<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id6988bb25-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26"><num value="26">§ 26.</num><heading> Commodity whistleblower incentives and protection</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6988bb26-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definitions</heading><chapeau>In this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6988bb27-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Covered judicial or administrative action</heading><content><p style="-uslm-lc:I12" class="indent1">The term “covered judicial or administrative action” means any judicial or administrative action brought by the Commission under this chapter that results in monetary sanctions exceeding $1,000,000.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6988bb28-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Fund</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Fund” means the Commodity Futures Trading Commission Customer Protection Fund established under subsection (g).</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6988bb29-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Monetary sanctions</heading><chapeau>The term “monetary sanctions”, when used with respect to any judicial or administrative action means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6988bb2a-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/a/3/A"><num value="A">(A)</num><content> any monies, including penalties, disgorgement, restitution, and interest ordered to be paid; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6988bb2b-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/a/3/B"><num value="B">(B)</num><content> any monies deposited into a disgorgement fund or other fund pursuant to <ref href="/us/usc/t15/s7246/b">section 7246(b) of title 15</ref>, as a result of such action or any settlement of such action.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6988bb2c-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> Original information</heading><chapeau>The term “original information” means information that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6988bb2d-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/a/4/A"><num value="A">(A)</num><content> is derived from the independent knowledge or analysis of a whistleblower;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6988bb2e-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/a/4/B"><num value="B">(B)</num><content> is not known to the Commission from any other source, unless the whistleblower is the original source of the information; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6988bb2f-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/a/4/C"><num value="C">(C)</num><content> is not exclusively derived from an allegation made in a judicial or administrative hearing, in a governmental report, hearing, audit, or investigation, or from the news media, unless the whistleblower is a source of the information.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6988bb30-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/a/5"><num value="5" class="bold">(5)</num><heading class="bold"> Related action</heading><content><p style="-uslm-lc:I12" class="indent1">The term “related action”, when used with respect to any judicial or administrative action brought by the Commission under this chapter, means any judicial or administrative action brought by an entity described in subclauses (I) through (VI) of subsection (h)(2)(C) that is based upon the original information provided by a whistleblower pursuant to subsection (a) that led to the successful enforcement of the Commission action.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6988bb31-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/a/6"><num value="6" class="bold">(6)</num><heading class="bold"> Successful resolution</heading><content><p style="-uslm-lc:I12" class="indent1">The term “successful resolution”, when used with respect to any judicial or administrative action brought by the Commission under this chapter, includes any settlement of such action.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6988bb32-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/a/7"><num value="7" class="bold">(7)</num><heading class="bold"> Whistleblower</heading><content><p style="-uslm-lc:I12" class="indent1">The term “whistleblower” means any individual, or 2 or more individuals acting jointly, who provides information relating to a violation of this chapter to the Commission, in a manner established by rule or regulation by the Commission.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6988bb33-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/b"><num value="b" class="bold">(b)</num><heading class="bold"> Awards</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6988bb34-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau>In any covered judicial or administrative action, or related action, the Commission, under regulations prescribed by the Commission and subject to subsection (c), shall pay an award or awards to 1 or more whistleblowers who voluntarily provided original information to the Commission that led to the successful enforcement of the covered judicial or administrative action, or related action, in an aggregate amount equal to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6988bb35-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/b/1/A"><num value="A">(A)</num><content> not less than 10 percent, in total, of what has been collected of the monetary sanctions imposed in the action or related actions; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6988bb36-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/b/1/B"><num value="B">(B)</num><content> not more than 30 percent, in total, of what has been collected of the monetary sanctions imposed in the action or related actions.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6988bb37-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Payment of awards</heading><content><p style="-uslm-lc:I12" class="indent1">Any amount paid under paragraph (1) shall be paid from the Fund.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6988bb38-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/c"><num value="c" class="bold">(c)</num><heading class="bold"> Determination of amount of award; denial of award</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6988bb39-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Determination of amount of award</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6988bb3a-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/c/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Discretion</heading><content><p style="-uslm-lc:I13" class="indent2">The determination of the amount of an award made under subsection (b) shall be in the discretion of the Commission.