<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id69bd1168-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s252"><num value="252">§ 252.</num><heading> Suspension or revocation of licenses</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id69bd1169-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s252/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau>After providing notice and an opportunity for a hearing in accordance with this section, the Secretary may suspend or revoke any license issued, or approval for an activity provided, under this chapter—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id69bd116a-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s252/a/1"><num value="1">(1)</num><content> for a material violation of, or failure to comply, with any provision of this chapter (including regulations promulgated under this chapter); or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id69bd116b-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s252/a/2"><num value="2">(2)</num><content> on the ground that unreasonable or exorbitant charges have been imposed for services rendered.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id69bd116c-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s252/b"><num value="b" class="bold">(b)</num><heading class="bold"> Temporary suspension</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary may temporarily suspend a license or approval for an activity under this chapter prior to an opportunity for a hearing for any violation of, or failure to comply with, any provision of this chapter (including regulations promulgated under this chapter).</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id69bd116d-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s252/c"><num value="c" class="bold">(c)</num><heading class="bold"> Authority to conduct hearings</heading><content><p style="-uslm-lc:I11" class="indent0">The agency within the Department that is responsible for administering regulations promulgated under this chapter shall have exclusive authority to conduct any hearing required under this section.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id69bd116e-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s252/d"><num value="d" class="bold">(d)</num><heading class="bold"> Judicial review</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id69bd116f-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s252/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Jurisdiction</heading><content><p style="-uslm-lc:I12" class="indent1">A final administrative determination issued subsequent to a hearing may be reviewable only in a district court of the United States.</p>
