</num><heading> Use of grant</heading><content><p style="-uslm-lc:I14" class="indent3">An eligible nonprofit entity, or other tax exempt organization, described in clause (i) may use assistance provided under this paragraph to create, expand, or operate value-added processing in an area described in clause (i) in connection with production agriculture.</p>
</content>
</clause>
<clause class="indent3" id="id912de8d3-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/c/1/B/iii"><num value="iii">(iii)</num><heading> Priority</heading><content><p style="-uslm-lc:I14" class="indent3">In making grants under this paragraph, the Secretary shall give priority to grants that will be used to provide assistance to eligible nonprofit entities and other tax exempt organizations described in clause (i).</p>
</content>
</clause>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id912de8d4-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/c/2"><num value="2">(2)</num><heading> Passenger transportation services or facilities</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary may award grants on a competitive basis to qualified nonprofit organizations for the provision of technical assistance and training to rural communities for the purpose of improving passenger transportation services or facilities. Assistance provided under this paragraph may include on-site technical assistance to local and regional governments, public transit agencies, and related nonprofit and for-profit organizations in rural areas, the development of training materials, and the provision of necessary training assistance to local officials and agencies in rural areas.</p>
</content>
</paragraph>
<paragraph class="indent1" id="id912e0fe5-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/c/3"><num value="3">(3)</num><heading> Grants to aid industries in adjusting to terminated Federal agricultural programs or increased foreign competition</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary may make grants under this section to facilitate economic opportunity for industries undergoing adjustment from terminated Federal agricultural price and income support programs or increased competition from foreign trade.</p>
</content>
</paragraph>
</subsection>
<subsection class="indent0" id="id912e0fe6-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/d"><num value="d">(d)</num><heading> Joint loans or grants for private business enterprises; restrictions; system of certification for expeditious processing of requests for assistance; prior approval of grant or loan; equity investment as condition for loan commitment; issuance of certificates of beneficial ownership of notes</heading><paragraph class="indent0" id="id912e36f7-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/d/1"><num value="1">(1)</num><content> The Secretary may participate in joint financing to facilitate development of private business enterprises in rural areas with the Economic Development Administration, the Small Business Administration, and the Department of Housing and Urban Development and other Federal and State agencies and with private and quasi-public financial institutions, through joint loans to applicants eligible under subsection (a) of this section for the purpose of improving, developing, or financing business, industry, and employment and improving the economic and environmental climate in rural areas or through joint grants to applicants eligible under subsection (c) of this section for such purposes, including in the case of loans or grants the development, construction, or acquisition of land, buildings, plants, equipment, access streets and roads, parking areas, utility extensions, necessary water supply and waste disposal facilities, refining, service and fees.</content>
</paragraph>
<paragraph class="indent0" id="id912e36f8-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/d/2"><num value="2">(2)</num><content> No financial or other assistance shall be extended under any provision of this section, except for cases in which such assistance does not exceed $1,000,000 or for cases in which direct employment will not be increased by more than fifty employees, that is calculated to or is likely to result in the transfer from one area to another of any employment or business activity provided by operations of the applicant, but this limitation shall not be construed to prohibit assistance for the expansion of an existing business entity through the establishment of a new branch, affiliate, or subsidiary of such entity if the establishment of such branch, affiliate, or subsidiary will not result in an increase in unemployment in the area of original location or in any other area where such entity conducts business operations unless there is reason to believe that such branch, affiliate, or subsidiary is being established with the intention of closing down the operations of the existing business entity in the area of its original location or in any other area where it conducts such operations.</content>
</paragraph>
<paragraph class="indent0" id="id912e5e09-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/d/3"><num value="3">(3)</num><content> No financial or other assistance shall be extended under any provision of this section, except for cases in which such assistance does not exceed $1,000,000 or for cases in which direct employment will not be increased by more than fifty employees, which is calculated to or likely to result in an increase in the production of goods, materials, or commodities, or the availability of services or facilities in the area, when there is not sufficient demand for such goods, materials, commodities, services, or facilities, to employ the efficient capacity of existing competitive commercial or industrial enterprises, unless such financial or other assistance will not have an adverse effect upon existing competitive enterprises in the area.</content>
</paragraph>
<paragraph class="indent0" id="id912e851a-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/d/4"><num value="4">(4)</num><content> No financial or other assistance shall be extended under any provision of this section, except for cases in which such assistance does not exceed $1,000,000 or for cases in which direct employment will not be increased by more than fifty employees, if the Secretary of Labor certifies within 30 days after the matter has been submitted to him by the Secretary of Agriculture that the provisions of paragraphs (2) and (3) of this subsection have not been complied with. The Secretary of Labor shall, in cooperation with the Secretary of Agriculture, develop a system of certification which will insure the expeditious processing of requests for assistance under this section.</content>
</paragraph>
<paragraph class="indent0" id="id912eac2b-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/d/5"><num value="5">(5)</num><content> No grant or loan authorized to be made under this chapter shall require or be subject to the prior approval of any officer, employee, or agency of any State.</content>
