<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id51f2e656-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a"><num value="1983a">§ 1983a.</num><heading> Prompt approval of loans and loan guarantees</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id51f2e657-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/a"><num value="a" class="bold">(a)</num><heading class="bold"> Applications; time for action by Secretary; notice; statement of reasons</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id51f2e658-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/a/1"><num value="1">(1)</num><content> The Secretary shall approve or disapprove an application for a loan or loan guarantee made under this chapter, and notify the applicant of such action, not later than 60 days after the Secretary has received a complete application for such loan or loan guarantee.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id51f2e659-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/a/2"><num value="2">(2)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id51f2e65a-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/a/2/A"><num value="A">(A)</num><content> If an application for a loan or loan guarantee under this chapter (other than under subchapter II of this chapter) is incomplete, the Secretary shall inform the applicant of the reasons such application is incomplete not later than 20 days after the Secretary has received such application.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id51f2e65b-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/a/2/B"><num value="B">(B)</num><clause style="-uslm-lc:I11" class="indent0" id="id51f2e65c-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/a/2/B/i"><num value="i">(i)</num><content> Not later than 10 calendar days after the Secretary receives an application for an operating loan or loan guarantee under subchapter II of this chapter, the Secretary shall notify the applicant of any information required before a decision may be made on the application. On receipt of an application, the Secretary shall request from other parties such information as may be needed in connection with the application.</content>
</clause>
<clause style="-uslm-lc:I11" class="indent0" id="id51f2e65d-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/a/2/B/ii"><num value="ii">(ii)</num><content> Not later than 15 calendar days after the date an agency of the Department of Agriculture receives a request for information made pursuant to clause (i), the agency shall provide the Secretary with the requested information.</content>
</clause>
<clause style="-uslm-lc:I11" class="indent0" id="id51f2e65e-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/a/2/B/iii"><num value="iii">(iii)</num><content> If, not later than 20 calendar days after the date a request is made pursuant to clause (i) with respect to an application, the Secretary has not received the information requested, the Secretary shall notify the applicant and the district office of the Farmers Home Administration, in writing, of the outstanding information.</content>
</clause>
<clause style="-uslm-lc:I11" class="indent0" id="id51f2e65f-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/a/2/B/iv"><num value="iv">(iv)</num><content> A county office shall notify the district office of the Farmers Home Administration of each application for an operating loan or loan guarantee under subchapter II of this chapter that is pending more than 45 days after receipt, and the reasons the application is pending.</content>
</clause>
<clause style="-uslm-lc:I11" class="indent0" id="id51f2e660-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/a/2/B/v"><num value="v">(v)</num><content> A district office that receives a notice provided under clause (iv) with respect to an application shall immediately take steps to ensure that final action is taken on the application not later than 15 days after the date of the receipt of the notice.</content>
</clause>
<clause style="-uslm-lc:I11" class="indent0" id="id51f2e661-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/a/2/B/vi"><num value="vi">(vi)</num><content> The district office shall report to the State office of the Farmers Home Administration on each application for an operating loan or loan guarantee under subchapter II of this chapter that is pending more than 45 days after receipt by the county committee, and the reasons the application is pending.</content>
</clause>
<clause style="-uslm-lc:I11" class="indent0" id="id51f2e662-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/a/2/B/vii"><num value="vii">(vii)</num><content> Each month, the Secretary shall notify the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate, on a State-by-State basis, as to each application for an operating loan or loan guarantee under subchapter II of this chapter on which final action had not been taken within 60 calendar days after receipt by the Secretary, and the reasons final action had not been taken.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id51f2e663-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/a/3"><num value="3">(3)</num><content> If an application for a loan or loan guarantee under this chapter is disapproved by the Secretary, the Secretary shall state the reasons for the disapproval in the notice required under paragraph (1).</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id51f2e664-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/a/4"><num value="4">(4)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id51f2e665-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/a/4/A"><num value="A">(A)</num><content> Notwithstanding paragraph (1), each application for a loan or loan guarantee under <ref href="/us/usc/t7/s1932/a">section 1932(a) of this title</ref>, or for a loan under <ref href="/us/usc/t7/s1926/a">section 1926(a) of this title</ref>, that is to be disapproved by the Secretary solely because the Secretary lacks the necessary amount of funds to make the loan or guarantee shall not be disapproved but shall be placed in pending status.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id51f2e666-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/a/4/B"><num value="B">(B)</num><content> The Secretary shall retain the pending application and reconsider the application beginning on the date that sufficient funds become available.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id51f2e667-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/a/4/C"><num value="C">(C)</num><content> Not later than 60 days after funds become available regarding each pending application, the Secretary shall notify the applicant of the approval or disapproval of funding for the application.