<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id52417be3-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016"><num value="2016">§ 2016.</num><heading> Issuance and use of program benefits</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id52417be4-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">Except as provided in subsection (i), EBT cards shall be issued only to households which have been duly certified as eligible to participate in the supplemental nutrition assistance program.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id52417be5-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/b"><num value="b" class="bold">(b)</num><heading class="bold"> Use</heading><content><p style="-uslm-lc:I11" class="indent0">Benefits issued to eligible households shall be used by them only to purchase food from retail food stores which have been approved for participation in the supplemental nutrition assistance program at prices prevailing in such stores: <i>Provided</i>, That nothing in this chapter shall be construed as authorizing the Secretary to specify the prices at which food may be sold by wholesale food concerns or retail food stores.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id52417be6-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/c"><num value="c" class="bold">(c)</num><heading class="bold"> Design</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id52417be7-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">EBT cards issued to eligible households shall be simple in design and shall include only such words or illustrations as are required to explain their purpose.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id52417be8-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Prohibition</heading><content><p style="-uslm-lc:I12" class="indent1">The name of any public official shall not appear on any EBT card.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id52417be9-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/d"><num value="d" class="bold">(d)</num><heading class="bold"> Delivery and control procedures</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall prescribe appropriate procedures for the delivery of benefits to benefit issuers and for the subsequent controls to be placed over such benefits by benefit issuers in order to ensure adequate accountability.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id52417bea-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/e"><num value="e" class="bold">(e)</num><heading class="bold"> State issuance liability</heading><content><p style="-uslm-lc:I11" class="indent0">Notwithstanding any other provision of this chapter, the State agency shall be strictly liable to the Secretary for any financial losses involved in the acceptance, storage and issuance of benefits, except that in the case of losses resulting from the issuance and replacement of authorizations for benefits which are sent through the mail, the State agency shall be liable to the Secretary to the extent prescribed in the regulations promulgated by the Secretary.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id52417beb-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f"><num value="f" class="bold">(f)</num><heading class="bold"> Alternative benefit delivery</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id52417bec-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">If the Secretary determines, in consultation with the Inspector General of the Department of Agriculture, that it would improve the integrity of the supplemental nutrition assistance program, the Secretary shall require a State agency to issue or deliver benefits using alternative methods.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id52417bed-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Imposition of costs</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id52417bee-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Except as provided in subparagraph (B), the Secretary shall require participating retail food stores (including restaurants participating in a State option restaurant program intended to serve the elderly, disabled, and homeless) to pay 100 percent of the costs of acquiring, and arrange for the implementation of, electronic benefit transfer point-of-sale equipment and supplies, including related services.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id52417bef-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Exemptions</heading><chapeau>The Secretary may exempt from subparagraph (A)—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id52417bf0-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f/2/B/i"><num value="i">(i)</num><content> farmers’ markets and other direct-to-consumer markets, military commissaries, nonprofit food buying cooperatives, and establishments, organizations, programs, or group living arrangements described in paragraphs (5), (7), and (8) of <ref href="/us/usc/t7/s2012/k">section 2012(k) of this title</ref>; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id52417bf1-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f/2/B/ii"><num value="ii">(ii)</num><content> establishments described in paragraphs (3), (4), and (9) of <ref href="/us/usc/t7/s2012/k">section 2012(k) of this title</ref>, other than restaurants participating in a State option restaurant program.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id52417bf2-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Interchange fees</heading><content><p style="-uslm-lc:I13" class="indent2">Nothing in this paragraph permits the charging of fees relating to the redemption of supplemental nutrition assistance program benefits, in accordance with subsection (h)(13).</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id52417bf3-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f/3"><num value="3" class="bold">(3)</num><heading class="bold"> Devaluation and termination of issuance of paper coupons</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id52417bf4-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Coupon issuance</heading><content><p style="-uslm-lc:I13" class="indent2">Effective on the date of enactment of the Food, Conservation, and Energy Act of 2008, no State shall issue any coupon, stamp, certificate, or authorization card to a household that receives supplemental nutrition assistance under this chapter.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id52417bf5-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> EBT cards</heading><content><p style="-uslm-lc:I13" class="indent2">Effective beginning on the date that is 1 year after the date of enactment of the Food, Conservation, and Energy Act of 2008, only an EBT card issued under subsection (i) shall be eligible for exchange at any retail food store.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id52417bf6-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> De-obligation of coupons</heading><chapeau>Coupons not redeemed during the 1-year period beginning on the date of enactment of the Food, Conservation, and Energy Act of 2008 shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id52417bf7-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f/3/C/i"><num value="i">(i)</num><content> no longer be an obligation of the Federal Government; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id52417bf8-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f/3/C/ii"><num value="ii">(ii)</num><content> not be redeemable.