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6988bb3b-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/c/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Criteria</heading><chapeau>In determining the amount of an award made under subsection (b), the Commission—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id6988bb3c-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/c/1/B/i"><num value="i">(i)</num><chapeau> shall take into consideration—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id6988bb3d-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/c/1/B/i/I"><num value="I">(I)</num><content> the significance of the information provided by the whistleblower to the success of the covered judicial or administrative action;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id6988bb3e-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/c/1/B/i/II"><num value="II">(II)</num><content> the degree of assistance provided by the whistleblower and any legal representative of the whistleblower in a covered judicial or administrative action;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id6988bb3f-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/c/1/B/i/III"><num value="III">(III)</num><content> the programmatic interest of the Commission in deterring violations of the <ref class="footnoteRef" idref="fn002060">1</ref><note type="footnote" id="fn002060"><num>1</num> So in original. Probably should be “this”.</note> chapter (including regulations under the <ref class="footnoteRef" idref="fn002060">1</ref> chapter) by making awards to whistleblowers who provide information that leads to the successful enforcement of such laws; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id6988bb40-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/c/1/B/i/IV"><num value="IV">(IV)</num><content> such additional relevant factors as the Commission may establish by rule or regulation; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6988bb41-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/c/1/B/ii"><num value="ii">(ii)</num><content> shall not take into consideration the balance of the Fund.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6988bb42-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Denial of award</heading><chapeau>No award under subsection (b) shall be made—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6988bb43-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/c/2/A"><num value="A">(A)</num><chapeau> to any whistleblower who is, or was at the time the whistleblower acquired the original information submitted to the Commission, a member, officer, or employee of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id6988bb44-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/c/2/A/i"><num value="i">(i)</num><content> a appropriate regulatory agency;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6988bb45-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/c/2/A/ii"><num value="ii">(ii)</num><content> the Department of Justice;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6988bb46-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/c/2/A/iii"><num value="iii">(iii)</num><content> a registered entity;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6988bb47-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/c/2/A/iv"><num value="iv">(iv)</num><content> a registered futures association;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6988bb48-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/c/2/A/v"><num value="v">(v)</num><content> a self-regulatory organization as defined in <ref href="/us/usc/t15/s78c/a">section 78c(a) of title 15</ref>; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6988bb49-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/c/2/A/vi"><num value="vi">(vi)</num><content> a law enforcement organization;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6988bb4a-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/c/2/B"><num value="B">(B)</num><content> to any whistleblower who is convicted of a criminal violation related to the judicial or administrative action for which the whistleblower otherwise could receive an award under this section;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6988bb4b-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/c/2/C"><num value="C">(C)</num><content> to any whistleblower who submits information to the Commission that is based on the facts underlying the covered action submitted previously by another whistleblower;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6988bb4c-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/c/2/D"><num value="D">(D)</num><content> to any whistleblower who fails to submit information to the Commission in such form as the Commission may, by rule or regulation, require.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6988bb4d-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/d"><num value="d" class="bold">(d)</num><heading class="bold"> Representation</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6988bb4e-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Permitted representation</heading><content><p style="-uslm-lc:I12" class="indent1">Any whistleblower who makes a claim for an award under subsection (b) may be represented by counsel.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6988bb4f-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Required representation</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6988bb50-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/d/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Any whistleblower who anonymously makes a claim for an award under subsection (b) shall be represented by counsel if the whistleblower submits the information upon which the claim is based.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6988bb51-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/d/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Disclosure of identity</heading><content><p style="-uslm-lc:I13" class="indent2">Prior to the payment of an award, a whistleblower shall disclose the identity of the whistleblower and provide such other information as the Commission may require, directly or through counsel for the whistleblower.</p>
</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6988bb52-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/e"><num value="e" class="bold">(e)</num><heading class="bold"> No contract necessary</heading><content><p style="-uslm-lc:I11" class="indent0">No contract with the Commission is necessary for any whistleblower to receive an award under subsection (b), unless otherwise required by the Commission, by rule or regulation.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6988bb53-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/f"><num value="f" class="bold">(f)</num><heading class="bold"> Appeals</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6988bb54-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Any determination made under this section, including whether, to whom, or in what amount to make awards, shall be in the discretion of the Commission.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6988bb55-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Appeals</heading><content><p style="-uslm-lc:I12" class="indent1">Any determination described in paragraph (1) may be appealed to the appropriate court of appeals of the United States not more than 30 days after the determination is issued by the Commission.</p>

</paragraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6988bb57-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g"><num value="g" class="bold">(g)</num><heading class="bold"> Commodity Futures Trading Commission Customer Protection Fund</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6988bb58-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/1"><num value="1" class="bold">(1)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I12" class="indent1">There is established in the Treasury of the United States a revolving fund to be known as the “Commodity Futures Trading Commission Customer Protection Fund”.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6988bb59-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/2"><num value="2" class="bold">(2)</num><heading class="bold"> Use of Fund</heading><chapeau>The Fund shall be available to the Commission, without further appropriation or fiscal year limitation, for—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6988bb5a-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/2/A"><num value="A">(A)</num><content> the payment of awards to whistleblowers as provided in subsection (a); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id698b044b-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/2/B"><num value="B">(B)</num><content> the funding of customer education initiatives designed to help customers protect themselves against fraud or other violations of this chapter, or the rules and regulations thereunder.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id698b044c-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/3"><num value="3" class="bold">(3)</num><heading class="bold"> Deposits and credits</heading><chapeau>There shall be deposited into or credited to the Fund:</chapeau><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id698b044d-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Monetary sanctions</heading><content><p style="-uslm-lc:I13" class="indent2">Any monetary sanctions collected by the Commission in any covered judicial or administrative action that is not otherwise distributed to victims of a violation of this chapter or the rules and regulations thereunder underlying such action, unless the balance of the Fund at the time the monetary judgment is collected exceeds $100,000,000.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id698b044e-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Additional amounts</heading><content><p style="-uslm-lc:I13" class="indent2">If the amounts deposited into or credited to the Fund under subparagraph (A) are not sufficient to satisfy an award made under subsection (b), there shall be deposited into or credited to the Fund an amount equal to the unsatisfied portion of the award from any monetary sanction collected by the Commission in any judicial or administrative action brought by the Commission under this chapter that is based on information provided by a whistleblower.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id698b044f-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Investment income</heading><content><p style="-uslm-lc:I13" class="indent2">All income from investments made under paragraph (4).</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id698b0450-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/4"><num value="4" class="bold">(4)</num><heading class="bold"> Investments</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id698b0451-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> Amounts in Fund may be invested</heading><content><p style="-uslm-lc:I13" class="indent2">The Commission may request the Secretary of the Treasury to invest the portion of the Fund that is not, in the Commission’s judgment, required to meet the current needs of the Fund.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id698b0452-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Eligible investments</heading><content><p style="-uslm-lc:I13" class="indent2">Investments shall be made by the Secretary of the Treasury in obligations of the United States or obligations that are guaranteed as to principal and interest by the United States, with maturities suitable to the needs of the Fund as determined by the Commission.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id698b0453-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/4/C"><num value="C" class="bold">(C)</num><heading class="bold"> Interest and proceeds credited</heading><content><p style="-uslm-lc:I13" class="indent2">The interest on, and the proceeds from the sale or redemption of, any obligations held in the Fund shall be credited to, and form a part of, the Fund.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id698b0454-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/5"><num value="5" class="bold">(5)</num><heading class="bold"> Reports to Congress</heading><chapeau>Not later than October 30 of each year, the Commission shall transmit to the Committee on Agriculture, Nutrition, and Forestry of the Senate, and the Committee on Agriculture of the House of Representatives a report on—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id698b0455-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/5/A"><num value="A">(A)</num><content> the Commission’s whistleblower award program under this section, including a description of the number of awards granted and the types of cases in which awards were granted during the preceding fiscal year;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id698b0456-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/5/B"><num value="B">(B)</num><content> customer education initiatives described in paragraph (2)(B) that were funded by the Fund during the preceding fiscal year;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id698b0457-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/5/C"><num value="C">(C)</num><content> the balance of the Fund at the beginning of the preceding fiscal year;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id698b0458-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/5/D"><num value="D">(D)</num><content> the amounts deposited into or credited to the Fund during the preceding fiscal year;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id698b0459-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/5/E"><num value="E">(E)</num><content> the amount of earnings on investments of amounts in the Fund during the preceding fiscal year;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id698b045a-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/5/F"><num value="F">(F)</num><content> the amount paid from the Fund during the preceding fiscal year to whistleblowers pursuant to subsection (b);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id698b045b-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/5/G"><num value="G">(G)</num><content> the amount paid from the Fund during the preceding fiscal year for customer education initiatives described in paragraph (2)(B);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id698b045c-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/5/H"><num value="H">(H)</num><content> the balance of the Fund at the end of the preceding fiscal year; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id698b045d-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/g/5/I"><num value="I">(I)</num><content> a complete set of audited financial statements, including a balance sheet, income statement, and cash flow analysis.