<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id54b59efa-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013"><num value="2013">§ 2013.</num><heading> Establishment of supplemental nutrition assistance program</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id54b59efb-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/a"><num value="a" class="bold">(a)</num><heading class="bold"> Program</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id54b59efc-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I12" class="indent1">Subject to the availability of funds appropriated under <ref href="/us/usc/t7/s2027">section 2027 of this title</ref>, the Secretary is authorized to formulate and administer a supplemental nutrition assistance program under which, at the request of the State agency, eligible households within the State shall be provided an opportunity to obtain a more nutritious diet through the issuance to them of an allotment, except that a State may not participate in the supplemental nutrition assistance program if the Secretary determines that State or local sales taxes are collected within that State on purchases of food made with benefits issued under this chapter. The benefits so received by such households shall be used only to purchase food from retail food stores which have been approved for participation in the supplemental nutrition assistance program. Benefits issued and used as provided in this chapter shall be redeemable at face value by the Secretary through the facilities of the Treasury of the United States.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id54b59efd-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> State quality control incentive</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id54b59efe-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/a/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Definition of payment error rate</heading><content><p style="-uslm-lc:I13" class="indent2">In this paragraph, the term “payment error rate” has the meaning given the term in <ref href="/us/usc/t7/s2025/c/2">section 2025(c)(2) of this title</ref>.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id54b59eff-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/a/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> State cost share</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id54b59f00-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/a/2/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I14" class="indent3">Subject to clause (iii), beginning in fiscal year 2028, if the payment error rate of a State as determined under clause (ii) is—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id54b59f01-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/a/2/B/i/I"><num value="I">(I)</num><content> less than 6 percent, the Federal share of the cost of the allotment described in paragraph (1) for that State in a fiscal year shall be 100 percent, and the State share shall be 0 percent;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id54b59f02-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/a/2/B/i/II"><num value="II">(II)</num><content> equal to or greater than 6 percent but less than 8 percent, the Federal share of the cost of the allotment described in paragraph (1) for that State in a fiscal year shall be 95 percent, and the State share shall be 5 percent;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id54b59f03-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/a/2/B/i/III"><num value="III">(III)</num><content> equal to or greater than 8 percent but less than 10 percent, the Federal share of the cost of the allotment described in paragraph (1) for that State in a fiscal year shall be 90 percent, and the State share shall be 10 percent; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id54b59f04-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/a/2/B/i/IV"><num value="IV">(IV)</num><content> equal to or greater than 10 percent, the Federal share of the cost of the allotment described in paragraph (1) for that State in a fiscal year shall be 85 percent, and the State share shall be 15 percent.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id54b59f05-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/a/2/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Elections</heading><subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="id54b59f06-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/a/2/B/ii/I"><num value="I" class="bold">(I)</num><heading class="bold"> Fiscal year 2028</heading><content><p style="-uslm-lc:I16" class="indent4">For fiscal year 2028, to calculate the applicable State share under clause (i), a State may elect to use the payment error rate of the State from fiscal year 2025 or 2026.</p>
</content>
</subclause>
<subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="id54b59f07-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/a/2/B/ii/II"><num value="II" class="bold">(II)</num><heading class="bold"> Fiscal year 2029 and thereafter</heading><content><p style="-uslm-lc:I16" class="indent4">For fiscal year 2029 and each fiscal year thereafter, to calculate the applicable State share under clause (i), the Secretary shall use the payment error rate of the State for the third fiscal year preceding the fiscal year for which the State share is being calculated.</p>

<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id54b7e8f8-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/a/2/B/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Delayed implementation</heading><subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="id54b7e8f9-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/a/2/B/iii/I"><num value="I" class="bold">(I)</num><heading class="bold"> Fiscal year 2025</heading><content><p style="-uslm-lc:I16" class="indent4">If, for fiscal year 2025, the payment error rate of a State multiplied by 1.5 is equal to or above 20 percent, the implementation date under clause (i) for that State shall be fiscal year 2029.</p>