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id52417bf9-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f/4"><num value="4" class="bold">(4)</num><heading class="bold"> Termination of manual vouchers</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id52417bfa-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Effective beginning on <date date="2014-02-07">February 7, 2014</date>, except as provided in subparagraph (B), no State shall issue manual vouchers to a household that receives supplemental nutrition assistance under this chapter or allow retail food stores to accept manual vouchers as payment, unless the Secretary determines that the manual vouchers are necessary, such as in the event of an electronic benefit transfer system failure or a disaster situation.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id52417bfb-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Exemptions</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary may exempt categories of retail food stores or individual retail food stores from subparagraph (A) based on criteria established by the Secretary.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id52417bfc-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f/5"><num value="5" class="bold">(5)</num><heading class="bold"> Unique identification number required</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id52417bfd-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f/5/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">To enhance the anti-fraud protections of the program, the Secretary shall require all parties providing electronic benefit transfer services to provide for and maintain unique terminal identification number information through the supplemental nutrition assistance program electronic benefit transfer transaction routing system.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id52417bfe-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f/5/B"><num value="B" class="bold">(B)</num><heading class="bold"> Regulations</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id52417bff-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f/5/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">Not earlier than 2 years after <date date="2014-02-07">February 7, 2014</date>, the Secretary shall issue proposed regulations to carry out this paragraph.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id52417c00-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/f/5/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Commercial practices</heading><content><p style="-uslm-lc:I14" class="indent3">In issuing regulations to carry out this paragraph, the Secretary shall consider existing commercial practices for other point-of-sale debit transactions.</p>
</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id52417c01-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/g"><num value="g" class="bold">(g)</num><heading class="bold"> Staggered issuance procedures</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id52417c02-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/g/1"><num value="1">(1)</num><content> The State agency may establish a procedure for staggering the issuance of benefits to eligible households throughout the month. Upon the request of the tribal organization that exercises governmental jurisdiction over the reservation, the State agency shall stagger the issuance of benefits for eligible households located on reservations for at least 15 days of a month.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id52417c03-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/g/2"><num value="2">(2)</num><heading> Requirements.—</heading><subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c04-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/g/2/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Any procedure established under paragraph (1) shall—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id52417c05-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/g/2/A/i"><num value="i">(i)</num><content> not reduce the allotment of any household for any period; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id52417c06-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/g/2/A/ii"><num value="ii">(ii)</num><content> ensure that no household experiences an interval between issuances of more than 40 days.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c07-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/g/2/B"><num value="B">(B)</num><heading> <inline class="small-caps">Multiple issuances</inline>.—</heading><content>The procedure may include issuing benefits to a household in more than 1 issuance during a month only when a benefit correction is necessary.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id52417c08-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h"><num value="h" class="bold">(h)</num><heading class="bold"> Electronic benefit transfers</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id52417c09-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/1"><num value="1">(1)</num><heading> In general.—</heading><subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c0a-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/1/A"><num value="A">(A)</num><heading> <inline class="small-caps">Implementation</inline>.—</heading><content>Not later than <date date="2002-10-01">October 1, 2002</date>, each State agency shall implement an electronic benefit transfer system under which household benefits determined under section 2017(a) or 2035 of this title are issued from and stored in a central databank, unless the Secretary provides a waiver for a State agency that faces unusual barriers to implementing an electronic benefit transfer system.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c0b-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/1/B"><num value="B">(B)</num><heading> <inline class="small-caps">Timely implementation</inline>.—</heading><content>Each State agency is encouraged to implement an electronic benefit transfer system under subparagraph (A) as soon as practicable.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c0c-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/1/C"><num value="C">(C)</num><heading> <inline class="small-caps">State flexibility</inline>.—</heading><content>Subject to paragraph (2), a State agency may procure and implement an electronic benefit transfer system under the terms, conditions, and design that the State agency considers appropriate.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c0d-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/1/D"><num value="D">(D)</num><heading> <inline class="small-caps">Operation</inline>.—</heading><chapeau>An electronic benefit transfer system should take into account generally accepted standard operating rules based on—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id52417c0e-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/1/D/i"><num value="i">(i)</num><content> commercial electronic funds transfer technology;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id52417c0f-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/1/D/ii"><num value="ii">(ii)</num><content> the need to permit interstate operation and law enforcement monitoring; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id52417c10-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/1/D/iii"><num value="iii">(iii)</num><content> the need to permit monitoring and investigations by authorized law enforcement agencies.