<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idf0500e5a-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s2276"><num value="2276">§ 2276.</num><heading> Confidentiality of information</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf0500e5b-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s2276/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">In the case of information furnished under a provision of law referred to in subsection (d), neither the Secretary of Agriculture, any other officer or employee of the Department of Agriculture or agency thereof, nor any other person may—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idf0500e5c-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s2276/a/1"><num value="1">(1)</num><content> use such information for a purpose other than the development or reporting of aggregate data in a manner such that the identity of the person who supplied such information is not discernible and is not material to the intended uses of such information;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf0500e5d-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s2276/a/2"><num value="2">(2)</num><content> disclose such information to the public, unless such information has been transformed into a statistical or aggregate form that does not allow the identification of the person who supplied particular information; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf0500e5e-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s2276/a/3"><num value="3">(3)</num><content> in the case of information collected under the authority described in paragraph (12) or (13) of subsection (d), disclose the information to any person or any Federal, State, local, or tribal agency outside the Department of Agriculture, unless the information has been converted into a statistical or aggregate form that does not allow the identification of the person that supplied particular information.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf0500e5f-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s2276/b"><num value="b" class="bold">(b)</num><heading class="bold"> Duty of Secretary; immunity from disclosure; necessary consent</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idf0500e60-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s2276/b/1"><num value="1">(1)</num><content> In carrying out a provision of law referred to in subsection (d), no department, agency, officer, or employee of the Federal Government, other than the Secretary of Agriculture, shall require a person to furnish a copy of statistical information provided to the Department of Agriculture.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idf0500e61-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s2276/b/2"><num value="2">(2)</num><chapeau> A copy of such information—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idf0500e62-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s2276/b/2/A"><num value="A">(A)</num><content> shall be immune from mandatory disclosure of any type, including legal process; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idf0500e63-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s2276/b/2/B"><num value="B">(B)</num><content> shall not, without the consent of such person, be admitted as evidence or used for any purpose in any action, suit, or other judicial or administrative proceeding.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf0500e64-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s2276/c"><num value="c" class="bold">(c)</num><heading class="bold"> Violations; penalties</heading><content><p style="-uslm-lc:I11" class="indent0">Any person who shall publish, cause to be published, or otherwise publicly release information collected pursuant to a provision of law referred to in subsection (d), in any manner or for any purpose prohibited in section <ref class="footnoteRef" idref="fn002254">1</ref><note type="footnote" id="fn002254"><num>1</num> So in original. Probably should be “subsection”.</note> (a), shall be fined not more than $10,000 or imprisoned for not more than 1 year, or both.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf0500e65-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s2276/d"><num value="d" class="bold">(d)</num><heading class="bold"> Provisions of law references</heading><chapeau style="-uslm-lc:I11" class="indent0">For purposes of this section, a provision of law referred to in this subsection means—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idf0500e66-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s2276/d/1"><num value="1">(1)</num><content> the first section of the Act entitled “An Act authorizing the Secretary of Agriculture to collect and publish statistics of the grade and staple length of cotton”, approved <date date="1927-03-03">March 3, 1927</date> (<ref href="/us/usc/t7/s471">7 U.S.C. 471</ref>) (commonly referred to as the “Cotton Statistics and Estimates Act”);</content>