</subclause>
<subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="id54b7e8fa-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/a/2/B/iii/II"><num value="II" class="bold">(II)</num><heading class="bold"> Fiscal year 2026</heading><content><p style="-uslm-lc:I16" class="indent4">If, for fiscal year 2026, the payment error rate of a State multiplied by 1.5 is equal to or above 20 percent, the implementation date under clause (i) for that State shall be fiscal year 2030.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id54b7e8fb-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Maximum Federal payment</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary may not pay towards the cost of an allotment described in paragraph (1) an amount that is greater than the applicable Federal share under paragraph (2).</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id54b7e8fc-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b"><num value="b" class="bold">(b)</num><heading class="bold"> Food distribution program on Indian reservations</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id54b7e8fd-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Distribution of commodities, with or without the supplemental nutrition assistance program, shall be made whenever a request for concurrent or separate food program operations, respectively, is made by a tribal organization.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id54b7e8fe-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Administration</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id54b7e8ff-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Subject to subparagraphs (B) and (C), in the event of distribution on all or part of an Indian reservation, the appropriate agency of the State government in the area involved shall be responsible for the distribution.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id54b7e900-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Administration by tribal organization</heading><content><p style="-uslm-lc:I13" class="indent2">If the Secretary determines that a tribal organization is capable of effectively and efficiently administering a distribution described in paragraph (1), then the tribal organization shall administer the distribution.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id54b7e901-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Prohibition</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall not approve any plan for a distribution described in paragraph (1) that permits any household on any Indian reservation to participate simultaneously in the supplemental nutrition assistance program and the program established under this subsection.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id54b7e902-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Disqualified participants</heading><content><p style="-uslm-lc:I12" class="indent1">An individual who is disqualified from participation in the food distribution program on Indian reservations under this subsection is not eligible to participate in the supplemental nutrition assistance program under this chapter for a period of time to be determined by the Secretary.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id54b7e903-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Administrative costs</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id54b7e904-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Subject to subparagraph (B), the Secretary shall pay not less than 80 percent of administrative costs and distribution costs on Indian reservations as the Secretary determines necessary for effective administration of such distribution by a State agency or tribal organization.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id54b7e905-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Waiver</heading><chapeau style="-uslm-lc:I13" class="indent2">The Secretary shall waive up to 100 percent of the non-Federal share of the costs described in subparagraph (A) if the Secretary determines that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id54b7e906-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/4/B/i"><num value="i">(i)</num><content> the tribal organization is financially unable to provide a greater non-Federal share of the costs; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id54b7e907-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/4/B/ii"><num value="ii">(ii)</num><content> providing a greater non-Federal share of the costs would be a substantial burden for the tribal organization.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id54b7e908-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/4/C"><num value="C" class="bold">(C)</num><heading class="bold"> Limitation</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary may not reduce any benefits or services under the food distribution program on Indian reservations under this subsection to any tribal organization that is granted a waiver under subparagraph (B).</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id54b7e909-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/4/D"><num value="D" class="bold">(D)</num><heading class="bold"> Tribal contribution</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary may allow a tribal organization to use funds provided to the tribal organization through a Federal agency or other Federal benefit to satisfy all or part of the non-Federal share of the costs described in subparagraph (A) if that use is otherwise consistent with the purpose of the funds.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id54b7e90a-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/5"><num value="5" class="bold">(5)</num><heading class="bold"> Bison meat</heading><chapeau style="-uslm-lc:I12" class="indent1">Subject to the availability of appropriations to carry out this paragraph, the Secretary may purchase bison meat for recipients of food distributed under this subsection, including bison meat from—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id54b7e90b-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/5/A"><num value="A">(A)</num><content> Native American bison producers; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id54b7e90c-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/5/B"><num value="B">(B)</num><content> producer-owned cooperatives of bison ranchers.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id54b7e90d-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/6"><num value="6" class="bold">(6)</num><heading class="bold"> Traditional and locally- and regionally-grown food fund</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id54b7e90e-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/6/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Subject to the availability of appropriations, the Secretary shall establish a fund for use in purchasing traditional and locally- and regionally-grown foods for recipients of food distributed under this subsection.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id54b7e90f-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/6/B"><num value="B" class="bold">(B)</num><heading class="bold"> Native American producers</heading><content><p style="-uslm-lc:I13" class="indent2">Where practicable, of the food provided under subparagraph (A), at least 50 percent shall be produced by Native American farmers, ranchers, and producers.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id54b7e910-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/6/C"><num value="C" class="bold">(C)</num><heading class="bold"> Definition of traditional and locally- and regionally-grown</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall determine the definition of the term “traditional and locally- and regionally-grown” with respect to food distributed under this paragraph.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id54b7e911-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/6/D"><num value="D" class="bold">(D)</num><heading class="bold"> Purchase of foods</heading><content><p style="-uslm-lc:I13" class="indent2">In carrying out this paragraph, the Secretary shall purchase or offer to purchase those traditional foods that may be procured cost-effectively.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id54b7e912-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/6/E"><num value="E" class="bold">(E)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I13" class="indent2">There is authorized to be appropriated to the Secretary to carry out this paragraph $5,000,000 for each of fiscal years 2008 through 2023.</p>