</paragraph>
<paragraph class="indent0" id="id912eac2c-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/d/6"><num value="6">(6)</num><content> No loan commitment issued under this section shall be conditioned upon the applicant investing in excess of 10 per centum in the business or industrial enterprise for which purpose the loan is to be made unless the Secretary determines there are special circumstances which necessitate an equity investment by the applicant greater than 10 per centum.</content>
</paragraph>
<paragraph class="indent0" id="id912eac2d-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/d/7"><num value="7">(7)</num><content> No provision of law shall prohibit issuance by the Secretary of certificates evidencing beneficial ownership in a block of notes insured or guaranteed under this chapter or Title V of the Housing Act of 1949 [<ref href="/us/usc/t42/s1471">42 U.S.C. 1471</ref> et seq.]; any sale by the Secretary of such certificates shall be treated as a sale of assets for the purposes of chapter 11 of title 31. Any security representing beneficial ownership in a block of notes guaranteed or insured under this chapter or Title V of the Housing Act of 1949 issued by a private entity shall be exempt from laws administered by the Securities and Exchange Commission, except sections 77q, 77v, and 77x of title 15; however, the Secretary shall require (i) that the issuer place such notes in the custody of an institution chartered by a Federal or State agency to act as trustee and (ii) that the issuer provide such periodic reports of sales as the Secretary deems necessary.</content>
</paragraph>
</subsection>
<subsection class="indent0" id="id912ed33e-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e"><num value="e">(e)</num><heading> Rural cooperative development grants</heading><paragraph class="indent1" id="id912ed33f-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/1"><num value="1">(1)</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I12" class="blockIndent1">In this subsection:</chapeau><subparagraph class="indent2" id="id912ed340-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/1/A"><num value="A">(A)</num><heading> Nonprofit institution</heading><content><p style="-uslm-lc:I13" class="indent2">The term “nonprofit institution” means any organization or institution, including an accredited institution of higher education, no part of the net earnings of which inures, or may lawfully inure, to the benefit of any private shareholder or individual.</p>
</content>
</subparagraph>
<subparagraph class="indent2" id="id912efa51-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/1/B"><num value="B">(B)</num><heading> United States</heading><content><p style="-uslm-lc:I13" class="indent2">The term “United States” means the several States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, and the other territories and possessions of the United States.</p>
</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id912efa52-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/2"><num value="2">(2)</num><heading> Grants</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall make grants effective <date date="1996-10-01">October 1, 1996</date>, under this subsection to nonprofit institutions for the purpose of enabling the institutions to establish and operate centers for rural cooperative development.</p>
</content>
</paragraph>
<paragraph class="indent1" id="id912efa53-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/3"><num value="3">(3)</num><heading> Goals</heading><content><p style="-uslm-lc:I12" class="indent1">The goals of a center funded under this subsection shall be to facilitate the creation of jobs in rural areas through the development of new rural cooperatives, value added processing, and rural businesses.</p>
</content>
</paragraph>
<paragraph class="indent1" id="id912f2164-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/4"><num value="4">(4)</num><heading> Application</heading>
<chapeau style="-uslm-lc:I12" class="blockIndent1">Any nonprofit institution seeking a grant under paragraph (2) shall submit to the Secretary an application containing a plan for the establishment and operation by the institution of a center or centers for cooperative development. The Secretary may approve the application if the plan contains the following:</chapeau><subparagraph class="indent2" id="id912f2165-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/4/A"><num value="A">(A)</num><content> A provision that substantiates that the center will effectively serve rural areas in the United States.</content>
</subparagraph>
<subparagraph class="indent2" id="id912f2166-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/4/B"><num value="B">(B)</num><content> A provision that the primary objective of the center will be to improve the economic condition of rural areas through cooperative development.</content>
</subparagraph>
<subparagraph class="indent2" id="id912f2167-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/4/C"><num value="C">(C)</num><chapeau> A description of the activities that the center will carry out to accomplish the objective. The activities may include the following:</chapeau><clause class="indent3" id="id912f2168-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/4/C/i"><num value="i">(i)</num><content> Programs for applied research and feasibility studies that may be useful to individuals, cooperatives, small businesses, and other similar entities in rural areas served by the center.</content>
</clause>
<clause class="indent3" id="id912f2169-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/4/C/ii"><num value="ii">(ii)</num><content> Programs for the collection, interpretation, and dissemination of information that may be useful to individuals, cooperatives, small businesses, and other similar entities in rural areas served by the center.</content>
</clause>
<clause class="indent3" id="id912f487a-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/4/C/iii"><num value="iii">(iii)</num><content> Programs providing training and instruction for individuals, cooperatives, small businesses, and other similar entities in rural areas served by the center.</content>
</clause>
<clause class="indent3" id="id912f487b-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/4/C/iv"><num value="iv">(iv)</num><content> Programs providing loans and grants to individuals, cooperatives, small businesses, and other similar entities in rural areas served by the center.</content>
</clause>
<clause class="indent3" id="id912f487c-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/4/C/v"><num value="v">(v)</num><content> Programs providing technical assistance, research services, and advisory services to individuals, cooperatives, small businesses, and other similar entities in rural areas served by the center.</content>
</clause>
