<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id3583fd40-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2157"><num value="2157">§ 2157.</num><heading> Release of trade secrets</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id3583fd41-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2157/a"><num value="a" class="bold">(a)</num><heading class="bold"> Release of confidential information prohibited</heading><chapeau style="-uslm-lc:I11" class="indent0">It shall be unlawful for any member of an Institutional Animal Committee to release any confidential information of the research facility including any information that concerns or relates to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3583fd42-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2157/a/1"><num value="1">(1)</num><content> the trade secrets, processes, operations, style of work, or apparatus; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3583fd43-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2157/a/2"><num value="2">(2)</num><content> the identity, confidential statistical data, amount or source of any income, profits, losses, or expenditures,</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">of the research facility.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id3583fd44-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2157/b"><num value="b" class="bold">(b)</num><heading class="bold"> Wrongful use of confidential information prohibited</heading><chapeau style="-uslm-lc:I11" class="indent0">It shall be unlawful for any member of such Committee—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3583fd45-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2157/b/1"><num value="1">(1)</num><content> to use or attempt to use to his advantages; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3583fd46-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2157/b/2"><num value="2">(2)</num><content> to reveal to any other person,</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">any information which is entitled to protection as confidential information under subsection (a).</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id3583fd47-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2157/c"><num value="c" class="bold">(c)</num><heading class="bold"> Penalties</heading><chapeau style="-uslm-lc:I11" class="indent0">A violation of subsection (a) or (b) is punishable by—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3583fd48-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2157/c/1"><num value="1">(1)</num><content> removal from such Committee; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3583fd49-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2157/c/2"><num value="2">(2)</num><subparagraph style="-uslm-lc:I12" class="indent1" id="id3583fd4a-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2157/c/2/A"><num value="A">(A)</num><content> a fine of not more than $1,000 and imprisonment of not more than one year; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id3583fd4b-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2157/c/2/B"><num value="B">(B)</num><content> if such violation is willful, a fine of not more than $10,000 and imprisonment of not more than three years.</content>
</subparagraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id3583fd4c-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2157/d"><num value="d" class="bold">(d)</num><heading class="bold"> Recovery of damages by injured person; costs; attorney’s fee</heading><content><p style="-uslm-lc:I11" class="indent0">Any person, including any research facility, injured in its business or property by reason of a violation of this section may recover all actual and consequential damages sustained by such person and the cost of the suit including a reasonable attorney’s fee.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id3583fd4d-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s2157/e"><num value="e" class="bold">(e)</num><heading class="bold"> Other rights and remedies</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this section shall be construed to affect any other rights of a person injured in its business or property by reason of a violation of this section. Subsection (d) shall not be construed to limit the exercise of any such rights arising out of or relating to a violation of subsections (a) and (b).</p>