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id698b045e-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h"><num value="h" class="bold">(h)</num><heading class="bold"> Protection of whistleblowers</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id698b045f-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/1"><num value="1" class="bold">(1)</num><heading class="bold"> Prohibition against retaliation</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id698b0460-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau>No employer may discharge, demote, suspend, threaten, harass, directly or indirectly, or in any other manner discriminate against, a whistleblower in the terms and conditions of employment because of any lawful act done by the whistleblower—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id698b0461-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/1/A/i"><num value="i">(i)</num><content> in providing information to the Commission in accordance with subsection (b); or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id698b0462-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/1/A/ii"><num value="ii">(ii)</num><content> in assisting in any investigation or judicial or administrative action of the Commission based upon or related to such information.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id698b0463-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Enforcement</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id698b0464-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/1/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> Cause of action</heading><content><p style="-uslm-lc:I14" class="indent3">An individual who alleges discharge or other discrimination in violation of subparagraph (A) may bring an action under this subsection in the appropriate district court of the United States for the relief provided in subparagraph (C), unless the individual who is alleging discharge or other discrimination in violation of subparagraph (A) is an employee of the Federal Government, in which case the individual shall only bring an action under <ref href="/us/usc/t5/s1221">section 1221 of title 5</ref>.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id698b0465-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/1/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Subpoenas</heading><content><p style="-uslm-lc:I14" class="indent3">A subpoena requiring the attendance of a witness at a trial or hearing conducted under this subsection may be served at any place in the United States.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id698b0466-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/1/B/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Statute of limitations</heading><content><p style="-uslm-lc:I14" class="indent3">An action under this subsection may not be brought more than 2 years after the date on which the violation reported in subparagraph (A) is committed.</p>

</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id698b0467-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Relief</heading><chapeau>Relief for an individual prevailing in an action brought under subparagraph (B) shall include—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id698b0468-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/1/C/i"><num value="i">(i)</num><content> reinstatement with the same seniority status that the individual would have had, but for the discrimination;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id698b0469-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/1/C/ii"><num value="ii">(ii)</num><content> the amount of back pay otherwise owed to the individual, with interest; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id698b046a-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/1/C/iii"><num value="iii">(iii)</num><content> compensation for any special damages sustained as a result of the discharge or discrimination, including litigation costs, expert witness fees, and reasonable attorney’s fees.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id698b046b-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/2"><num value="2" class="bold">(2)</num><heading class="bold"> Confidentiality</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id698b046c-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Except as provided in subparagraphs (B) and (C), the Commission, and any officer or employee of the Commission, shall not disclose any information, including information provided by a whistleblower to the Commission, which could reasonably be expected to reveal the identity of a whistleblower, except in accordance with the provisions of <ref href="/us/usc/t5/s552a">section 552a of title 5</ref>, unless and until required to be disclosed to a defendant or respondent in connection with a public proceeding instituted by the Commission or any entity described in subparagraph (C). For purposes of <ref href="/us/usc/t5/s552">section 552 of title 5</ref>, this paragraph shall be considered a statute described in subsection (b)(3)(B) of such section 552.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id698b046d-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Effect</heading><content><p style="-uslm-lc:I13" class="indent2">Nothing in this paragraph is intended to limit the ability of the Attorney General to present such evidence to a grand jury or to share such evidence with potential witnesses or defendants in the course of an ongoing criminal investigation.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id698b046e-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Availability to government agencies</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id698b046f-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/2/C/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><chapeau>Without the loss of its status as confidential in the hands of the Commission, all information referred to in subparagraph (A) may, in the discretion of the Commission, when determined by the Commission to be necessary or appropriate to accomplish the purposes of this chapter and protect customers and in accordance with clause (ii), be made available to—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id698b0470-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/2/C/i/I"><num value="I">(I)</num><content> the Department of Justice;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id698b0471-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/2/C/i/II"><num value="II">(II)</num><content> an appropriate department or agency of the Federal Government, acting within the scope of its jurisdiction;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id698b0472-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/2/C/i/III"><num value="III">(III)</num><content> a registered entity, registered futures association, or self-regulatory organization as defined in <ref href="/us/usc/t15/s78c/a">section 78c(a) of title 15</ref>;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id698b0473-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/2/C/i/IV"><num value="IV">(IV)</num><content> a State attorney general in connection with any criminal investigation;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id698b0474-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/2/C/i/V"><num value="V">(V)</num><content> an appropriate department or agency of any State, acting within the scope of its jurisdiction; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id698b0475-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/2/C/i/VI"><num value="VI">(VI)</num><content> a foreign futures authority.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id698b0476-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/2/C/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Maintenance of information</heading><content><p style="-uslm-lc:I14" class="indent3">Each of the entities, agencies, or persons described in clause (i) shall maintain information described in that clause as confidential, in accordance with the requirements in subparagraph (A).</p>

