<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idbbb271a0-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s24"><num value="24">§ 24.</num><heading> Customer property with respect to commodity broker debtors; definitions</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idbbb271a1-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s24/a"><num value="a" class="bold">(a)</num><heading class="bold"> Regulations respecting commodity broker debtors</heading><chapeau>Notwithstanding title 11, the Commission may provide, with respect to a commodity broker that is a debtor under chapter 7 of title 11, by rule or regulation—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idbbb271a2-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s24/a/1"><num value="1">(1)</num><content> that certain cash, securities, other property, or commodity contracts are to be included in or excluded from customer property or member property;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbbb271a3-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s24/a/2"><num value="2">(2)</num><content> that certain cash, securities, other property, or commodity contracts are to be specifically identifiable to a particular customer in a specific capacity;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbbb271a4-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s24/a/3"><num value="3">(3)</num><content> the method by which the business of such commodity broker is to be conducted or liquidated after the date of the filing of the petition under such chapter, including the payment and allocation of margin with respect to commodity contracts not specifically identifiable to a particular customer pending their orderly liquidation;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idbbb271a5-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s24/a/4"><num value="4">(4)</num><content> any persons to which customer property and commodity contracts may be transferred under <ref href="/us/usc/t11/s766">section 766 of title 11</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbbb271a6-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s24/a/5"><num value="5">(5)</num><content> how the net equity of a customer is to be determined.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idbbb271a7-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s24/b"><num value="b" class="bold">(b)</num><heading class="bold"> Definitions</heading><content><p style="-uslm-lc:I11" class="indent0">As used in this section, the terms “commodity broker”, “commodity contract”, “customer”, “customer property”, “member property”, “net equity”, and “security” have the meanings assigned such terms for the purposes of subchapter IV of chapter 7 of title 11.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idbbb271a8-aaf5-11e3-a8cb-a7a72594c0f9" identifier="/us/usc/t7/s24/c"><num value="c" class="bold">(c)</num><heading class="bold"> Portfolio margining accounts</heading><content><p style="-uslm-lc:I11" class="indent0">The Commission shall exercise its authority to ensure that securities held in a portfolio margining account carried as a futures account are customer property and the owners of those accounts are customers for the purposes of subchapter IV of chapter 7 of title 11.</p>
