<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id935f9836-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d"><num value="2009d">§ 2009d.</num><heading> Rural Development Trust Fund</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id935f9837-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/a"><num value="a" class="bold">(a)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I11" class="indent0">There is established in the Treasury of the United States a trust fund which shall be known as the Rural Development Trust Fund (in this subchapter referred to as the “Trust Fund”).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id935f9838-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/b"><num value="b" class="bold">(b)</num><heading class="bold"> Accounts</heading><chapeau>There are established in the Trust Fund the following accounts:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id935f9839-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/b/1"><num value="1">(1)</num><content> The rural community facilities account.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id935f983a-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/b/2"><num value="2">(2)</num><content> The rural utilities account.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id935f983b-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/b/3"><num value="3">(3)</num><content> The rural business and cooperative development account.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id935f983c-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/b/4"><num value="4">(4)</num><content> The federally recognized Indian tribe account.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id935f983d-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/c"><num value="c" class="bold">(c)</num><heading class="bold"> Deposits into accounts</heading><chapeau>Notwithstanding any other provision of law, each fiscal year—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id935f983e-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/c/1"><num value="1">(1)</num><content> all amounts made available to carry out the authorities described in subsection (d)(1) for the fiscal year shall be deposited into the rural community facilities account of the Trust Fund;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id935f983f-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/c/2"><num value="2">(2)</num><content> all amounts made available to carry out the authorities described in subsection (d)(2) for the fiscal year shall be deposited into the rural utilities account of the Trust Fund; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id935f9840-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/c/3"><num value="3">(3)</num><content> all amounts made available to carry out the authorities described in subsection (d)(3) for the fiscal year shall be deposited into the rural business and cooperative development account of the Trust Fund.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id935f9841-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/d"><num value="d" class="bold">(d)</num><heading class="bold"> Function categories</heading><chapeau>The function categories described in this subsection are the following:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id935f9842-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Rural community facilities</heading><chapeau>The rural community development category consists of all amounts made available for—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id935f9843-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/d/1/A"><num value="A">(A)</num><content> community facility direct and guaranteed loans under <ref href="/us/usc/t7/s1926/a/1">section 1926(a)(1) of this title</ref>; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id935f9844-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/d/1/B"><num value="B">(B)</num><content> community facility grants under paragraph (19), (20), or (21) of <ref href="/us/usc/t7/s1926/a">section 1926(a) of this title</ref>.</content>
</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id935f9845-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Rural utilities</heading><chapeau>The rural utilities category consists of all amounts made available for—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id935f9846-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/d/2/A"><num value="A">(A)</num><content> water or waste disposal grants or direct or guaranteed loans under paragraph (1) or (2) of <ref href="/us/usc/t7/s1926/a">section 1926(a) of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id935f9847-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/d/2/B"><num value="B">(B)</num><content> rural water or wastewater technical assistance and training grants under <ref href="/us/usc/t7/s1926/a/14">section 1926(a)(14) of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id935f9848-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/d/2/C"><num value="C">(C)</num><content> emergency community water assistance grants under <ref href="/us/usc/t7/s1926a">section 1926a of this title</ref>; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id935f9849-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/d/2/D"><num value="D">(D)</num><content> solid waste management grants under <ref href="/us/usc/t7/s1932/b">section 1932(b) of this title</ref>.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id935f984a-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Rural business and cooperative development</heading><chapeau>The rural business and cooperative development category consists of all amounts made available for—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id935f984b-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/d/3/A"><num value="A">(A)</num><content> rural business opportunity grants under section 1926(a)(11)(A) <ref class="footnoteRef" idref="fn002216">1</ref><note type="footnote" id="fn002216"><num>1</num> See References in Text note below.</note> of this title;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id935f984c-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/d/3/B"><num value="B">(B)</num><content> business and industry direct and guaranteed loans under <ref href="/us/usc/t7/s1932/a/2/A">section 1932(a)(2)(A) of this title</ref>; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id935f984d-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/d/3/C"><num value="C">(C)</num><content> rural business enterprise grants or rural educational network grants under <ref href="/us/usc/t7/s1932/c">section 1932(c) of this title</ref>.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id935f984e-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/e"><num value="e" class="bold">(e)</num><heading class="bold"> Federally recognized Indian tribe account</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id935f984f-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> Transfers into account</heading><content><p style="-uslm-lc:I12" class="indent1">Each fiscal year, the Secretary shall transfer to the federally recognized Indian tribe account of the Trust Fund 3 percent of the amount deposited into the Trust Fund for the fiscal year under subsection (d).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id935f9850-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Use of funds</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall make available to federally recognized Indian tribes the amounts in the federally recognized Indian tribe account for use pursuant to any authority described in subsection (d).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id935f9851-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/f"><num value="f" class="bold">(f)</num><heading class="bold"> Allocation among States</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall allocate the amounts in each account specified in subsection (c) among the States in a fair, reasonable, and appropriate manner that takes into consideration rural population, levels of income, unemployment, and other relevant factors, as determined by the Secretary.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id935f9852-9221-11e6-8cff-f47c89fe825b" identifier="/us/usc/t7/s2009d/g"><num value="g" class="bold">(g)</num><heading class="bold"> Availability of funds allocated for States</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall make available to each State the total amount allocated for the State under subsection (f) that remains after applying <ref href="/us/usc/t7/s2009f">section 2009f of this title</ref>.</p>