<clause class="indent3" id="id912f487d-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/4/C/vi"><num value="vi">(vi)</num><content> Programs providing for the coordination of services and sharing of information among the center.<ref class="footnoteRef" idref="fn002197">1</ref><note type="footnote" id="fn002197"><num>1</num> So in original. Probably should be “centers.”</note></content>
</clause>
</subparagraph>
<subparagraph class="indent2" id="id912f6f8e-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/4/D"><num value="D">(D)</num><content> A description of the contributions that the activities are likely to make to the improvement of the economic conditions of the rural areas for which the center will provide services.</content>
</subparagraph>
<subparagraph class="indent2" id="id912f6f8f-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/4/E"><num value="E">(E)</num><content> Provisions that the center, in carrying out the activities, will seek, where appropriate, the advice, participation, expertise, and assistance of representatives of business, industry, educational institutions, the Federal Government, and State and local governments.</content>
</subparagraph>
<subparagraph class="indent2" id="id912f6f90-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/4/F"><num value="F">(F)</num><content> Provisions that the center will take all practicable steps to develop continuing sources of financial support for the center, particularly from sources in the private sector.</content>
</subparagraph>
<subparagraph class="indent2" id="id912f6f91-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/4/G"><num value="G">(G)</num><chapeau> Provisions for—</chapeau><clause class="indent3" id="id912f96a2-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/4/G/i"><num value="i">(i)</num><content> monitoring and evaluating the activities by the nonprofit institution operating the center; and</content>
</clause>
<clause class="indent3" id="id912f96a3-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/4/G/ii"><num value="ii">(ii)</num><content> accounting for money received by the institution under this section.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id912f96a4-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/5"><num value="5">(5)</num><heading> Awarding grants</heading>
<chapeau style="-uslm-lc:I12" class="blockIndent1">Grants made under paragraph (2) shall be made on a competitive basis. In making grants under paragraph (2), the Secretary shall give preference to grant applications providing for the establishment of centers for rural cooperative development that—</chapeau><subparagraph class="indent2" id="id912f96a5-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/5/A"><num value="A">(A)</num><content> demonstrate a proven track record in carrying out activities to promote and assist the development of cooperatively and mutually owned businesses;</content>
</subparagraph>
<subparagraph class="indent2" id="id912f96a6-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/5/B"><num value="B">(B)</num><content> demonstrate previous expertise in providing technical assistance in rural areas to promote and assist the development of cooperatively and mutually owned businesses;</content>
</subparagraph>
<subparagraph class="indent2" id="id912f96a7-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/5/C"><num value="C">(C)</num><content> demonstrate the ability to assist in the retention of businesses, facilitate the establishment of cooperatives and new cooperative approaches, and generate employment opportunities that will improve the economic conditions of rural areas;</content>
</subparagraph>
<subparagraph class="indent2" id="id912fbdb8-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/5/D"><num value="D">(D)</num><content> commit to providing technical assistance and other services to underserved and economically distressed areas in rural areas of the United States;</content>
</subparagraph>
<subparagraph class="indent2" id="id912fbdb9-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/5/E"><num value="E">(E)</num><chapeau> demonstrate a commitment to—</chapeau><clause class="indent3" id="id912fbdba-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/5/E/i"><num value="i">(i)</num><content> networking with and sharing the results of the efforts of the center with other cooperative development centers and other organizations involved in rural economic development efforts; and</content>
</clause>
<clause class="indent3" id="id912fbdbb-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/5/E/ii"><num value="ii">(ii)</num><content> developing multiorganization and multistate approaches to addressing the economic development and cooperative needs of rural areas; and</content>
</clause>
</subparagraph>
<subparagraph class="indent2" id="id912fbdbc-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/5/F"><num value="F">(F)</num><content> commit to providing a 25 percent matching contribution with private funds and in-kind contributions, except that the Secretary shall not require non-Federal financial support in an amount that is greater than 5 percent in the case of a 1994 institution (as defined in section 532 of the Equity in Educational Land-Grant Status Act of 1994 (<ref href="/us/usc/t7/s301">7 U.S.C. 301</ref> note; <ref href="/us/pl/103/382">Public Law 103–382</ref>)).</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id912fe4cd-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/6"><num value="6">(6)</num><heading> Grant period</heading><subparagraph class="indent2" id="id912fe4ce-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/6/A"><num value="A">(A)</num><heading> In general</heading><content><p style="-uslm-lc:I13" class="indent2">A grant awarded to a center that has received no prior funding under this subsection shall be made for a period of 1 year.</p>
</content>
</subparagraph>
<subparagraph class="indent2" id="id912fe4cf-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/6/B"><num value="B">(B)</num><heading> Multiyear grants</heading><content><p style="-uslm-lc:I13" class="indent2">If the Secretary determines it to be in the best interest of the program, the Secretary shall award grants for a period of more than 1 year, but not more than 3 years, to a center that has successfully met the parameters described in paragraph (5), as determined by the Secretary.</p>
</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id912fe4d0-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/7"><num value="7">(7)</num><heading> Authority to extend grant period</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary may extend for 1 additional 12-month period the period in which a grantee may use a grant made under this subsection.</p>
</content>
</paragraph>
<paragraph class="indent1" id="id912fe4d1-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/8"><num value="8">(8)</num><heading> Technical assistance to prevent excessive unemployment or underemployment</heading><content><p style="-uslm-lc:I12" class="indent1">In carrying out this subsection, the Secretary may provide technical assistance to alleviate or prevent conditions of excessive unemployment, underemployment, outmigration, or low employment growth in economically distressed rural areas that the Secretary determines have a substantial need for the assistance. The assistance may include planning and feasibility studies, management and operational assistance, and studies evaluating the need for development potential of projects that increase employment and improve economic growth in the areas.</p>