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id52417c11-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/2"><num value="2">(2)</num><chapeau> The Secretary shall issue final regulations that establish standards for the approval of such a system. The standards shall include—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c12-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/2/A"><num value="A">(A)</num><content> defining the required level of recipient protection regarding privacy, ease of use, and access to and service in retail food stores;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c13-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/2/B"><num value="B">(B)</num><content> the terms and conditions of participation by retail food stores, financial institutions, and other appropriate parties;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c14-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/2/C"><num value="C">(C)</num><clause style="-uslm-lc:I12" class="indent1" id="id52417c15-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/2/C/i"><num value="i">(i)</num><content> measures to maximize the security of a system using the most recent technology available that the State agency considers appropriate and cost effective and which may include personal identification numbers, photographic identification on electronic benefit transfer cards, and other measures to protect against fraud and abuse; and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id52417c16-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/2/C/ii"><num value="ii">(ii)</num><chapeau> unless determined by the Secretary to be located in an area with significantly limited access to food, measures that require an electronic benefit transfer system—</chapeau><subclause style="-uslm-lc:I13" class="indent2" id="id52417c17-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/2/C/ii/I"><num value="I">(I)</num><content> to set and enforce sales restrictions based on benefit transfer payment eligibility by using scanning or product lookup entry; and</content>
</subclause>
<subclause style="-uslm-lc:I13" class="indent2" id="id52417c18-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/2/C/ii/II"><num value="II">(II)</num><content> to deny benefit tenders for manually entered sales of ineligible items.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c19-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/2/D"><num value="D">(D)</num><content> system transaction interchange, reliability, and processing speeds;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c1a-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/2/E"><num value="E">(E)</num><content> financial accountability;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c1b-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/2/F"><num value="F">(F)</num><content> the required testing of system operations prior to implementation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c1c-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/2/G"><num value="G">(G)</num><content> the analysis of the results of system implementation in a limited project area prior to expansion; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c1d-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/2/H"><num value="H">(H)</num><content> procurement standards.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id52417c1e-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/3"><num value="3">(3)</num><chapeau> In the case of a system described in paragraph (1) in which participation is not optional for households, the Secretary shall not approve such a system unless—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c1f-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/3/A"><num value="A">(A)</num><content> a sufficient number of eligible retail food stores, including those stores able to serve minority language populations, have agreed to participate in the system throughout the area in which it will operate to ensure that eligible households will not suffer a significant reduction in their choice of retail food stores or a significant increase in the cost of food or transportation to participating food stores; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c20-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/3/B"><num value="B">(B)</num><content> any special equipment necessary to allow households to purchase food with the benefits issued under this chapter is operational at a sufficient number of registers to provide service that is comparable to service provided individuals who are not members of households receiving supplemental nutrition assistance program benefits, as determined by the Secretary.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id52417c21-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/4"><num value="4">(4)</num><content> Administrative costs incurred in connection with activities under this subsection shall be eligible for reimbursement in accordance with <ref href="/us/usc/t7/s2025">section 2025 of this title</ref>, subject to the limitations in <ref href="/us/usc/t7/s2025/g">section 2025(g) of this title</ref>.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id52417c22-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/5"><num value="5">(5)</num><content> The Secretary shall periodically inform State agencies of the advantages of using electronic benefit systems to issue benefits in accordance with this subsection in lieu of issuing coupons to households.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id52417c23-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/6"><num value="6">(6)</num><content> This subsection shall not diminish the authority of the Secretary to conduct projects to test automated or electronic benefit delivery systems under <ref href="/us/usc/t7/s2026/f">section 2026(f) of this title</ref>.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id52417c24-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/7"><num value="7">(7)</num><heading> <inline class="small-caps">Replacement of benefits</inline>.—</heading><content>Regulations issued by the Secretary regarding the replacement of benefits and liability for replacement of benefits under an electronic benefit transfer system shall be similar to the regulations in effect for a paper-based supplemental nutrition assistance issuance system.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id52417c25-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/8"><num value="8">(8)</num><heading> <inline class="small-caps">Replacement of cards</inline>.—</heading><subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c26-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/8/A"><num value="A">(A)</num><heading> <inline class="small-caps">Fees</inline>.—</heading><content>A State agency may collect a charge for replacement of an electronic benefit transfer card by reducing the monthly allotment of the household receiving the replacement card.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c27-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/8/B"><num value="B">(B)</num><heading> Purposeful loss of cards.—</heading><clause style="-uslm-lc:I13" class="indent2" id="id52417c28-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/8/B/i"><num value="i">(i)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Subject to terms and conditions established by the Secretary in accordance with clause (ii), if a household makes excessive requests for replacement of the electronic benefit transfer card of the household, the Secretary may require a State agency to decline to issue a replacement card to the household unless the household, upon request of the State agency, provides an explanation for the loss of the card.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id52417c29-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/8/B/ii"><num value="ii">(ii)</num><heading> <inline class="small-caps">Requirements</inline>.