</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id54b7e913-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/7"><num value="7" class="bold">(7)</num><heading class="bold"> Availability of funds</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id54b7e914-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/7/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Funds made available for a fiscal year to carry out this subsection shall remain available for obligation for a period of 2 fiscal years.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id54b7e915-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/b/7/B"><num value="B" class="bold">(B)</num><heading class="bold"> Administrative costs</heading><content><p style="-uslm-lc:I13" class="indent2">Funds made available for a fiscal year to carry out paragraph (4) shall remain available for obligation by the State agency or tribal organization for a period of 2 fiscal years.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id54b7e916-76cc-11f0-949d-c46244eca0b0" identifier="/us/usc/t7/s2013/c"><num value="c" class="bold">(c)</num><heading class="bold"> Regulations; transmittal of copy of regulations to Congressional committees prior to issuance</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall issue such regulations consistent with this chapter as the Secretary deems necessary or appropriate for the effective and efficient administration of the supplemental nutrition assistance program and shall promulgate all such regulations in accordance with the procedures set forth in <ref href="/us/usc/t5/s553">section 553 of title 5</ref>. In addition, prior to issuing any regulation, the Secretary shall provide the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a copy of the regulation with a detailed statement justifying it.</p>

<paragraph style="-uslm-lc:I21" class="indent0"><num value="3">“(3)</num><heading> <inline class="small-caps">Eligibility.—</inline></heading><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">“(A)</num><heading> <inline class="small-caps">Consultation</inline>.—</heading><content>The Secretary shall consult with the Secretary of the Interior and Indian tribes to determine the process and criteria under which a tribal organization may participate in the demonstration project.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><heading> <inline class="small-caps">Criteria</inline>.—</heading><chapeau>The Secretary shall select for participation in the demonstration project tribal organizations that—</chapeau><clause style="-uslm-lc:I23" class="indent2"><num value="i">“(i)</num><content> are successfully administering the food distribution program of the tribal organization under section 4(b)(2)(B) of the Food and Nutrition Act of 2008 (<ref href="/us/usc/t7/s2013/b/2/B">7 U.S.C. 2013(b)(2)(B)</ref>),</content>
</clause>
<clause style="-uslm-lc:I23" class="indent2"><num value="ii">“(ii)</num><content> have the capacity to purchase agricultural commodities in accordance with paragraph (4) for the food distribution program of the tribal organization, and</content>
</clause>
<clause style="-uslm-lc:I23" class="indent2"><num value="iii">“(iii)</num><content> meet any other criteria determined by the Secretary, in consultation with the Secretary of the Interior and Indian tribes.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="4">“(4)</num><heading> <inline class="small-caps">Procurement of agricultural commodities</inline>.—</heading><chapeau>Any agricultural commodities purchased by a tribal organization under the demonstration project shall—</chapeau><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">“(A)</num><content> be domestically produced,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><content> supplant, not supplement, the type of agricultural commodities in existing food packages for that tribal organization,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="C">“(C)</num><content> be of similar or higher nutritional value as the type of agricultural commodities that would be supplanted in the existing food package for that tribal organization, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="D">“(D)</num><content> meet any other criteria determined by the Secretary.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="5">“(5)</num><heading> <inline class="small-caps">Report</inline>.—</heading><content>Not later than 1 year after the date on which funds are appropriated under paragraph (6) and annually thereafter, the Secretary shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report describing the activities carried out under the demonstration project during the preceding year.</content>