</content>
</paragraph>
<paragraph class="indent1" id="id9130f642-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/9"><num value="9">(9)</num><heading> Grants to defray administrative costs</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary may make grants to defray not to exceed 75 percent of the costs incurred by organizations and public bodies to carry out projects for which grants or loans are made under this subsection. For purposes of determining the non-Federal share of the costs, the Secretary shall consider contributions in cash and in kind, fairly evaluated, including premises, equipment, and services.</p>
</content>
</paragraph>
<paragraph class="indent1" id="id9130f643-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/10"><num value="10">(10)</num><heading> Cooperative research program</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall enter into a cooperative research agreement with 1 or more qualified academic institutions in each fiscal year to conduct research on the effects of all types of cooperatives on the national economy.</p>
</content>
</paragraph>
<paragraph class="indent1" id="id9130f644-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/11"><num value="11">(11)</num><heading> Addressing needs of minority communities</heading><subparagraph class="indent2" id="id9130f645-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/11/A"><num value="A">(A)</num><heading> Definition of socially disadvantaged group</heading><content><p style="-uslm-lc:I13" class="indent2">In this paragraph, the term “socially disadvantaged group” has the meaning given the term in <ref href="/us/usc/t7/s2003/e">section 2003(e) of this title</ref>.</p>

</subparagraph>
<subparagraph class="indent2" id="id91311d56-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/11/B"><num value="B">(B)</num><heading> Reservation of funds</heading><clause class="indent3" id="id91314467-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/11/B/i"><num value="i">(i)</num><heading> In general</heading>
<chapeau style="-uslm-lc:I14" class="blockIndent3">If the total amount appropriated under paragraph (12) for a fiscal year exceeds $7,500,000, the Secretary shall reserve an amount equal to 20 percent of the total amount appropriated for grants for cooperative development centers, individual cooperatives, or groups of cooperatives—</chapeau><subclause class="indent4" id="id91314468-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/11/B/i/I"><num value="I">(I)</num><content> that serve socially disadvantaged groups; and</content>
</subclause>
<subclause class="indent4" id="id91314469-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/11/B/i/II"><num value="II">(II)</num><content> a majority of the boards of directors or governing boards of which are comprised of individuals who are members of socially disadvantaged groups.</content>
</subclause>
</clause>
<clause class="indent3" id="id9131446a-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/11/B/ii"><num value="ii">(ii)</num><heading> Insufficient applications</heading><content><p style="-uslm-lc:I14" class="indent3">To the extent there are insufficient applications to carry out clause (i), the Secretary shall use the funds as otherwise authorized by this subsection.</p>

<paragraph class="indent1" id="id91316b7b-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/e/12"><num value="12">(12)</num><heading> Authorization of appropriations</heading><content><p style="-uslm-lc:I12" class="indent1">There are authorized to be appropriated to carry out this subsection $50,000,000 for each of fiscal years 2008 through 2012.</p>

<subsection class="indent0" id="id91316b7c-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/f"><num value="f">(f)</num><heading> Grants to broadcasting systems</heading><paragraph class="indent1" id="id91316b7d-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/f/1"><num value="1">(1)</num><heading> “Statewide” defined</heading><content><p style="-uslm-lc:I12" class="indent1">In this subsection, the term “statewide” means having a coverage area of not less than 90 percent of the population of a State and not less than 80 percent of the rural land area of the State (as determined by the Secretary).</p>
</content>
</paragraph>
<paragraph class="indent1" id="id91316b7e-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/f/2"><num value="2">(2)</num><heading> Grants</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary may make grants to statewide private nonprofit public television systems, whose coverage area is predominately rural, for the purpose of demonstrating the effectiveness of such systems in providing information on agriculture and other issues of importance to farmers and other rural residents. Grants available under this paragraph may be used for capital equipment expenditures, start-up and program costs, and other costs necessary to the operation of such demonstrations.</p>

</paragraph>
<paragraph class="indent1" id="id9131928f-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/f/3"><num value="3">(3)</num><heading> Authorization of appropriations</heading><content><p style="-uslm-lc:I12" class="indent1">There is authorized to be appropriated to carry out this subsection $5,000,000 for each of fiscal years 2008 through 2012.</p>

<subsection class="indent0" id="id91319290-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g"><num value="g">(g)</num><heading> Business and industry direct and guaranteed loans</heading><paragraph class="indent1" id="id91319291-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/1"><num value="1">(1)</num><heading> Definition of business and industry loan</heading><content><p style="-uslm-lc:I12" class="indent1">In this subsection, the term “business and industry loan” means a business and industry direct or guaranteed loan that is made or guaranteed by the Secretary under subsection (a)(2)(A) of this section, including guarantees described in paragraph (3)(A)(ii).</p>
</content>
</paragraph>
<paragraph class="indent1" id="id9131b9a2-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/2"><num value="2">(2)</num><heading> Loan guarantees for the purchase of cooperative stock</heading><subparagraph class="indent2" id="id9131b9a3-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/2/A"><num value="A">(A)</num><heading> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary may guarantee a business and industry loan to individual farmers or ranchers for the purpose of purchasing capital stock of a farmer or rancher cooperative established for the purpose of processing an agricultural commodity.</p>
</content>
</subparagraph>
