<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id06eeb971-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s20"><num value="20">§ 20.</num><heading> Market reports</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id06eeb972-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s20/a"><num value="a" class="bold">(a)</num><heading class="bold"> Information</heading><content><p style="-uslm-lc:I11" class="indent0">The Commission may conduct regular investigations of the markets for goods, articles, services, rights, and interests which are the subject of futures contracts, and furnish reports of the findings of these investigations to the public on a regular basis. These market reports shall, where appropriate, include information on the supply, demand, prices, and other conditions in the United States and other countries with respect to such goods, articles, services, rights, interests, and information respecting the futures markets.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id06eeb973-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s20/b"><num value="b" class="bold">(b)</num><heading class="bold"> Avoidance of duplication</heading><content><p style="-uslm-lc:I11" class="indent0">The Commission shall cooperate with the Department of Agriculture and any other Department or Federal agency which makes market investigations to avoid unnecessary duplication of information-gathering activities.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id06eee084-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s20/c"><num value="c" class="bold">(c)</num><heading class="bold"> Furnishing of information; confidentiality</heading><content><p style="-uslm-lc:I11" class="indent0">The Department of Agriculture and any other Department or Federal agency which has market information sought by the Commission shall furnish it to the Commission upon the request of any authorized employee of the Commission. The Commission shall abide by any rules of confidentiality applying to such information.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id06eee085-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s20/d"><num value="d" class="bold">(d)</num><heading class="bold"> Disclosure of business transactions, market positions, trade secrets, or names of customers</heading><content><p style="-uslm-lc:I11" class="indent0">The Commission shall not disclose in such reports data and information which would separately disclose the business transactions or market positions of any person and trade secrets or names of customers except as provided in <ref href="/us/usc/t7/s12">section 12 of this title</ref>.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id06eee086-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s20/e"><num value="e" class="bold">(e)</num><heading class="bold"> Application</heading><content><p style="-uslm-lc:I11" class="indent0">This section shall not apply to investigations involving any security underlying a security futures product.</p>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><chapeau> the effect of the trading in contracts for the future delivery of live cattle on—</chapeau><clause style="-uslm-lc:I23" class="indent2"><num value="i">“(i)</num><content> the price relationship between feeder cattle and fed cattle;</content>

<clause style="-uslm-lc:I23" class="indent2"><num value="ii">“(ii)</num><content> the price discovery process with respect to live cattle; and</content>
</clause>
<clause style="-uslm-lc:I23" class="indent2"><num value="iii">“(iii)</num><content> price competition within the cattle industry;</content>
</clause>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> the effect of the use of packer contracts, as a means of obtaining slaughter cattle, on the increase in short hedging in contracts for the future delivery of live cattle and the effect of this increase in short hedging on prices in the futures and cash markets;</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> the effect on the ability of the cash markets to accurately reflect prevailing conditions of supply and demand if packer contracts become the prevalent method of marketing fed cattle;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> whether the present delivery system for contracts for the future delivery of live cattle creates any bias (either upward or downward) in the cash price for cattle;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="6">“(6)</num><content> whether the present delivery system for contracts for the future delivery of live cattle creates price volatility during the delivery month; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="7">“(7)</num><content> whether there are advantages or disadvantages to a cash settlement system in lieu of the present delivery system in the case of contracts for the future delivery of live cattle.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Reports.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Preliminary report</inline>.—</heading><content>Not later than <date date="1987-01-15">January 15, 1987</date>, the Comptroller General shall submit a preliminary report on the results of the study required under subsection (a) to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Final report</inline>.—</heading><content>Not later than 1 year after the date of enactment of this Act [<date date="1986-11-10">Nov. 10, 1986</date>], the Comptroller General shall submit to such committees a detailed final report of the results of the study required under subsection (a).”</content>
