<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id353ede08-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2008a"><num value="2008a">§ 2008a.</num><heading> Equitable relief</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id353ede09-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2008a/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">Subject to subsection (b), the Secretary may provide a form of relief described in subsection (c) to any farmer or rancher who—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id353ede0a-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2008a/a/1"><num value="1">(1)</num><content> received a direct farm ownership, operating, or emergency loan under this chapter; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id353ede0b-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2008a/a/2"><num value="2">(2)</num><content> the Secretary determines is not in compliance with the requirements of this chapter with respect to the loan.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id353ede0c-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2008a/b"><num value="b" class="bold">(b)</num><heading class="bold"> Limitation</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary may only provide relief to a farmer or rancher under subsection (a) if the Secretary determines that the farmer or rancher—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id353ede0d-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2008a/b/1"><num value="1">(1)</num><content> acted in good faith; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id353ede0e-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2008a/b/2"><num value="2">(2)</num><content> relied on an action of, or the advice of, the Secretary (including any authorized representative of the Secretary) to the detriment of the farming or ranching operation of the farmer or rancher.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id353ede0f-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2008a/c"><num value="c" class="bold">(c)</num><heading class="bold"> Forms of relief</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary may provide to a farmer or rancher under subsection (a) any of the following forms of relief:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id353ede10-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2008a/c/1"><num value="1">(1)</num><content> The farmer or rancher may retain loans or other benefits received in association with the loan with respect to which the farmer or rancher was determined to be noncompliant under subsection (a)(2).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id353ede11-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2008a/c/2"><num value="2">(2)</num><content> The farmer or rancher may receive such other equitable relief as the Secretary determines to be appropriate.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id353ede12-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2008a/d"><num value="d" class="bold">(d)</num><heading class="bold"> Condition</heading><content><p style="-uslm-lc:I11" class="indent0">As a condition of receiving relief under this section, the Secretary may require the farmer or rancher to take actions designed to remedy the noncompliance.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id353ede13-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2008a/e"><num value="e" class="bold">(e)</num><heading class="bold"> Administrative appeal; judicial review</heading><chapeau style="-uslm-lc:I11" class="indent0">A determination or action of the Secretary under this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id353ede14-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2008a/e/1"><num value="1">(1)</num><content> shall be final; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id353ede15-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2008a/e/2"><num value="2">(2)</num><content> shall not be subject to administrative appeal or judicial review under chapter 7 of title 5.</content>