<subparagraph class="indent2" id="id9131b9a4-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/2/B"><num value="B">(B)</num><heading> Processing contracts during initial period</heading><content><p style="-uslm-lc:I13" class="indent2">A cooperative described in subparagraph (A) for which a farmer or rancher receives a guarantee to purchase stock under subparagraph (A) may contract for services to process agricultural commodities, or otherwise process value-added agricultural products, during the 5-year period beginning on the date of the startup of the cooperative in order to provide adequate time for the planning and construction of the processing facility of the cooperative.</p>
</content>
</subparagraph>
<subparagraph class="indent2" id="id9131b9a5-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/2/C"><num value="C">(C)</num><heading> Financial information</heading><content><p style="-uslm-lc:I13" class="indent2">Financial information required by the Secretary from a farmer or rancher as a condition of making a business and industry loan guarantee under this paragraph shall be provided in the manner generally required by commercial agricultural lenders in the area.</p>
</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id9131e0b6-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/3"><num value="3">(3)</num><heading> Loans to cooperatives</heading><subparagraph class="indent2" id="id9131e0b7-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/3/A"><num value="A">(A)</num><heading> Eligibility</heading><clause class="indent3" id="id9131e0b8-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/3/A/i"><num value="i">(i)</num><heading> In general</heading><content><p style="-uslm-lc:I14" class="indent3">The Secretary may make or guarantee a business and industry loan to a cooperative organization that is headquartered in a metropolitan area if the loan is used for a project or venture described in subsection (a) of this section that is located in a rural area or a loan guarantee that meets the requirements of paragraph (6).</p>
</content>
</clause>
<clause class="indent3" id="id9131e0b9-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/3/A/ii"><num value="ii">(ii)</num><heading> Equity</heading><content><p style="-uslm-lc:I14" class="indent3">The Secretary may guarantee a loan made for the purchase of preferred stock or similar equity issued by a cooperative organization or a fund that invests primarily in cooperative organizations, if the guarantee significantly benefits 1 or more entities eligible for assistance for the purposes described in subsection (a)(1), as determined by the Secretary.</p>
</content>
</clause>
</subparagraph>
<subparagraph class="indent2" id="id9131e0ba-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/3/B"><num value="B">(B)</num><heading> Refinancing</heading>
<chapeau style="-uslm-lc:I13" class="blockIndent2">A cooperative organization that is eligible for a business and industry loan shall be eligible to refinance an existing business and industry loan with a lender if—</chapeau><clause class="indent3" id="id913207cb-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/3/B/i"><num value="i">(i)</num><chapeau> the cooperative organization—</chapeau><subclause class="indent4" id="id913207cc-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/3/B/i/I"><num value="I">(I)</num><content> is current and performing with respect to the existing loan; and</content>
</subclause>
<subclause class="indent4" id="id913207cd-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/3/B/i/II"><num value="II">(II)</num><content> is not, and has not been, in payment default, or the collateral of which has not been converted, with respect to the existing loan; and</content>
</subclause>
</clause>
<clause class="indent3" id="id913207ce-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/3/B/ii"><num value="ii">(ii)</num><content> there is adequate security or full collateral for the refinanced loan.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id913207cf-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/4"><num value="4">(4)</num><heading> Loan appraisals</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary may require that any appraisal made in connection with a business and industry loan be conducted by a specialized appraiser that uses standards that are similar to standards used for similar purposes in the private sector, as determined by the Secretary.</p>
</content>
</paragraph>
<paragraph class="indent1" id="id91322ee0-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/5"><num value="5">(5)</num><heading> Fees</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary may assess a 1-time fee for any guaranteed business and industry loan in an amount that does not exceed 2 percent of the guaranteed principal portion of the loan.</p>
</content>
</paragraph>
<paragraph class="indent1" id="id91322ee1-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/6"><num value="6">(6)</num><heading> Loan guarantees in nonrural areas</heading><subparagraph class="indent2" id="id913255f2-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/6/A"><num value="A">(A)</num><heading> In general</heading>
<chapeau style="-uslm-lc:I13" class="blockIndent2">The Secretary may guarantee a business and industry loan to a cooperative organization for a facility that is not located in a rural area if—</chapeau><clause class="indent3" id="id913255f3-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/6/A/i"><num value="i">(i)</num><content> the primary purpose of the loan guarantee is for a facility to provide value-added processing for agricultural producers that are located within 80 miles of the facility;</content>
</clause>
<clause class="indent3" id="id913255f4-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/6/A/ii"><num value="ii">(ii)</num><content> the applicant demonstrates to the Secretary that the primary benefit of the loan guarantee will be to provide employment for residents of a rural area; and</content>
</clause>
<clause class="indent3" id="id913255f5-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/6/A/iii"><num value="iii">(iii)</num><content> the total amount of business and industry loans guaranteed for a fiscal year under this paragraph does not exceed 10 percent of the business and industry loans guaranteed for the fiscal year under subsection (a)(2)(A) of this section.</content>
</clause>
</subparagraph>
<subparagraph class="indent2" id="id913255f6-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/6/B"><num value="B">(B)</num><heading> Principal amounts</heading><content><p style="-uslm-lc:I13" class="indent2">The principal amount of a business and industry loan guaranteed under this paragraph may not exceed $25,000,000.</p>
</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id913255f7-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/7"><num value="7">(7)</num><heading> Intangible assets</heading><content><p style="-uslm-lc:I12" class="indent1">In determining whether a cooperative organization is eligible for a guaranteed business and industry loan, the Secretary may consider the market value of a properly appraised brand name, patent, or trademark of the cooperative.</p>