—</heading><chapeau>The terms and conditions established by the Secretary shall provide that—</chapeau><subclause style="-uslm-lc:I14" class="indent3" id="id52417c2a-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/8/B/ii/I"><num value="I">(I)</num><content> the household be given the opportunity to provide the requested explanation and meet the requirements under this paragraph promptly;</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="id52417c2b-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/8/B/ii/II"><num value="II">(II)</num><content> after an excessive number of lost cards, the head of the household shall be required to review program rights and responsibilities with State agency personnel authorized to make determinations under <ref href="/us/usc/t7/s2014/a">section 2014(a) of this title</ref>; and</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="id52417c2c-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/8/B/ii/III"><num value="III">(III)</num><content> any action taken, including actions required under <ref href="/us/usc/t7/s2015/b/2">section 2015(b)(2) of this title</ref>, other than the withholding of the electronic benefit transfer card until an explanation described in subclause (I) is provided, shall be consistent with the due process protections under section 2015(b) or 2020(e)(10) of this title, as appropriate.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c2d-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/8/C"><num value="C">(C)</num><heading> <inline class="small-caps">Protecting vulnerable persons</inline>.—</heading><content>In implementing this paragraph, a State agency shall act to protect homeless persons, persons with disabilities, victims of crimes, and other vulnerable persons who lose electronic benefit transfer cards but are not intentionally committing fraud.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c2e-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/8/D"><num value="D">(D)</num><heading> <inline class="small-caps">Effect on eligibility</inline>.—</heading><content>While a State may decline to issue an electronic benefits transfer card until a household satisfies the requirements under this paragraph, nothing in this paragraph shall be considered a denial of, or limitation on, the eligibility for benefits under <ref href="/us/usc/t7/s2014">section 2014 of this title</ref>.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id52417c2f-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/9"><num value="9">(9)</num><heading> Optional photographic identification.—</heading><subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c30-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/9/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>A State agency may require that an electronic benefit card contain a photograph of 1 or more members of a household.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c31-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/9/B"><num value="B">(B)</num><heading> <inline class="small-caps">Other authorized users</inline>.—</heading><content>If a State agency requires a photograph on an electronic benefit card under subparagraph (A), the State agency shall establish procedures to ensure that any other appropriate member of the household or any authorized representative of the household may utilize the card.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id52417c32-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/10"><num value="10">(10)</num><heading> <inline class="small-caps">Federal law not applicable</inline>.—</heading><content>Section 1693<i>o</i>–2 of title 15 shall not apply to electronic benefit transfer or reimbursement systems under this chapter.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id52417c33-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/11"><num value="11">(11)</num><heading> Application of anti-tying restrictions to electronic benefit transfer systems.—</heading><subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c34-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/11/A"><num value="A">(A)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this paragraph:</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id52417c35-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/11/A/i"><num value="i">(i)</num><heading> <inline class="small-caps">Affiliate</inline>.—</heading><content>The term “affiliate” has the meaning provided the term in <ref href="/us/usc/t12/s1841/k">section 1841(k) of title 12</ref>.</content>

<clause style="-uslm-lc:I13" class="indent2" id="id52417c36-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/11/A/ii"><num value="ii">(ii)</num><heading> <inline class="small-caps">Company</inline>.—</heading><content>The term “company” has the meaning provided the term in <ref href="/us/usc/t12/s1971">section 1971 of title 12</ref>, but shall not include a bank, a bank holding company, or any subsidiary of a bank holding company.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id52417c37-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/11/A/iii"><num value="iii">(iii)</num><heading> <inline class="small-caps">Electronic benefit transfer service</inline>.—</heading><chapeau>The term “electronic benefit transfer service” means the processing of electronic transfers of household benefits, determined under section 2017(a) or 2035 of this title, if the benefits are—</chapeau><subclause style="-uslm-lc:I14" class="indent3" id="id52417c38-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/11/A/iii/I"><num value="I">(I)</num><content> issued from and stored in a central databank;</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="id52417c39-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/11/A/iii/II"><num value="II">(II)</num><content> electronically accessed by household members at the point of sale; and</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="id52417c3a-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/11/A/iii/III"><num value="III">(III)</num><content> provided by a Federal or State government.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id52417c3b-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/11/A/iv"><num value="iv">(iv)</num><heading> <inline class="small-caps">Point-of-sale service</inline>.—</heading><content>The term “point-of-sale service” means any product or service related to the electronic authorization and processing of payments for merchandise at a retail food store, including credit or debit card services, automated teller machines, point-of-sale terminals, or access to on-line systems.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c3c-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/11/B"><num value="B">(B)</num><heading> <inline class="small-caps">Restrictions</inline>.—</heading><chapeau>A company may not sell or provide electronic benefit transfer services, or fix or vary the consideration for electronic benefit transfer services, on the condition or requirement that the customer—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id52417c3d-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/11/B/i"><num value="i">(i)</num><content> obtain some additional point-of-sale service from the company or an affiliate of the company; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id52417c3e-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/11/B/ii"><num value="ii">(ii)</num><content> not obtain some additional point-of-sale service from a competitor of the company or competitor of any affiliate of the company.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c3f-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/11/C"><num value="C">(C)</num><heading> <inline class="small-caps">Consultation with the federal reserve board</inline>.—</heading><content>Before promulgating regulations or interpretations of regulations to carry out this paragraph, the Secretary shall consult with the Board of Governors of the Federal Reserve System.