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id51f2e668-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/b"><num value="b" class="bold">(b)</num><heading class="bold"> Loan proceeds; time for receipt</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id51f2e669-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/b/1"><num value="1">(1)</num><content> Except as provided in paragraph (2), if an application for an insured loan under this chapter is approved by the Secretary, the Secretary shall provide the loan proceeds to the applicant not later than 15 days (or such longer period as the applicant may approve) after the application for the loan is approved by the Secretary.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id51f2e66a-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/b/2"><num value="2">(2)</num><content> If the Secretary is unable to provide the loan proceeds to the applicant within such 15-day period because sufficient funds are not available to the Secretary for such purpose, the Secretary shall provide the loan proceeds to the applicant as soon as practicable (but in no event later than 15 days unless the applicant agrees to a longer period) after sufficient funds for such purpose become available to the Secretary.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id51f2e66b-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/c"><num value="c" class="bold">(c)</num><heading class="bold"> Reconsideration of applications; time for action by Secretary</heading><content><p style="-uslm-lc:I11" class="indent0">If an application for a loan or loan guarantee under this chapter is disapproved by the Secretary, but such action is subsequently reversed or revised as the result of an appeal within the Department of Agriculture or to the courts of the United States and the application is returned to the Secretary for further consideration, the Secretary shall act on the application and provide the applicant with notice of the action within 15 days after return of the application to the Secretary.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id51f2e66c-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/d"><num value="d" class="bold">(d)</num><heading class="bold"> Approved lender designation applications; time for decision by Secretary</heading><content><p style="-uslm-lc:I11" class="indent0">In carrying out the approved lender program established by exhibit A to subpart B of part 1980 of title 7, Code of Federal Regulations, the Secretary shall ensure that each request of a lending institution for designation as an approved lender under such program is reviewed, and a decision made on the application, not later than 15 days after the Secretary has received a complete application for such designation.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id51f2e66d-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/e"><num value="e" class="bold">(e)</num><heading class="bold"> Processing loan applications; personnel and other resources made available; use of authorities of law</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id51f2e66e-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/e/1"><num value="1">(1)</num><content> As soon as practicable after <date date="1985-12-23">December 23, 1985</date>, the Secretary shall take such steps as are necessary to make personnel, including the payment of overtime for such personnel, and other resources of the Department of Agriculture available to the Farmers Home Administration as are sufficient to enable the Farmers Home Administration to expeditiously process loan applications that are submitted by farmers and ranchers.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id51f2e66f-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/e/2"><num value="2">(2)</num><chapeau> In carrying out paragraph (1), the Secretary may use any authority of law provided to the Secretary, including—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id51f2e670-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/e/2/A"><num value="A">(A)</num><content> the Agricultural Credit Insurance Fund established under <ref href="/us/usc/t7/s1929">section 1929 of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id51f2e671-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/e/2/B"><num value="B">(B)</num><content> the employment procedures used in connection with the emergency loan program established under subchapter III of this chapter.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id51f2e672-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/f"><num value="f" class="bold">(f)</num><heading class="bold"> Graduation of seasoned direct loan borrowers to loan guarantee program</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id51f2e673-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/f/1"><num value="1">(1)</num><chapeau> As used in this subsection:</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id51f2e674-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/f/1/A"><num value="A">(A)</num><content> The term “approved lender” means a lender approved prior to <date date="1992-10-28">October 28, 1992</date>, by the Secretary under the approved lender program established by exhibit A to subpart B of part 1980 of title 7, Code of Federal Regulations (as in effect on <date date="1991-01-01">January 1, 1991</date>), or a lender certified under section 1989 <ref class="footnoteRef" idref="fn002200">1</ref><note type="footnote" id="fn002200"><num>1</num> See References in Text note below.</note> of this title.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id51f2e675-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/f/1/B"><num value="B">(B)</num><content> The term “seasoned direct loan borrower” means a borrower receiving a direct loan under this chapter who has been classified as “commercial” or “standard” under subpart W of part 2006 of the Instruction Manual (as in effect on <date date="1991-01-01">January 1, 1991</date>).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id51f2e676-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/f/2"><num value="2">(2)</num><content> The Secretary, or a contracting third party, shall annually review under <ref href="/us/usc/t7/s2006b">section 2006b of this title</ref> the loans of each seasoned loan borrower. If, based on the review, it is determined that a borrower would be able to obtain a loan, guaranteed by the Secretary, from a commercial or cooperative lender at reasonable rates and terms for loans for similar purposes and periods of time, the Secretary shall assist the borrower in applying for the commercial or cooperative loan.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id51f2e677-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/f/3"><num value="3">(3)</num><content> In accordance with <ref href="/us/usc/t7/s2006d">section 2006d of this title</ref>, the Secretary shall prepare a prospectus on each seasoned direct loan borrower determined eligible to obtain a guaranteed loan. The prospectus shall contain a description of the amounts of loan guarantee and interest assistance that the Secretary will provide to the seasoned direct loan borrower to enable the seasoned direct loan borrower to carry out a financially viable farming plan if a guaranteed loan is made.