</content>
</paragraph>
<paragraph class="indent1" id="id91327d08-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/8"><num value="8">(8)</num><heading> Limitations on loan guarantees for cooperative organizations</heading><subparagraph class="indent2" id="id91327d09-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/8/A"><num value="A">(A)</num><heading> Principal amount</heading><clause class="indent3" id="id91327d0a-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/8/A/i"><num value="i">(i)</num><heading> In general</heading><content><p style="-uslm-lc:I14" class="indent3">Subject to clause (ii), the principal amount of a business and industry loan made to a cooperative organization and guaranteed under this subsection shall not exceed $40,000,000.</p>
</content>
</clause>
<clause class="indent3" id="id91327d0b-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/8/A/ii"><num value="ii">(ii)</num><heading> Use</heading>
<chapeau style="-uslm-lc:I14" class="blockIndent3">To be eligible for a guarantee under this subsection for a business and industry loan made to a cooperative organization, the principal amount of the any such loan in excess of $25,000,000 shall be used to carry out a project that—</chapeau><subclause class="indent4" id="id9132a41c-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/8/A/ii/I"><num value="I">(I)</num><item class="indent4" id="id9132a41d-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/8/A/ii/I/aa"><num value="aa">(aa)</num><content> is in a rural area; and</content>
</item>
<item class="indent4" id="id9132a41e-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/8/A/ii/I/bb"><num value="bb">(bb)</num><content> provides for the value-added processing of agricultural commodities; or</content>
</item>
</subclause>
<subclause class="indent4" id="id9132a41f-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/8/A/ii/II"><num value="II">(II)</num><content> significantly benefits 1 or more entities eligible for assistance for the purposes described in subsection (a)(1), as determined by the Secretary.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph class="indent2" id="id9132a420-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/8/B"><num value="B">(B)</num><heading> Applications</heading>
<chapeau style="-uslm-lc:I13" class="blockIndent2">If a cooperative organization submits an application for a guarantee under this subsection of a business and industry loan with a principal amount that is in excess of $25,000,000, the Secretary—</chapeau><clause class="indent3" id="id9132cb31-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/8/B/i"><num value="i">(i)</num><content> shall review and, if appropriate, approve the application; and</content>
</clause>
<clause class="indent3" id="id9132cb32-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/8/B/ii"><num value="ii">(ii)</num><content> may not delegate the approval authority.</content>
</clause>
</subparagraph>
<subparagraph class="indent2" id="id9132cb33-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/8/C"><num value="C">(C)</num><heading> Maximum amount</heading><content><p style="-uslm-lc:I13" class="indent2">The total amount of business and industry loans made to cooperative organizations and guaranteed for a fiscal year under this subsection with principal amounts that are in excess of $25,000,000 may not exceed 10 percent of the business and industry loans guaranteed for the fiscal year under subsection (a)(2)(A) of this section.</p>

</subparagraph>
</paragraph>
<paragraph class="indent1" id="id9132cb34-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/9"><num value="9">(9)</num><heading> Locally or regionally produced agricultural food products</heading><subparagraph class="indent2" id="id9132f245-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/9/A"><num value="A">(A)</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I13" class="blockIndent2">In this paragraph:</chapeau><clause class="indent3" id="id9132f246-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/9/A/i"><num value="i">(i)</num><heading> Locally or regionally produced agricultural food product</heading>
<chapeau style="-uslm-lc:I14" class="blockIndent3">The term “locally or regionally produced agricultural food product” means any agricultural food product that is raised, produced, and distributed in—</chapeau><subclause class="indent4" id="id9132f247-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/9/A/i/I"><num value="I">(I)</num><content> the locality or region in which the final product is marketed, so that the total distance that the product is transported is less than 400 miles from the origin of the product; or</content>
</subclause>
<subclause class="indent4" id="id9132f248-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/9/A/i/II"><num value="II">(II)</num><content> the State in which the product is produced.</content>
</subclause>
</clause>
<clause class="indent3" id="id9132f249-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/9/A/ii"><num value="ii">(ii)</num><heading> Underserved community</heading>
<chapeau style="-uslm-lc:I14" class="blockIndent3">The term “underserved community” means a community (including an urban or rural community and an Indian tribal community) that has, as determined by the Secretary—</chapeau><subclause class="indent4" id="id9133195a-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/9/A/ii/I"><num value="I">(I)</num><content> limited access to affordable, healthy foods, including fresh fruits and vegetables, in grocery retail stores or farmer-to-consumer direct markets; and</content>
</subclause>
<subclause class="indent4" id="id9133195b-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/9/A/ii/II"><num value="II">(II)</num><content> a high rate of hunger or food insecurity or a high poverty rate.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph class="indent2" id="id9133195c-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/9/B"><num value="B">(B)</num><heading> Loan and loan guarantee program</heading><clause class="indent3" id="id9133195d-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/9/B/i"><num value="i">(i)</num><heading> In general</heading><content><p style="-uslm-lc:I14" class="indent3">The Secretary shall make or guarantee loans to individuals, cooperatives, cooperative organizations, businesses, and other entities to establish and facilitate enterprises that process, distribute, aggregate, store, and market locally or regionally produced agricultural food products to support community development and farm and ranch income.</p>
</content>
</clause>