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id52417c40-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/12"><num value="12">(12)</num><heading> Recovering electronic benefits.—</heading><subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c41-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/12/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>A State agency shall establish a procedure for recovering electronic benefits from the account of a household due to inactivity.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c42-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/12/B"><num value="B">(B)</num><heading> <inline class="small-caps">Benefit storage</inline>.—</heading><content>A State agency may store recovered electronic benefits off-line in accordance with subparagraph (D), if the household has not accessed the account after 6 months.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c43-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/12/C"><num value="C">(C)</num><heading> <inline class="small-caps">Benefit expunging</inline>.—</heading><content>A State agency shall expunge benefits that have not been accessed by a household after a period of 12 months.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c44-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/12/D"><num value="D">(D)</num><heading> <inline class="small-caps">Notice</inline>.—</heading><chapeau>A State agency shall—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id52417c45-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/12/D/i"><num value="i">(i)</num><content> send notice to a household the benefits of which are stored under subparagraph (B); and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id52417c46-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/12/D/ii"><num value="ii">(ii)</num><content> not later than 48 hours after request by the household, make the stored benefits available to the household.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id52417c47-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/13"><num value="13">(13)</num><heading> <inline class="small-caps">Interchange fees</inline>.—</heading><content>No interchange fees shall apply to electronic benefit transfer transactions under this subsection.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id52417c48-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/14"><num value="14">(14)</num><heading> Mobile technologies.—</heading><subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c49-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/14/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Subject to subparagraph (B), the Secretary shall approve retail food stores to redeem benefits through electronic means other than wired point of sale devices for electronic benefit transfer transactions, if the retail food stores—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id52417c4a-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/14/A/i"><num value="i">(i)</num><content> establish recipient protections regarding privacy, ease of use, access, and support similar to the protections provided for transactions made in retail food stores;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id52417c4b-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/14/A/ii"><num value="ii">(ii)</num><content> bear the costs of obtaining, installing, and maintaining mobile technologies, including mechanisms needed to process EBT cards and transaction fees;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id52417c4c-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/14/A/iii"><num value="iii">(iii)</num><content> demonstrate the foods purchased with benefits issued under this section through mobile technologies are purchased at a price not higher than the price of the same food purchased by other methods used by the retail food store, as determined by the Secretary;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id52417c4d-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/14/A/iv"><num value="iv">(iv)</num><content> provide adequate documentation for each authorized transaction, as determined by the Secretary; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id52417c4e-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/14/A/v"><num value="v">(v)</num><content> meet other criteria as established by the Secretary.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52417c4f-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/14/B"><num value="B">(B)</num><heading> Demonstration project on acceptance of benefits of mobile transactions.—</heading><clause style="-uslm-lc:I13" class="indent2" id="id52417c50-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/14/B/i"><num value="i">(i)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Before authorizing implementation of subparagraph (A) in all States, the Secretary shall pilot the use of mobile technologies determined by the Secretary to be appropriate to test the feasibility and implications for program integrity, by allowing retail food stores to accept benefits from recipients of supplemental nutrition assistance through mobile transactions.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id52417c51-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/14/B/ii"><num value="ii">(ii)</num><heading> <inline class="small-caps">Demonstration projects</inline>.—</heading><chapeau>To be eligible to participate in a demonstration project under clause (i), a retail food store shall submit to the Secretary for approval a plan that includes—</chapeau><subclause style="-uslm-lc:I14" class="indent3" id="id5243ed52-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/14/B/ii/I"><num value="I">(I)</num><content> a description of the technology;</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="id5243ed53-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/14/B/ii/II"><num value="II">(II)</num><content> the manner by which the retail food store will provide proof of the transaction to households;</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="id5243ed54-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/14/B/ii/III"><num value="III">(III)</num><content> the provision of data to the Secretary, consistent with requirements established by the Secretary, in a manner that allows the Secretary to evaluate the impact of the demonstration on participant access, ease of use, and program integrity; and</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="id5243ed55-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/14/B/ii/IV"><num value="IV">(IV)</num><content> such other criteria as the Secretary may require.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id5243ed56-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/14/B/iii"><num value="iii">(iii)</num><heading> <inline class="small-caps">Date of completion</inline>.—</heading><content>The demonstration projects under this subparagraph shall be completed and final reports submitted to the Secretary by not later than <date date="2016-07-01">July 1, 2016</date>.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id5243ed57-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/14/C"><num value="C">(C)</num><heading> <inline class="small-caps">Report to congress</inline>.—</heading><chapeau>The Secretary shall—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id5243ed58-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/14/C/i"><num value="i">(i)</num><content> by not later than <date date="2017-01-01">January 1, 2017</date>, authorize implementation of subparagraph (A) in all States, unless the Secretary makes a finding, based on the data provided under subparagraph (B), that implementation in all States is not in the best interest of the supplemental nutrition assistance program; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id5243ed59-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/h/14/C/ii"><num value="ii">(ii)</num><content> if the determination made in clause (i) is not to implement subparagraph (A) in all States, submit a report to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate that includes the basis of the finding.</content>
