<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idbc3c89ab-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229"><num value="229">§ 229.</num><heading> Annual report</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idbc3c89ac-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau>Not later than March 1 of each year, the Secretary shall submit to Congress and make publicly available a report that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idbc3c89ad-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229/a/1"><num value="1">(1)</num><chapeau> states, for the preceding year, separately for livestock and poultry and separately by enforcement area category (financial, trade practice, or competitive acts and practices), with respect to investigations into possible violations of this chapter—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idbc3c89ae-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229/a/1/A"><num value="A">(A)</num><content> the number of investigations opened;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbc3c89af-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229/a/1/B"><num value="B">(B)</num><content> the number of investigations that were closed or settled without a referral to the General Counsel of the Department of Agriculture;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbc3c89b0-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229/a/1/C"><num value="C">(C)</num><content> for investigations described in subparagraph (B), the length of time from initiation of the investigation to when the investigation was closed or settled without the filing of an enforcement complaint;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbc3c89b1-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229/a/1/D"><num value="D">(D)</num><content> the number of investigations that resulted in referral to the General Counsel of the Department of Agriculture for further action, the number of such referrals resolved without administrative enforcement action, and the number of enforcement actions filed by the General Counsel;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbc3c89b2-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229/a/1/E"><num value="E">(E)</num><content> for referrals to the General Counsel that resulted in an administrative enforcement action being filed, the length of time from the referral to the filing of the administrative action;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbc3c89b3-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229/a/1/F"><num value="F">(F)</num><content> for referrals to the General Counsel that resulted in an administrative enforcement action being filed, the length of time from filing to resolution of the administrative enforcement action;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbc3c89b4-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229/a/1/G"><num value="G">(G)</num><content> the number of investigations that resulted in referral to the Department of Justice for further action, and the number of civil enforcement actions filed by the Department of Justice on behalf of the Secretary pursuant to such a referral;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbc3c89b5-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229/a/1/H"><num value="H">(H)</num><content> for referrals that resulted in a civil enforcement action being filed by the Department of Justice, the length of time from the referral to the filing of the enforcement action;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbc3c89b6-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229/a/1/I"><num value="I">(I)</num><content> for referrals that resulted in a civil enforcement action being filed by the Department of Justice, the length of time from the filing of the enforcement action to resolution; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbc3c89b7-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229/a/1/J"><num value="J">(J)</num><content> the average civil penalty imposed in administrative or civil enforcement actions for violations of this chapter, and the total amount of civil penalties imposed in all such enforcement actions; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbc3c89b8-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229/a/2"><num value="2">(2)</num><content> includes any other additional information the Secretary considers important to include in the annual report.</content>