<clause class="indent3" id="id9133195e-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/9/B/ii"><num value="ii">(ii)</num><heading> Requirement</heading><content><p style="-uslm-lc:I14" class="indent3">The recipient of a loan or loan guarantee under clause (i) shall include in an appropriate agreement with retail and institutional facilities to which the recipient sells locally or regionally produced agricultural food products a requirement to inform consumers of the retail or institutional facilities that the consumers are purchasing or consuming locally or regionally produced agricultural food products.</p>
</content>
</clause>
<clause class="indent3" id="id9133406f-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/9/B/iii"><num value="iii">(iii)</num><heading> Priority</heading><content><p style="-uslm-lc:I14" class="indent3">In making or guaranteeing a loan under clause (i), the Secretary shall give priority to projects that have components benefitting underserved communities.</p>
</content>
</clause>
<clause class="indent3" id="id91334070-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/9/B/iv"><num value="iv">(iv)</num><heading> Reports</heading>
<chapeau style="-uslm-lc:I14" class="blockIndent3">Not later than 2 years after the date of enactment of this paragraph and annually thereafter, the Secretary shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report that describes projects carried out using loans or loan guarantees made under clause (i), including—</chapeau><subclause class="indent4" id="id91334071-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/9/B/iv/I"><num value="I">(I)</num><content> the characteristics of the communities served; and</content>
</subclause>
<subclause class="indent4" id="id91336782-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/9/B/iv/II"><num value="II">(II)</num><content> resulting benefits.</content>
</subclause>
</clause>
<clause class="indent3" id="id91336783-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/9/B/v"><num value="v">(v)</num><heading> Reservation of funds</heading><subclause class="indent4" id="id91336784-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/9/B/v/I"><num value="I">(I)</num><heading> In general</heading><content><p style="-uslm-lc:I16" class="indent4">For each of fiscal years 2008 through 2012, the Secretary shall reserve not less than 5 percent of the funds made available to carry out this subsection to carry out this subparagraph.</p>
</content>
</subclause>
<subclause class="indent4" id="id91336785-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/g/9/B/v/II"><num value="II">(II)</num><heading> Availability of funds</heading><content><p style="-uslm-lc:I16" class="indent4">Funds reserved under subclause (I) for a fiscal year shall be reserved until April 1 of the fiscal year.</p>

<subsection class="indent0" id="id91336786-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/h"><num value="h">(h)</num><heading> Loan guarantees for certain loans</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary may guarantee loans made under subsection (a) of this section to finance the issuance of bonds for the projects described in <ref href="/us/usc/t7/s1926/a/24">section 1926(a)(24) of this title</ref>.</p>

</subsection>
<subsection class="indent0" id="id91338e97-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/i"><num value="i">(i)</num><heading> Appropriate technology transfer for rural areas program</heading><paragraph class="indent1" id="id91338e98-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/i/1"><num value="1">(1)</num><heading> Definition of national nonprofit agricultural assistance institution</heading>
<chapeau style="-uslm-lc:I12" class="blockIndent1">In this subsection, the term “national nonprofit agricultural assistance institution” means an organization that—</chapeau><subparagraph class="indent2" id="id91338e99-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/i/1/A"><num value="A">(A)</num><content> is described in <ref href="/us/usc/t26/s501/c/3">section 501(c)(3) of title 26</ref> and exempt from taxation under <ref class="footnoteRef" idref="fn002198">2</ref><note type="footnote" id="fn002198"><num>2</num> So in original. The word “section” probably should appear.</note> 501(a) of that title;</content>
</subparagraph>
<subparagraph class="indent2" id="id91338e9a-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/i/1/B"><num value="B">(B)</num><content> has staff and offices in multiple regions of the United States;</content>
</subparagraph>
<subparagraph class="indent2" id="id91338e9b-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/i/1/C"><num value="C">(C)</num><content> has experience and expertise in operating national agriculture technical assistance programs;</content>
</subparagraph>
<subparagraph class="indent2" id="id91338e9c-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/i/1/D"><num value="D">(D)</num><content> expands markets for the agricultural commodities produced by producers through the use of practices that enhance the environment, natural resource base, and quality of life; and</content>
</subparagraph>
<subparagraph class="indent2" id="id9133b5ad-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/i/1/E"><num value="E">(E)</num><content> improves the economic viability of agricultural operations.</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id9133b5ae-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/i/2"><num value="2">(2)</num><heading> Establishment</heading>
<chapeau style="-uslm-lc:I12" class="blockIndent1">The Secretary shall establish a national appropriate technology transfer for rural areas program to assist agricultural producers that are seeking information to—</chapeau><subparagraph class="indent2" id="id9133b5af-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/i/2/A"><num value="A">(A)</num><content> reduce input costs;</content>
</subparagraph>
<subparagraph class="indent2" id="id9133b5b0-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/i/2/B"><num value="B">(B)</num><content> conserve energy resources;</content>
</subparagraph>
<subparagraph class="indent2" id="id9133b5b1-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/i/2/C"><num value="C">(C)</num><content> diversify operations through new energy crops and energy generation facilities; and</content>
</subparagraph>
<subparagraph class="indent2" id="id9133b5b2-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/i/2/D"><num value="D">(D)</num><content> expand markets for agricultural commodities produced by the producers by using practices that enhance the environment, natural resource base, and quality of life.</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id9133b5b3-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/i/3"><num value="3">(3)</num><heading> Implementation</heading><subparagraph class="indent2" id="id9133b5b4-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/i/3/A"><num value="A">(A)</num><heading> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall carry out the program under this subsection by making a grant to, or offering to enter into a cooperative agreement with, a national nonprofit agricultural assistance institution.</p>
</content>
</subparagraph>