</clause>
</subparagraph>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id5243ed5a-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/i"><num value="i" class="bold">(i)</num><heading class="bold"> State option to issue benefits to certain individuals made ineligible by welfare reform</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5243ed5b-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/i/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding any other provision of law, a State agency may, with the approval of the Secretary, issue benefits under this chapter to an individual who is ineligible to participate in the supplemental nutrition assistance program solely as a result of section 2015(<i>o</i>)(2) of this title or section 1612 or 1613 of title 8.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5243ed5c-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/i/2"><num value="2" class="bold">(2)</num><heading class="bold"> State payments to Secretary</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5243ed5d-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/i/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau>Not later than the date the State agency issues benefits to individuals under this subsection, the State agency shall pay the Secretary, in accordance with procedures established by the Secretary, an amount that is equal to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id5243ed5e-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/i/2/A/i"><num value="i">(i)</num><content> the value of the benefits; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5243ed5f-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/i/2/A/ii"><num value="ii">(ii)</num><content> the costs of issuing and redeeming benefits, and other Federal costs, incurred in providing the benefits, as determined by the Secretary.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5243ed60-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/i/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Crediting</heading><content><p style="-uslm-lc:I13" class="indent2">Notwithstanding <ref href="/us/usc/t31/s3302/b">section 3302(b) of title 31</ref>, payments received under subparagraph (A) shall be credited to the supplemental nutrition assistance program appropriation account or the account from which the costs were drawn, as appropriate, for the fiscal year in which the payment is received.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5243ed61-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/i/3"><num value="3" class="bold">(3)</num><heading class="bold"> Reporting</heading><content><p style="-uslm-lc:I12" class="indent1">To be eligible to issue benefits under this subsection, a State agency shall comply with reporting requirements established by the Secretary to carry out this subsection.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5243ed62-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/i/4"><num value="4" class="bold">(4)</num><heading class="bold"> Plan</heading><chapeau>To be eligible to issue benefits under this subsection, a State agency shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id5243ed63-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/i/4/A"><num value="A">(A)</num><content> submit a plan to the Secretary that describes the conditions and procedures under which the benefits will be issued, including eligibility standards, benefit levels, and the methodology the State agency will use to determine amounts due the Secretary under paragraph (2); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5243ed64-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/i/4/B"><num value="B">(B)</num><content> obtain the approval of the Secretary for the plan.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5243ed65-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/i/5"><num value="5" class="bold">(5)</num><heading class="bold"> Violations</heading><content><p style="-uslm-lc:I12" class="indent1">A sanction, disqualification, fine, or other penalty prescribed under Federal law (including sections 2021 and 2024 of this title) shall apply to a violation committed in connection with a benefit issued under this subsection.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5243ed66-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/i/6"><num value="6" class="bold">(6)</num><heading class="bold"> Ineligibility for administrative reimbursement</heading><content><p style="-uslm-lc:I12" class="indent1">Administrative and other costs incurred in issuing a benefit under this subsection shall not be eligible for Federal funding under this chapter.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5243ed67-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/i/7"><num value="7" class="bold">(7)</num><heading class="bold"> Exclusion from enhanced payment accuracy systems</heading><content><p style="-uslm-lc:I12" class="indent1"><ref href="/us/usc/t7/s2025/c">Section 2025(c) of this title</ref> shall not apply to benefits issued under this subsection.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id5243ed68-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j"><num value="j" class="bold">(j)</num><heading class="bold"> Interoperability and portability of electronic benefit transfer transactions</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5243ed69-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/1"><num value="1" class="bold">(1)</num><heading class="bold"> Definitions</heading><chapeau>In this subsection:</chapeau><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5243ed6a-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Electronic benefit transfer card</heading><content><p style="-uslm-lc:I13" class="indent2">The term “electronic benefit transfer card” means a card that provides benefits under this chapter through an electronic benefit transfer service (as defined in subsection (h)(11)(A) of this section).</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5243ed6b-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Electronic benefit transfer contract</heading><content><p style="-uslm-lc:I13" class="indent2">The term “electronic benefit transfer contract” means a contract that provides for the issuance, use, or redemption of program benefits in the form of electronic benefit transfer cards.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5243ed6c-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Interoperability</heading><content><p style="-uslm-lc:I13" class="indent2">The term “interoperability” means a system that enables program benefits in the form of an electronic benefit transfer card to be redeemed in any State.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5243ed6d-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/1/D"><num value="D" class="bold">(D)</num><heading class="bold"> Interstate transaction</heading><content><p style="-uslm-lc:I13" class="indent2">The term “interstate transaction” means a transaction that is initiated in 1 State by the use of an electronic benefit transfer card that is issued in another State.