<paragraph style="-uslm-lc:I21" class="indent0"><num value="3">“(3)</num><heading> <inline class="small-caps">Report</inline>.—</heading><chapeau>Not later than 18 months after the date of enactment of this Act [<date date="2014-02-07">Feb. 7, 2014</date>], the Secretary shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report that—</chapeau><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">“(A)</num><content> contains a list of programs, services, functions, and activities with respect to which it would be feasible to be administered by a tribal organization;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><content> a description of whether that administration would necessitate a statutory or regulatory change; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="C">“(C)</num><content> such other issues that may be determined by the Secretary and developed through consultation pursuant to paragraph (4).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="4">“(4)</num><heading> <inline class="small-caps">Consultation with indian tribes</inline>.—</heading><content>In developing the report required by paragraph (3), the Secretary shall consult with tribal organizations.</content>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="5">“(5)</num><heading> <inline class="small-caps">Funding</inline>.—</heading><content>Out of any funds made available under section 18 [probably means <ref href="/us/pl/88/525/s18">section 18 of Pub. L. 88–525</ref>, <ref href="/us/usc/t7/s2027">7 U.S.C. 2027</ref>] for fiscal year 2014, the Secretary shall make available to carry out the study and report described in paragraphs (2) and (3) $1,000,000, to remain available until expended.</content>

<paragraph style="-uslm-lc:I21" class="indent0"><num value="6">“(6)</num><heading> <inline class="small-caps">Traditional and local foods demonstration project.—</inline></heading><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">“(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Subject to the availability of appropriations, the Secretary shall pilot a demonstration project by awarding a grant to 1 or more tribal organizations authorized to administer the food distribution program on Indian reservations under section 4(b) of the Food and Nutrition Act of 2008 (<ref href="/us/usc/t7/s2013/b">7 U.S.C. 2013(b)</ref>) for the purpose of purchasing nutritious and traditional foods, and when practicable, foods produced locally by Indian producers, for distribution to recipients of foods distributed under that program.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><heading> <inline class="small-caps">Administration</inline>.—</heading><content>The Secretary may award a grant on a noncompetitive basis to 1 or more tribal organizations that have the administrative and financial capability to conduct a demonstration project, as determined by the Secretary.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="C">“(C)</num><heading> <inline class="small-caps">Consultation, technical assistance, and training</inline>.—</heading><content>During the implementation phase of the demonstration project, the Secretary shall consult with Indian tribes and provide outreach to Indian farmers, ranchers, and producers regarding the training and capacity to participate in the demonstration project.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="D">“(D)</num><heading> <inline class="small-caps">Funding.—</inline></heading><clause style="-uslm-lc:I23" class="indent2"><num value="i">“(i)</num><heading> <inline class="small-caps">Authorization of appropriations</inline>.—</heading><content>There is authorized to be appropriated to carry out this section $2,000,000 for each of fiscal years 2014 through 2018.</content>

<clause style="-uslm-lc:I23" class="indent2"><num value="ii">“(ii)</num><heading> <inline class="small-caps">Relationship to other authorities</inline>.—</heading><content>The funds and authorities provided under this subparagraph are in addition to any other funds or authorities the Secretary may have to carry out activities described in this paragraph.”</content>
