<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idbc3ef9c6-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229b"><num value="229b">§ 229b.</num><heading> Right to discuss terms of contract</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idbc3ef9c7-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229b/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definitions</heading><chapeau>In this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idbc3ef9c8-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229b/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Producer</heading><content><p style="-uslm-lc:I12" class="indent1">The term “producer” means any person engaged in the raising and caring for livestock or poultry for slaughter.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idbc3ef9c9-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229b/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Processor</heading><content><p style="-uslm-lc:I12" class="indent1">The term “processor” means any person engaged in the business of obtaining livestock or poultry for the purpose of slaughtering the livestock or poultry.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idbc3ef9ca-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229b/b"><num value="b" class="bold">(b)</num><heading class="bold"> No prohibition of discussion</heading><chapeau>Notwithstanding a provision in any contract between a producer and a processor for the production of livestock or poultry, or in any marketing agreement between a producer and a processor for the sale of livestock or poultry for a term of 1 year or more, that provides that information contained in the contract is confidential, a party to the contract shall not be prohibited from discussing any terms or details of the contract with—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idbc3ef9cb-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229b/b/1"><num value="1">(1)</num><content> a Federal or State agency;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbc3ef9cc-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229b/b/2"><num value="2">(2)</num><content> a legal adviser to the party;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbc3ef9cd-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229b/b/3"><num value="3">(3)</num><content> a lender to the party;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbc3ef9ce-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229b/b/4"><num value="4">(4)</num><content> an accountant hired by the party;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbc3ef9cf-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229b/b/5"><num value="5">(5)</num><content> an executive or manager of the party;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbc3ef9d0-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229b/b/6"><num value="6">(6)</num><content> a landlord of the party; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbc3ef9d1-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229b/b/7"><num value="7">(7)</num><content> a member of the immediate family of the party.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idbc3ef9d2-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229b/c"><num value="c" class="bold">(c)</num><heading class="bold"> Effect on State laws</heading><chapeau>Subsection (b) of this section does not—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idbc3ef9d3-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229b/c/1"><num value="1">(1)</num><content> preempt any State law that addresses confidentiality provisions in contracts for the sale or production of livestock or poultry, except any provision of State law that makes lawful a contract provision that prohibits a party from, or limits a party in, engaging in discussion that subsection (b) of this section requires to be permitted; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbc3ef9d4-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229b/c/2"><num value="2">(2)</num><content> deprive any State court of jurisdiction under any such State law.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idbc3ef9d5-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s229b/d"><num value="d" class="bold">(d)</num><heading class="bold"> Applicability</heading><content><p style="-uslm-lc:I11" class="indent0">This section applies to each contract described in subsection (b) of this section that is entered into, amended, renewed, or extended after <date date="2002-05-13">May 13, 2002</date>.</p>