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5243ed6e-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/1/E"><num value="E" class="bold">(E)</num><heading class="bold"> Portability</heading><content><p style="-uslm-lc:I13" class="indent2">The term “portability” means a system that enables program benefits in the form of an electronic benefit transfer card to be used in any State by a household to purchase food at a retail food store or wholesale food concern approved under this chapter.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5243ed6f-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/1/F"><num value="F" class="bold">(F)</num><heading class="bold"> Settling</heading><content><p style="-uslm-lc:I13" class="indent2">The term “settling” means movement, and reporting such movement, of funds from an electronic benefit transfer card issuer that is located in 1 State to a retail food store, or wholesale food concern, that is located in another State, to accomplish an interstate transaction.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5243ed70-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/1/G"><num value="G" class="bold">(G)</num><heading class="bold"> Smart card</heading><content><p style="-uslm-lc:I13" class="indent2">The term “smart card” means an intelligent benefit card described in <ref href="/us/usc/t7/s2026/f">section 2026(f) of this title</ref>.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5243ed71-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/1/H"><num value="H" class="bold">(H)</num><heading class="bold"> Switching</heading><content><p style="-uslm-lc:I13" class="indent2">The term “switching” means the routing of an interstate transaction that consists of transmitting the details of a transaction electronically recorded through the use of an electronic benefit transfer card in 1 State to the issuer of the card that is in another State.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5243ed72-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/2"><num value="2" class="bold">(2)</num><heading class="bold"> Requirement</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than <date date="2002-10-01">October 1, 2002</date>, the Secretary shall ensure that systems that provide for the electronic issuance, use, and redemption of program benefits in the form of electronic benefit transfer cards are interoperable, and supplemental nutrition assistance program benefits are portable, among all States.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5243ed73-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/3"><num value="3" class="bold">(3)</num><heading class="bold"> Cost</heading><content><p style="-uslm-lc:I12" class="indent1">The cost of achieving the interoperability and portability required under paragraph (2) shall not be imposed on any retail store, or any wholesale food concern, approved to participate in the supplemental nutrition assistance program.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5243ed74-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/4"><num value="4" class="bold">(4)</num><heading class="bold"> Standards</heading><chapeau>Not later than 210 days after <date date="2000-02-11">February 11, 2000</date>, the Secretary shall promulgate regulations that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id5243ed75-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/4/A"><num value="A">(A)</num><content> adopt a uniform national standard of interoperability and portability required under paragraph (2) that is based on the standard of interoperability and portability used by a majority of State agencies; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5243ed76-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/4/B"><num value="B">(B)</num><content> require that any electronic benefit transfer contract that is entered into 30 days or more after the regulations are promulgated, by or on behalf of a State agency, provide for the interoperability and portability required under paragraph (2) in accordance with the national standard.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5243ed77-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/5"><num value="5" class="bold">(5)</num><heading class="bold"> Exemptions</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5243ed78-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/5/A"><num value="A" class="bold">(A)</num><heading class="bold"> Contracts</heading><chapeau>The requirements of paragraph (2) shall not apply to the transfer of benefits under an electronic benefit transfer contract before the expiration of the term of the contract if the contract—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id5243ed79-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/5/A/i"><num value="i">(i)</num><content> is entered into before the date that is 30 days after the regulations are promulgated under paragraph (4); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5243ed7a-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/5/A/ii"><num value="ii">(ii)</num><content> expires after <date date="2002-10-01">October 1, 2002</date>.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5243ed7b-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/5/B"><num value="B" class="bold">(B)</num><heading class="bold"> Waiver</heading><chapeau>At the request of a State agency, the Secretary may provide 1 waiver to temporarily exempt, for a period ending on or before the date specified under clause (iii), the State agency from complying with the requirements of paragraph (2), if the State agency—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id5243ed7c-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/5/B/i"><num value="i">(i)</num><content> establishes to the satisfaction of the Secretary that the State agency faces unusual technological barriers to achieving by <date date="2002-10-01">October 1, 2002</date>, the interoperability and portability required under paragraph (2);</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5243ed7d-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/5/B/ii"><num value="ii">(ii)</num><content> demonstrates that the best interest of the supplemental nutrition assistance program would be served by granting the waiver with respect to the electronic benefit transfer system used by the State agency to administer the supplemental nutrition assistance program; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5243ed7e-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/5/B/iii"><num value="iii">(iii)</num><content> specifies a date by which the State agency will achieve the interoperability and portability required under paragraph (2).</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5243ed7f-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/5/C"><num value="C" class="bold">(C)</num><heading class="bold"> Smart card systems</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall allow a State agency that is using smart cards for the delivery of supplemental nutrition assistance program benefits to comply with the requirements of paragraph (2) at such time after <date date="2002-10-01">October 1, 2002</date>, as the Secretary determines that a practicable technological method is available for interoperability with electronic benefit transfer cards.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5243ed80-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/6"><num value="6" class="bold">(6)</num><heading class="bold"> Funding</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5243ed81-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/6/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau>In accordance with regulations promulgated by the Secretary, the Secretary shall pay 100 percent of the costs incurred by a State agency under this chapter for switching and settling interstate transactions—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id5243ed82-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/6/A/i"><num value="i">(i)</num><content> incurred after <date date="2000-02-11">February 11, 2000</date>, and before <date date="2002-10-01">October 1, 2002</date>, if the State agency uses the standard of interoperability and portability adopted by a majority of State agencies; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5243ed83-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/6/A/ii"><num value="ii">(ii)</num><content> incurred after <date date="2002-09-30">September 30, 2002</date>, if the State agency uses the uniform national standard of interoperability and portability adopted under paragraph (4)(A).</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5243ed84-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/j/6/B"><num value="B" class="bold">(B)</num><heading class="bold"> Limitation</heading><content><p style="-uslm-lc:I13" class="indent2">The total amount paid to State agencies for each fiscal year under subparagraph (A) shall not exceed $500,000.</p>