<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id698b0477-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/2/C/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Study on impact of FOIA exemption on Commodity Futures Trading Commission</heading><subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="id698b0478-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/2/C/iii/I"><num value="I" class="bold">(I)</num><heading class="bold"> Study</heading><chapeau>The Inspector General of the Commission shall conduct a study—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="id698b0479-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/2/C/iii/I/aa"><num value="aa">(aa)</num><content> on whether the exemption under <ref href="/us/usc/t5/s552/b/3">section 552(b)(3) of title 5</ref> (known as the Freedom of Information Act) established in paragraph (2)(A) aids whistleblowers in disclosing information to the Commission;</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id698b047a-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/2/C/iii/I/bb"><num value="bb">(bb)</num><content> on what impact the exemption has had on the public’s ability to access information about the Commission’s regulation of commodity futures and option markets; and</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id698b047b-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/2/C/iii/I/cc"><num value="cc">(cc)</num><content> to make any recommendations on whether the Commission should continue to use the exemption.</content>
</item>
</subclause>
<subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="id698b047c-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/2/C/iii/II"><num value="II" class="bold">(II)</num><heading class="bold"> Report</heading><chapeau>Not later than 30 months after <date date="2010-07-21">July 21, 2010</date>, the Inspector General shall—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="id698b047d-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/2/C/iii/II/aa"><num value="aa">(aa)</num><content> submit a report on the findings of the study required under this clause to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives; and</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id698b047e-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/2/C/iii/II/bb"><num value="bb">(bb)</num><content> make the report available to the public through publication of a report on the website of the Commission.</content>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id698b047f-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/h/3"><num value="3" class="bold">(3)</num><heading class="bold"> Rights retained</heading><content><p style="-uslm-lc:I12" class="indent1">Nothing in this section shall be deemed to diminish the rights, privileges, or remedies of any whistleblower under any Federal or State law, or under any collective bargaining agreement.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id698b0480-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/i"><num value="i" class="bold">(i)</num><heading class="bold"> Rulemaking authority</heading><content><p style="-uslm-lc:I11" class="indent0">The Commission shall have the authority to issue such rules and regulations as may be necessary or appropriate to implement the provisions of this section consistent with the purposes of this section.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id698b0481-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/j"><num value="j" class="bold">(j)</num><heading class="bold"> Implementing rules</heading><content><p style="-uslm-lc:I11" class="indent0">The Commission shall issue final rules or regulations implementing the provisions of this section not later than 270 days after <date date="2010-07-21">July 21, 2010</date>.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id698b0482-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/k"><num value="k" class="bold">(k)</num><heading class="bold"> Original information</heading><content><p style="-uslm-lc:I11" class="indent0">Information submitted to the Commission by a whistleblower in accordance with rules or regulations implementing this section shall not lose its status as original information solely because the whistleblower submitted such information prior to the effective date of such rules or regulations, provided such information was submitted after <date date="2010-07-21">July 21, 2010</date>.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id698b0483-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/l"><num value="l" class="bold">(l)</num><heading class="bold"> Awards</heading><content><p style="-uslm-lc:I11" class="indent0">A whistleblower may receive an award pursuant to this section regardless of whether any violation of a provision of this chapter, or a rule or regulation thereunder, underlying the judicial or administrative action upon which the award is based occurred prior to <date date="2010-07-21">July 21, 2010</date>.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id698b0484-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/m"><num value="m" class="bold">(m)</num><heading class="bold"> Provision of false information</heading><content><p style="-uslm-lc:I11" class="indent0">A whistleblower who knowingly and willfully makes any false, fictitious, or fraudulent statement or representation, or who makes or uses any false writing or document knowing the same to contain any false, fictitious, or fraudulent statement or entry, shall not be entitled to an award under this section and shall be subject to prosecution under <ref href="/us/usc/t18/s1001">section 1001 of title 18</ref>.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id698b0485-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/n"><num value="n" class="bold">(n)</num><heading class="bold"> Nonenforceability of certain provisions waiving rights and remedies or requiring arbitration of disputes</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id698b0486-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s26/n/1"><num value="1" class="bold">(1)</num><heading class="bold"> Waiver of rights and remedies</heading><content><p style="-uslm-lc:I12" class="indent1">The rights and remedies provided for in this section may not be waived by any agreement, policy form, or condition of employment including by a predispute arbitration agreement.</p>
