<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id36bd0309-67ea-11f0-abe3-a99c69ea2bc3" identifier="/us/usc/t7/s27"><num value="27">§ 27.</num><heading> Definitions</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id36bd030a-67ea-11f0-abe3-a99c69ea2bc3" identifier="/us/usc/t7/s27/a"><num value="a" class="bold">(a)</num><heading class="bold"> Bank</heading><chapeau style="-uslm-lc:I11" class="indent0">In sections 27 to 27f of this title, the term “bank” means—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id36bd030b-67ea-11f0-abe3-a99c69ea2bc3" identifier="/us/usc/t7/s27/a/1"><num value="1">(1)</num><content> any depository institution (as defined in <ref href="/us/usc/t12/s1813/c">section 1813(c) of title 12</ref>);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id36bd030c-67ea-11f0-abe3-a99c69ea2bc3" identifier="/us/usc/t7/s27/a/2"><num value="2">(2)</num><content> any foreign bank or branch or agency of a foreign bank (each as defined in <ref href="/us/usc/t12/s3101">section 3101 of title 12</ref>);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id36bd030d-67ea-11f0-abe3-a99c69ea2bc3" identifier="/us/usc/t7/s27/a/3"><num value="3">(3)</num><content> any Federal or State credit union (as defined in <ref href="/us/usc/t12/s1752">section 1752 of title 12</ref>);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id36bd030e-67ea-11f0-abe3-a99c69ea2bc3" identifier="/us/usc/t7/s27/a/4"><num value="4">(4)</num><content> any corporation organized under section 25A of the Federal Reserve Act [<ref href="/us/usc/t12/s611">12 U.S.C. 611</ref> et seq.];</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id36bd030f-67ea-11f0-abe3-a99c69ea2bc3" identifier="/us/usc/t7/s27/a/5"><num value="5">(5)</num><content> any corporation operating under section 25 of the Federal Reserve Act [<ref href="/us/usc/t12/s601">12 U.S.C. 601</ref> et seq.];</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id36bd0310-67ea-11f0-abe3-a99c69ea2bc3" identifier="/us/usc/t7/s27/a/6"><num value="6">(6)</num><content> any trust company; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id36bd0311-67ea-11f0-abe3-a99c69ea2bc3" identifier="/us/usc/t7/s27/a/7"><num value="7">(7)</num><content> any subsidiary of any entity described in paragraph <ref class="footnoteRef" idref="fn002061">1</ref><note type="footnote" id="fn002061"><num>1</num> So in original. Probably should be “paragraphs”.</note> (1) through (6) of this subsection, if the subsidiary is regulated as if the subsidiary were part of the entity and is not a broker or dealer (as such terms are defined in <ref href="/us/usc/t15/s78c">section 78c of title 15</ref>) or a futures commission merchant (as defined in <ref href="/us/usc/t7/s1a">section 1a of this title</ref>).</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id36bd0312-67ea-11f0-abe3-a99c69ea2bc3" identifier="/us/usc/t7/s27/b"><num value="b" class="bold">(b)</num><heading class="bold"> Identified banking product</heading><chapeau style="-uslm-lc:I11" class="indent0">In sections 27 to 27f of this title, the term “identified banking product” shall have the same meaning as in paragraphs (1) through (5) of section 206(a) of the Gramm-Leach-Bliley Act, except that in applying such section for purposes of sections 27 to 27f of this title—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id36bd0313-67ea-11f0-abe3-a99c69ea2bc3" identifier="/us/usc/t7/s27/b/1"><num value="1">(1)</num><content> the term “bank” shall have the meaning given in subsection (a) of this section; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id36bd0314-67ea-11f0-abe3-a99c69ea2bc3" identifier="/us/usc/t7/s27/b/2"><num value="2">(2)</num><content> the term “qualified investor” means eligible contract participant (as defined in <ref href="/us/usc/t7/s1a">section 1a of this title</ref>, as in effect on <date date="2000-12-21">December 21, 2000</date>).</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id36bd0315-67ea-11f0-abe3-a99c69ea2bc3" identifier="/us/usc/t7/s27/c"><num value="c" class="bold">(c)</num><heading class="bold"> Hybrid instrument</heading><content><p style="-uslm-lc:I11" class="indent0">In sections 27 to 27f of this title, the term “hybrid instrument” means an identified banking product not excluded by <ref href="/us/usc/t7/s27a">section 27a of this title</ref>, offered by a bank, having one or more payments indexed to the value, level, or rate of, or providing for the delivery of, one or more commodities (as defined in <ref href="/us/usc/t7/s1a">section 1a of this title</ref>).</p>
