<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id6aeda289-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s2702"><num value="2702">§ 2702.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">As used in this chapter—</chapeau><subsection style="-uslm-lc:I11" class="indent0" id="id6aeda28a-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s2702/a"><num value="a">(a)</num><content> The term “Secretary” means the Secretary of Agriculture or any other officer or employee of the Department of Agriculture to whom there has heretofore been delegated, or to whom there may hereafter be delegated, the authority to act in his stead.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6aeda28b-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s2702/b"><num value="b">(b)</num><content> The term “person” means any individual, group of individuals, partnership, corporation, association, cooperative, or any other entity.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6aeda28c-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s2702/c"><num value="c"> (c)</num><content> The term “commercial eggs” or “eggs” means eggs from domesticated chickens which are sold for human consumption either in shell egg form or for further processing into egg products.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6aeda28d-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s2702/d"><num value="d">(d)</num><content> The term “hen” or “laying hen” means a domesticated female chicken twenty weeks of age or over, raised primarily for the production of commercial eggs.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6aeda28e-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s2702/e"><num value="e">(e)</num><content> The term “egg producer” means the person owning laying hens engaged in the production of commercial eggs.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6aeda28f-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s2702/f"><num value="f">(f)</num><content> The term “case” means a standard shipping package containing thirty dozen eggs.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6aeda290-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s2702/g"><num value="g">(g)</num><content> The term “hatching eggs” means eggs intended for use by hatcheries for the production of baby chicks.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6aeda291-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s2702/h"><num value="h">(h)</num><content> The term “United States” means the forty-eight contiguous States of the United States of America and the District of Columbia.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6aeda292-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s2702/i"><num value="i">(i)</num><content> The term “promotion” means any action, including paid advertising, to advance the image or desirability of eggs, egg products, spent fowl, or products of spent fowl.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6aeda293-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s2702/j"><num value="j">(j)</num><content> The term “research” means any type of research to advance the image, desirability, marketability, production, or quality of eggs, egg products, spent fowl, or products of spent fowl.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6aeda294-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s2702/k"><num value="k">(k)</num><content> The term “consumer education” means any action to advance the image or desirability of eggs, egg products, spent fowl, or products of spent fowl.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6aeda295-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s2702/l"><num value="l">(l)</num><content> The term “marketing” means the sale or other disposition of commercial eggs, egg products, spent fowl, or products of spent fowl, in any channel of commerce.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6aeda296-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s2702/m"><num value="m">(m)</num><content> The term “commerce” means interstate, foreign, or intrastate commerce.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6aeda297-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s2702/n"><num value="n">(n)</num><content> The term “egg products” means products produced, in whole or in part, from eggs.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6aeda298-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s2702/o"><num value="o">(o)</num><content> The term “spent fowl” means hens which have been in production of commercial eggs and have been removed from such production for slaughter.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6aeda299-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s2702/p"><num value="p">(p)</num><content> The term “products of spent fowl” means commercial products produced from spent fowl.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6aeda29a-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s2702/q"><num value="q">(q)</num><content> The term “hatchery operator” means any person engaged in the production of egg-type baby chicks.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6aeda29b-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s2702/r"><num value="r">(r)</num><content> The term “started pullet” means a hen less than twenty weeks of age.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6aeda29c-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s2702/s"><num value="s">(s)</num><content> The term “started pullet dealer” means any person engaged in the sale of started pullets.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6aeda29d-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s2702/t"><num value="t">(t)</num><content> The term “handler” means any person, specified in the order or the rules and regulations issued thereunder, who receives or otherwise acquires eggs from an egg producer, and processes, prepares for marketing, or markets, such eggs, including eggs of his own production.</content>
</subsection>