<subparagraph class="indent2" id="id9133b5b5-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/i/3/B"><num value="B">(B)</num><heading> Grant amount</heading><content><p style="-uslm-lc:I13" class="indent2">A grant made, or cooperative agreement entered into, under subparagraph (A) shall provide 100 percent of the cost of providing information described in paragraph (2).</p>

<paragraph class="indent1" id="id9133dcc6-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/i/4"><num value="4">(4)</num><heading> Authorization of appropriations</heading><content><p style="-uslm-lc:I12" class="indent1">There are authorized to be appropriated to carry out this subsection $5,000,000 for each of fiscal years 2008 through 2012.</p>

<subsection class="indent0" id="id9133dcc7-f639-11e2-8470-abc29ba29c4d" identifier="/us/usc/t7/s1932/j"><num value="j">(j)</num><heading> Rural economic area partnership zones</heading><content><p style="-uslm-lc:I11" class="indent0">Effective beginning on the date of enactment of this subsection through <date date="2012-09-30">September 30, 2012</date>, the Secretary shall carry out those rural economic area partnership zones administratively in effect on the date of enactment of this subsection in accordance with the terms and conditions contained in the memorandums of agreement entered into by the Secretary for the rural economic area partnership zones, except as otherwise provided in this subsection.</p>

<subsection class="indent0"><num value="a">“(a)</num><paragraph class="indent0"><num value="1">(1)</num><content> Prior to <date date="1988-09-30">September 30, 1988</date>, the Secretary of Agriculture (hereafter in this section referred to as the ‘Secretary’) shall guarantee loans made by public agencies or private organizations (including loans made by financial institutions such as insurance companies) to nonprofit national rural development and finance corporations that establish similar and affiliated statewide rural development and finance programs for the purpose of providing loans, guarantees, and other financial assistance to profit or nonprofit local businesses to improve business, industry, and employment opportunities in a rural area (as determined by the Secretary).</content>
</paragraph>
<paragraph class="indent0"><num value="2">“(2)</num><chapeau> To be eligible to obtain a loan guarantee under this subsection, a corporation must—</chapeau><subparagraph class="indent1"><num value="A">“(A)</num><content> demonstrate to the Secretary the ability of the corporation to administer a national revolving rural development loan program;</content>
</subparagraph>
<subparagraph class="indent1"><num value="B">“(B)</num><content> be prepared to commit financial resources under the control of the corporation to the establishment of affiliated statewide rural development and finance programs; and</content>
</subparagraph>
<subparagraph class="indent1"><num value="C">“(C)</num><content> have secured commitments of significant financial support from public agencies and private organizations for such affiliated statewide programs.</content>
</subparagraph>
</paragraph>
<paragraph class="indent0"><num value="3">“(3)</num><content> A national rural development and finance corporation receiving a loan guarantee under this subsection shall base a determination to establish an affiliated statewide program in large part on the willingness of States and private organizations to sponsor and make funds available to such program.</content>
</paragraph>
<paragraph class="indent0"><num value="4">“(4)</num><content> Notwithstanding any other provision of law, for the fiscal year ending <date date="1986-09-30">September 30, 1986</date>, of the amounts available to guarantee loans in accordance with section 310B of the Consolidated Farm and Rural Development Act (<ref href="/us/usc/t7/s1932">7 U.S.C. 1932</ref>) from the Rural Development Insurance Fund, $20,000,000 shall be used by the Secretary to guarantee loans under the national rural development and finance program established under this subsection, to remain available until expended.</content>
</paragraph>
<paragraph class="indent0"><num value="5">“(5)</num><content> Notwithstanding any provision to the contrary of subsection (4) above, the $20,000,000 which was available pursuant to subsection (4) shall continue to be available and shall be used by the Secretary prior to <date date="1988-09-30">September 30, 1988</date>, to guarantee loans for the national rural development and finance program and shall remain available until expended.</content>
</paragraph>
</subsection>
<subsection class="indent0"><num value="b">“(b)</num><paragraph class="indent0"><num value="1">(1)</num><content> Prior to <date date="1988-09-30">September 30, 1988</date>, the Secretary shall make grants, from funds transferred under paragraph (2), to national rural development and finance corporations for the purpose of establishing a rural development program to provide financial and technical assistance to compliment [sic] the loan guarantees made or to be made to such corporations under subsection (a).</content>
</paragraph>
<paragraph class="indent0"><num value="2">“(2)</num><chapeau> All funds in, appropriated to, or repaid to the Rural Development Loan Fund, including those on deposit and available upon date of enactment [<date date="1985-12-23">Dec. 23, 1985</date>], under sections 623 and 633 [<ref href="/us/usc/t42/s9812">42 U.S.C. 9812</ref>, 9822] of the Community Economic Development Act of 1981 (<ref href="/us/usc/t42/s9801">42 U.S.C. 9801</ref> et seq.) shall be transferred to the Secretary provided that—</chapeau><subparagraph class="indent1"><num value="A">“(A)</num><content> all funds on deposit and available on date of enactment shall be used for the purpose of making grants under paragraph (1) and shall remain available until expended;</content>
</subparagraph>
<subparagraph class="indent1"><num value="B">“(B)</num><content> notwithstanding any other provision of law, all loans to intermediary borrowers made prior to date of enactment, shall upon date of enactment, for the life of such loan, bear a rate of interest not to exceed that in effect upon the date of issuance of such loans; and</content>
</subparagraph>
<subparagraph class="indent1"><num value="C">“(C)</num><chapeau> notwithstanding paragraph (1), all funds other than funds to which subparagraph (A) applies shall be used by the Secretary to make loans—</chapeau><clause class="indent2"><num value="i">“(i)</num><content> to the entities;</content>
</clause>
<clause class="indent2"><num value="ii">“(ii)</num><content> for the purposes; and</content>
</clause>
<clause class="indent2"><num value="iii">“(iii)</num><content> subject to the terms and conditions;</content>
</clause>

<continuation style="-uslm-lc:I31" class="indent1">specified in the first, second, and last sentences of section 623(a) of the Community Economic Development Act of 1981 (<ref href="/us/usc/t42/s9812/a">42 U.S.C. 9812(a)</ref>). For purposes of this subparagraph, any reference in such sentences to the Secretary shall be deemed to be a reference to the Secretary of Agriculture.”</continuation>