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id51f2e678-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/f/4"><num value="4">(4)</num><heading> Verification.—</heading><subparagraph style="-uslm-lc:I12" class="indent1" id="id51f2e679-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/f/4/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Secretary shall provide a prospectus of a seasoned direct loan borrower to each approved lender whose lending area includes the location of the seasoned direct loan borrower.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id51f2e67a-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/f/4/B"><num value="B">(B)</num><heading> <inline class="small-caps">Notification</inline>.—</heading><content>The Secretary shall notify each borrower of a loan that a prospectus has been provided to a lender under subparagraph (A).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id51f2e67b-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/f/4/C"><num value="C">(C)</num><heading> <inline class="small-caps">Credit extended</inline>.—</heading><content>If the Secretary receives an offer from an approved lender to extend credit to the seasoned direct loan borrower under terms and conditions contained in the prospectus, the seasoned direct loan borrower shall not be eligible for an insured loan from the Secretary under subchapter I or II of this chapter, except as otherwise provided in this subsection.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id51f2e67c-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/f/5"><num value="5">(5)</num><content> If the Secretary is unable to provide loan guarantees and, if necessary, interest assistance to the seasoned direct loan borrower under this subsection in amounts sufficient to enable the seasoned direct loan borrower to borrow from commercial sources the amount required to carry out a financially viable farming plan, or if the Secretary does not receive an offer from an approved lender to extend credit to a seasoned direct loan borrower under the terms and conditions contained in the prospectus, the Secretary shall make an insured loan to the seasoned direct loan borrower under subchapter I or II of this chapter, whichever is applicable.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id51f2e67d-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/f/6"><num value="6">(6)</num><content> To the extent necessary for the borrower to obtain a loan, guaranteed by the Secretary, from a commercial or cooperative lender, the Secretary shall provide interest rate reductions as provided for under <ref href="/us/usc/t7/s1999">section 1999 of this title</ref>.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id51f2e67e-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/g"><num value="g" class="bold">(g)</num><heading class="bold"> Simplified application forms for loan guarantees</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id51f2e67f-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/g/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau>The Secretary shall provide to lenders a short, simplified application form for guarantees under this chapter of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id51f2e680-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/g/1/A"><num value="A">(A)</num><content> farmer program loans the principal amount of which is $125,000 or less; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id51f2e681-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/g/1/B"><num value="B">(B)</num><chapeau> business and industry guaranteed loans under <ref href="/us/usc/t7/s1932/a/2/A">section 1932(a)(2)(A) of this title</ref> the principal amount of which is—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id51f2e682-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/g/1/B/i"><num value="i">(i)</num><content> in the case of a loan guarantee made during fiscal year 2002 or 2003, $400,000 or less; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id51f2e683-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/g/1/B/ii"><num value="ii">(ii)</num><chapeau> in the case of a loan guarantee made during any subsequent fiscal year—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id51f2e684-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/g/1/B/ii/I"><num value="I">(I)</num><content> $400,000 or less; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id51f2e685-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/g/1/B/ii/II"><num value="II">(II)</num><content> if the Secretary determines that there is not a significant increased risk of a default on the loan, $600,000 or less.</content>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id51f2e686-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/g/2"><num value="2" class="bold">(2)</num><heading class="bold"> Water and waste disposal grants and loans</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall develop an application process that accelerates, to the maximum extent practicable, the processing of applications for water and waste disposal grants or direct or guaranteed loans under paragraph (1) or (2) of <ref href="/us/usc/t7/s1926/a">section 1926(a) of this title</ref> the grant award amount or principal loan amount, respectively, of which is $300,000 or less.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id51f2e687-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/g/3"><num value="3" class="bold">(3)</num><heading class="bold"> Administration</heading><chapeau>In developing an application under this subsection, the Secretary shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id51f2e688-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/g/3/A"><num value="A">(A)</num><content> consult with commercial and cooperative lenders; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id51f2e689-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/g/3/B"><num value="B">(B)</num><chapeau> ensure that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id51f2e68a-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/g/3/B/i"><num value="i">(i)</num><content> the form can be completed manually or electronically, at the option of the lender;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id51f2e68b-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/g/3/B/ii"><num value="ii">(ii)</num><content> the form minimizes the documentation required to accompany the form;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id51f2e68c-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/g/3/B/iii"><num value="iii">(iii)</num><content> the cost of completing and processing the form is minimal; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id51f2e68d-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s1983a/g/3/B/iv"><num value="iv">(iv)</num><content> the form can be completed and processed in an expeditious manner.</content>
</clause>
</subparagraph>