</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id5243ed85-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/k"><num value="k" class="bold">(k)</num><heading class="bold"> Option to accept program benefits through on-line transactions</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5243ed86-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/k/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Subject to paragraph (4), the Secretary shall approve retail food stores to accept benefits from recipients of supplemental nutrition assistance through on-line transactions.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5243ed87-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/k/2"><num value="2" class="bold">(2)</num><heading class="bold"> Requirements to accept benefits</heading><chapeau>A retail food store seeking to accept benefits from recipients of supplemental nutrition assistance through on-line transactions shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id5243ed88-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/k/2/A"><num value="A">(A)</num><content> establish recipient protections regarding privacy, ease of use, access, and support similar to the protections provided for transactions made in retail food stores;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5243ed89-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/k/2/B"><num value="B">(B)</num><content> ensure benefits are not used to pay delivery, ordering, convenience, or other fees or charges;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5243ed8a-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/k/2/C"><num value="C">(C)</num><chapeau> clearly notify participating households at the time a food order is placed—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id5243ed8b-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/k/2/C/i"><num value="i">(i)</num><content> of any delivery, ordering, convenience, or other fee or charge associated with the food purchase; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5243ed8c-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/k/2/C/ii"><num value="ii">(ii)</num><content> that any such fee cannot be paid with benefits provided under this chapter;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5243ed8d-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/k/2/D"><num value="D">(D)</num><content> ensure the security of on-line transactions by using the most effective technology available that the Secretary considers appropriate and cost-effective and that is comparable to the security of transactions at retail food stores; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5243ed8e-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/k/2/E"><num value="E">(E)</num><content> meet other criteria as established by the Secretary.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5243ed8f-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/k/3"><num value="3" class="bold">(3)</num><heading class="bold"> State agency action</heading><content><p style="-uslm-lc:I12" class="indent1">Each State agency shall ensure that recipients of supplemental nutrition assistance can use benefits on-line as described in this subsection as appropriate.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5243ed90-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/k/4"><num value="4" class="bold">(4)</num><heading class="bold"> Demonstration project on acceptance of benefits through on-line transactions</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5243ed91-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/k/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Before the Secretary authorizes implementation of paragraph (1) in all States, the Secretary shall carry out a number of demonstration projects as determined by the Secretary to test the feasibility of allowing retail food stores to accept benefits through on-line transactions.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5243ed92-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/k/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Demonstration projects</heading><chapeau>To be eligible to participate in a demonstration project under subparagraph (A), a retail food store shall submit to the Secretary for approval a plan that includes—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id5243ed93-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/k/4/B/i"><num value="i">(i)</num><content> a method of ensuring that benefits may be used to purchase only eligible items under this chapter;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5243ed94-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/k/4/B/ii"><num value="ii">(ii)</num><content> a description of the method of educating participant households about the availability and operation of on-line purchasing;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5243ed95-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/k/4/B/iii"><num value="iii">(iii)</num><content> adequate testing of the on-line purchasing option prior to implementation;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5243ed96-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/k/4/B/iv"><num value="iv">(iv)</num><content> the provision of data as requested by the Secretary for purposes of analyzing the impact of the project on participant access, ease of use, and program integrity;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5243ed97-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/k/4/B/v"><num value="v">(v)</num><content> reports on progress, challenges, and results, as determined by the Secretary; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5243ed98-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s2016/k/4/B/vi"><num value="vi">(vi)</num><content> such other criteria, including security criteria, as established by the Secretary.</content>

</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">(A)</num><content> specifies the number of State agencies that have entered into an EBT-system contract with multiple EBT-system vendors; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><content> describes, for each State agency described in subparagraph (A), how responsibilities are divided among the various vendors;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><chapeau> with respect to any State in which an EBT system is not operational throughout the State as of <date date="2002-10-01">October 1, 2002</date>—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> provides an explanation of the reasons why an EBT system is not operational throughout the State;</content>
